PERFORMANCE WORK STATEMENT FOR
VERTICAL TRANSPORTATION EQUIPMENT
MAINTENANCE, REPAIR, & INSPECTION SERVICES
SECTION I
1. DESCRIPTION OF SERVICES.
1.1. General. The Contractor shall provide all management, tools, supplies, equipment, parts and labor necessary to maintain, repair, and inspect the real property vertical transportation equipment (VTE) at Joint Base Elmendorf-Richardson (JBER) in a manner that will ensure continuous and safe operation (full maintenance and repair with the exception of the exclusions listed in paragraph 1.3 below). The VTEs and their locations are listed in Appendix A. NOTE: The term “VTE” in this Performance Work Statement (PWS) includes all equipment listed in Appendix A: freight and passenger elevators and wheelchair/stair lifts.
1.1.1. Overview. This full maintenance contract signifies a VTE service provider (Contractor) takes total service responsibility for the equipment identified in the contract. Except those services covered in paragraph 1.3 below, the monthly fixed price includes all inspections, maintenance, repairs, replacements, and routine and emergency service calls. This contract allows the Government to budget total yearly costs and eliminates concerns relating to individual parts repair or replacement invoicing.
The Contractor assumes all responsibility and determines the amount of service visits and types of service required to keep the VTE operating safely and within the performance objectives of Section II.
1.2. Objectives. Work conducted on VTE will be in accordance with the American Society of Mechanical Engineers (ASME) A17.1-2007 (or applicable code for year VTE put in service), Safety Code for Elevators and Escalators (ASME A17.1), ANSI/ASME A17.2-2010, Guide for Inspection of Elevators, Escalators, and Moving Walks (applicable to equipment), A17.3-2011, Safety Code for Existing Elevators and Escalators (applicable to equipment), National Fire Protection Association Standards (NFPA), Unified Facilities Criteria (UFC) 3-600-01, Fire Protection Engineering for Facilities, Occupational Safety and Health Administration (OSHA) Standards and the recommendations of the original equipment manufacturer (OEM).
1.3. Excluded Services. The following are not covered in the full maintenance service arrangement and are considered over and above services:
1.3.1. Modifications. Alterations (a.k.a., modernizations) are not covered in the full maintenance service arrangement. (See Paragraph 1.4.2.)
1.3.2. Damage. Acts by parties other than the Contractor of vandalism, abuse, negligence, damage resulting from rescue and recovery operations, acts of God (including damage resulting from emergency power generator power spikes and low quality) are not included in the contract.
1.3.3. Additional. Items excluded from full maintenance coverage are; cosmetic, construction, ancillary components of the VTE system including the finishing, repairing or replacement of the cab enclosure, ceiling frames, hoistway door panels, door frames, sills, car flooring, floor covering, main line power switches, main power breaker(s), hydraulic elevator jack outer housing, buried piping, smoke and fire sensors, fire service reports, main communication feeders to controller, security systems, batteries for emergency lighting and lowering that are not solely dedicated to the VTE, air conditioners, and heaters.
1.3.4. Cleaning. Routine cleaning and refinishing of the interior of cars and the exterior of the hoistway doors and frames is not included in the basic full maintenance service.
1.3.5. Reporting. In the event that the Contractor encounters an item of work included in paragraph
1.3 through 1.3.4, the Contractor will report the situation to the Contracting Officer’s Representative (COR). The report will include the work location, a detailed scope of the required work, justification for Contractor determination that the work was not included in the contract, and an itemized cost estimate (including time to repair, all required parts and a breakdown of labor hours). NOTE: Any part, component or assembly unavailable from the manufacturer due to obsolescence, remains the Contractor’s responsibility to obtain an engineered equivalent product from a commercial source.
1.4. Definitions.
1.4.1. Maintenance, Repair, and Replacement. Maintenance, repair and replacement are on existing VTE and included in the contract scope of services. All maintenance, repair and replacement of damaged, broken, or worn parts are to be done in a manner that ensures that the equipment may be operated safely. Maintenance, repair and replacement are actions to restore equipment to a state in which it may safely perform its required operations as installed in accordance with the manufacturer’s recommendations. See ASME A17.1 for requirements.
1.4.2. Alterations. Any existing VTE alterations are not included under the full maintenance service arrangement. Alteration/modernization may be covered on an over and above Contract Line Item or it may result in a modification to the contract. Typically alterations are done to enhance the operation or safety of the equipment. In the case of elevators, when an alteration is made, all affected safety requirements must be complied with. All work as part of an alteration is required to comply with specific requirements of the current ASME A17.1 Code edition. See ASME A17.1 for requirements.
1.5. Maintenance and Inspection Services.
1.5.1. Initial Condition Assessment. The Contractor with the CO/COR (or representative) shall determine the working order and condition of all VTE listed in Appendix A within thirty (30) calendar days of contract award. The Government will either replace missing items or repair all items not in working order or serviceable condition, or the CO will direct the Contractor to replace the missing items, accomplish the repair, and reimburse the Contractor in accordance with the contract. The CO will give instructions for situations where a unit requires a level of repair potentially constituting alteration as described by paragraph 1.4.2. The Contractor and the CO shall certify their agreement as to the working order of the equipment. All repair work shall be in accordance with standard commercial practices using only new parts of equal quality specified by the VTE manufacturer in effecting repairs (substitution of a different component is only permitted where it is equivalent to that which was tested, as determined by the certifying agency).
1.5.2. Maintenance Control Program. The Contractor shall develop and submit to the Government an annual written Maintenance Control Program (MCP) for each VTE within thirty (30) calendar days after contract award to cover the basic contract and any option periods. The MCP shall, at a minimum, include required inspections, timelines for inspections and maintenance to be performed. The Contractor shall perform inspections and maintenance of all VTE in accordance with the MCP.
Inspections and maintenance shall be performed during regular scheduled work days/hours. The MCP shall ensure compliance with all minimum code requirements.
1.5.3. Maintenance Objectives. The Contractor shall perform maintenance in accordance with the MCP to ensure reliable and continuous safe operation. The maintenance work shall be in accordance with commercial practices or manufacturer’s specifications, if available, and shall be intended to maintain the VTE in safe and reliable operating condition. The MCP is required to specify appropriate intervals for specific maintenance items.
1.5.4. Job Site. Cleaning of equipment spaces and daily cleanup of job sites in conjunction with maintenance, inspections and tests, and repairs are required.
1.5.5. Maintenance Standards. The Contractor shall perform necessary inspections and tests as required under ASME A17.1 Appendix N, using a Qualified Elevator Inspector (QEI). The first annual test (initial) shall include the five-(5)-year test for all traction and roped hydraulic elevators regardless of due date. On the third anniversary of the initial test, the three-(3)-year test and the annual test shall be accomplished simultaneously.
1.5.6. Government Inspections. The Government may perform inspections of the VTE at no cost to the Contractor for purposes of capital asset management and quality assurance. If discrepancies are discovered during these inspections, the Contractor will be notified in writing of any determination and may be responsible for the corrective actions.
1.5.7. Maintenance Reports. The Contractor shall prepare and submit a written report within two (2) business days of work completion. The report shall identify each VTE, the location, maintenance work performed, repairs needed, date of inspection, name of inspector, and overall condition of the VTE.

1.5.8. Retention of Maintenance Records. The Contractor shall maintain a copy of all current VTE inspection documentation, along with an index indicating the location, date inspected, and date of the next required inspection. Provide the original to the CO/COR. The index and copies of certificates shall be delivered to the CO/COR upon request; however, no later than two (2) business days of a request to review. (SS-4)
1.6. Repair Service Calls. The Contractor shall provide service calls (routine and emergency) under the full maintenance service agreement at no additional charge. All repair work shall be done in accordance with standard commercial practices and completed within 7 days of receipt of all materials.
Evidence of parts orders shall be provided to the government upon request. Contractor shall repair and replace components of the VTE at no additional cost to the Government. When a component in a labeled product is replaced, it must be replaced with an identical component manufactured under the original labeling service (certifying agency). Substitution of a different component is only permitted where it is equivalent to that which was tested, as determined by the certifying agency. The parts used for replacement are required to comply with all the requirements that the old parts originally complied with. The Unified Facilities Guide Specifications (UFGS) and the UFC will be used to benchmark acceptable replacement components. 1.6.1. Routine Service Calls. Service calls will be classified as routine when the work or adjustments do not qualify as an emergency call.
1.6.1.1. Routine Service Call Notifications. The CO or COR will notify the Contractor of any routine service calls.
1.6.1.2. Routine Service Call Response. The Contractor shall respond in-person to the VTE and begin work on routine service calls at no additional cost to the Government within 24 hours after receipt of the call on regular scheduled work days/hours. (SS-1)
1.6.1.3. Routine Service Call Repair Procedures and Reports. The Contractor shall report to the work location, survey the repair, and provide the CO/COR an estimate of time and cost of repairs not covered in the full maintenance service contract, but necessary to bring the VTE back to operation. The COR can approve estimates under $2,500, all other estimates will be considered and approved by the CO. The Contractor shall commence repair work after notification from the CO/COR. Time and charges shall commence when contractor personnel arrive at the site. Charges shall not be incurred while the Contractor is awaiting parts or additional personnel. The Contractor upon examination of the service call shall notify the COR of projected downtime and estimated time for repair no later than 1530 hours the following business day. The Contractor shall post a sign on the unit stating when repairs are to be completed. The COR shall be notified upon completion of all routine service calls.
The Contractor shall prepare and submit to the CO/COR a written report within two (2) business days after the repair. The report shall include the date and time of the service call, the location of the VTE, the repairs performed, and the name of the technician performing the repairs. (SS-4)
1.6.2. Emergency Service Calls. Emergency calls are defined as calls made for services when a VTE system fails and constitutes a danger to personnel; threatens to damage properties; or threatens to disrupt activity, operations, and/or training missions.
1.6.2.1 Emergency Service Call Notifications. The CO, COR or Emergency Services personnel will notify the Contractor of any emergency service calls.
1.6.2.2. Emergency Service Call Response. The Contractor shall respond in person to the VTE and begin work on emergency service calls within 2 hours after receipt of the call on regular scheduled work days/hours, after hours, weekends, and recognized holidays. (SS-2)
1.6.2.3. Emergency Call Repair Procedures and Reports. 1.7. Work Schedule. The Contractor shall submit a monthly work schedule to the COR no later than five (5) business days prior to the start of the month for all services described in this PWS. (SS-4)
1.8. Monthly Invoicing. The Contractor shall invoice monthly for all service calls for the previous month.
SECTION II
2. SERVICE SUMMARY.
2.1 General. The contract service requirements are summarized in performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimally acceptable levels of service required for each requirement. The Services Summary (SS) provides information on contract requirements, the expected level of Contractor performance, and the expected method of government validation and confirmation of services provided. These thresholds are critical to mission success. Procedures as set forth in the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies.

2.2. Quality Assurance. The Government shall inspect and evaluate the Contractor’s performance to ensure services are received in accordance with requirements set forth in this PWS. The Contractor shall provide work schedules in accordance with paragraph 1.7. The COR shall inspect by validating actual work performance, physically checking an attribute of the completed task, checking a management information report, investigating customer complaints, conferring with facility managers, or otherwise inspecting the task or its results to determine whether or not performance meets the standards contained in this PWS. The COR will use the Contractor’s work schedule or modified version thereof, to record validation results. When a performance threshold has not been met or Contractor performance has not been accomplished, the COR will initiate and provide the CO a Contract Discrepancy Report (CDR) DD Form 2772 for issuance to the Contractor. The Contractor shall respond to the CDR IAW instructions provided and return it to the CO within 10 calendar days of receipt.
2.3. Performance Assessment.
2.3.1. Periodic Inspection. This method requires the COR to employ a “spot check” style of evaluation based on the contractor’s monthly schedule. Periodic surveillances will be conducted on a scheduled basis (daily, weekly, monthly, quarterly, semi-annual or annually) and may be adjusted based on quality trends.
2.3.2. Random Inspection. Random Inspection is a COR evaluation method designed to evaluate some part, but not all, of the contract requirement being monitored. Using random surveillance, any occurrence of a contract requirement is as likely to be evaluated as any other occurrence. With this type of surveillance, the Contractor is unable to guess which occurrences of work are most likely to be evaluated. Evaluations are conducted by the COR. Results are compared to performance standards to check conformance.
2.3.3. Customer Complaints. The COR will receive and investigate complaints. The COR shall be responsible for initially validating customer complaints. The CO shall make final determination of the validity of customer complaint(s) in cases of disagreement between the COR and the Contractor.
Validated customer complaints shall be re-performed within two (2) hours of notification, if performance can be completed without detrimental impact on customer.
2.3.4. Unsatisfactory Performance. Any unsatisfactory inspection (defect) result shall be recorded, and the Contractor shall re-perform the service within 24 hours after notification by the COR.
2.3.5. Performance Thresholds. Exceeding the performance threshold of these performance objectives, in any combination for any two, or more consecutive or non-consecutive months during a contract period shall constitute an immediate Progress Meeting with the Multi-functional Team (MFT).
All remedies shall be IAW the Federal Acquisition Regulation (FAR) 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance.
SECTION III
3.0 GOVERNMENT FURNISHED PROPERTYAND SERVICES.
3.1 Government Furnished Property. (Reserved)
3.2. Keys. The Contractor shall be accountable for elevator keys supplied by the Government. The Contractor, at no cost to the Government, shall replace lost or damaged keys.
3.3. Security, Fire, and Medical Services. The Government will provide police and fire protection.
In the event of a medical emergency, base ambulance service for transporting an injured employee to a local hospital is available on a cost reimbursement basis. For security, fire, or medical emergencies, contractors shall call 911. Security Forces can also be reached at 552-4444. All mishaps will be promptly reported to the base safety office through the CO or COR.
3.4. Utilities. The Government will provide all electricity, water, and sewage, needed to complete the requirements of this contract, at no cost to the Contractor. The Contractor shall instruct employees in utility conservation practices.
SECTION IV
4.0. GENERAL INFORMATION.
4.1. Hours of Operation. The Contractor shall perform VTE maintenance services during normal business hours (7:30 a.m. to 4:30 p.m., Monday through Friday) and shall be available for after-hours response to emergencies, to include weekends and recognized holidays.
4.1.1. Recognized Holidays.
New Year’s Day Martin Luther King Jr.’s Birthday President’s Day Memorial Day Independence Day Labor Day Columbus Day Veteran’s Day Thanksgiving Day Christmas Day *If the holiday falls on a Saturday, it will be observed on the preceding Friday. If the holiday falls on Sunday, it will be observed on the following Monday.
4.2. Performance of Service during Crisis or Heightened Security. The services under this contract are not essential for performance during crisis. The CO will determine circumstances which constitute a crisis based on direction from Security Forces and base leadership.
4.3. Contract Manager. The Contractor shall provide a contract manager and alternate(s), who are knowledgeable in VTE maintenance, and can be reached during normal business hours. The Contractor shall provide the CO/COR telephone number(s) for the contract manager and alternate(s) within two
(2) days of contract start date. The Contractor shall also provide to the CO/COR the names and phone numbers of contractor POCs for after business hours including nights, weekends, and recognized holidays. This information will be kept updated by the Contractor whenever personnel changes occur.
4.3.1. Authority. The contract manager or alternate(s) shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract.
4.3.2. Availability. The contract manager or alternate(s) shall be available during normal business hours to meet on the installation within two (2) hours with government personnel designated by the CO/COR to discuss areas of concern.
4.3.3. Communication. The contract manager and alternate(s) must be able to read, write, speak, and understand the English language. (Speaking skill is not required where the contractor employee is hearing impaired.)
4.4. Personnel. Contractor personnel shall present a neat appearance. Contractor personnel shall be easily recognizable while on the installation in conjunction with this contract. This shall be accomplished through the wear of distinctive clothing, overcoats, or hats, bearing the company name or logo. The coloring or design of the items selected should be such that identifies personnel easily and quickly for reasons of safety and personal protection.
4.4.1. Alcohol/Drug Use. Contractor personnel shall not consume alcoholic beverages or illegal drugs, while on duty. The Contractor shall immediately remove any employee who is under the influence of alcohol or drugs.
4.4.2. Smoking. Contractor personnel shall smoke cigarettes in designated smoking areas only.
4.5. Conflicts of Interest.
4.5.1. U.S. Government Employees. The Contractor shall not employ any person who is an U.S.
Government employee if employing that person would create a conflict of interest. In addition, the Contractor shall not employ any person who is an employee of the Department of the Defense if such employment would be contrary to the policies contained in AFI 64-106, Chapter 1, Industrial Labor Relations Activities.
4.5.2. Spouses and Dependents. The Contractor shall not employ any person who is a spouse or dependent of a Department of the Air Force or Department of Army employee (either military or civilian) if employing that person would create a conflict of interest or appearance of a conflict of interest by virtue of such employment.
4.5.3. Off-duty Military Personnel. The Contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours, or deployment. Military Reservists and National Guard members may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the Contractor's ability to perform. However, their absence at any time shall not constitute an excuse for nonperformance under this contract.
4.6. Special Qualifications. The Contractor shall be licensed by the state in which the work is conducted to provide the services specified in this contract. All work will be performed by personnel who are trained and qualified for the systems and equipment. The Contractor shall ensure personnel are certified by appropriate federal and state regulatory agencies to meet federal and local certification requirements for the maintenance of the VTE. The Contractor shall provide documentation to the CO/COR upon request.
4.7. Employee Restrictions. The Government is authorized to restrict employment under the contract of any contractor employee or prospective contractor employee who is identified as a potential threat to the health, safety, security, general well-being, or operational mission of the installation and its population.
4.8. Contractor Manpower Reporting. The Contractor shall report all contractor labor hours (including sub-contractor labor hours) required for performance of services provided under this contract for “U.S. Air Force” via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address http://www.ecmra.mil. Reporting inputs will be for the labor executed during the period of performance during each government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the electronic Contractor Manpower Reporting Application (eCMRA) help desk.
4.9. Security. The Contractor shall ensure that employees comply with JBER security requirements imposed by the Installation Commander at all times while on JBER premises. The Contractor shall obtain all necessary passes, decals, badges, or other items required for access to perform contract services at JBER. The Contractor is responsible for accountability of all such media, which shall be surrendered to the Security Forces Squadron Pass and Registration Section upon completion or termination of the contract or upon termination of an individual’s employment for the Contractor. The Contractor shall comply with all JBER policies regarding entry to the installation, rules of the road, contingency operations compliance, and photography prohibitions. Contractor employees are authorized entry to the installation for the purpose of work under this contract only, and are not authorized in other facilities or areas without prior government authorization. Due to safety/security requirements, Contractor personnel shall be required to fluently speak, comprehend, read, and write English.
4.9.1. Base Access. The Contractor must be aware that entry requirements are subject to change due to installation and world situations. All employees may be subject to a background check through the FBI for base access.
4.9.1.1. The Contractor shall obtain base identification and vehicle passes for all Contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. The Contractor shall supply the CO with a list of employees and subcontractor personnel requiring access as changes occur.
4.9.1.2. The Contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the installation.
4.9.1.3. Upon completion or termination of the contract or expiration of the identification passes, the Contractor shall ensure that all passes issued to employees and subcontractor employees are returned to the issuing office. Failure to comply with these requirements may result in withholding of final payment.
4.10. Restricted Area Entry and Escort. The Contractor shall contact Civil Engineering (CE) customer service by email or telephone at 773ces.csu@us.af.mil or 552-3727 to arrange for entry and escort service, when required, in secure or restricted locations on base.
4.11. Notification of Debarment/Suspension Status. The Contractor shall provide immediate notice to the CO in the event of being suspended, debarred or declared ineligible by any other Federal Department or agency, or upon receipt of a notice of proposed debarment from another DOD Agency, during the performance of this contract.
4.12. Physical Security. The Contractor shall secure all government facilities, equipment, and materials at the end of each work period.
4.13. Safety.
4.13.1. General. The Contractor shall perform work in a safe manner as required by OSHA Safety and Health Requirements. The Contractor shall provide a verbal report to the CO/COR, as soon as possible, of each occurrence of damage to Government property or an accident resulting in death, injury, occupational disease, or adverse environmental impact. The Contractor shall provide a completed copy of the required Accident Investigation Reports to the CO/COR within five (5) calendar days of each occurrence. Contractor shall provide personal protective equipment to all workers for use at all times during performance of services if required.
4.13.2. Contractor Vehicles. Contractor vehicles shall be maintained in a safe and operational condition at all times while on JBER. Contractor vehicles shall be clearly identified with the contractor’s name on both sides. The contractor shall be responsible for ensuring that all vehicles are properly licensed and registered IAW state, local and installation regulations.
4.13.2.1. Privately Owned Vehicles. The Contractor shall ensure that employees required to operate a privately owned vehicle on the installation are properly licensed and registered IAW state, local and installation regulations.
4.13.2.2. Traffic Laws. The Contractor and its employees shall comply with base traffic regulations and may be subject to search prior to authorization to proceed through gate.
4.13.2.3. Weapons, Firearms, and Ammunition. Contractor employees are prohibited from possessing weapons, firearms, or ammunition on themselves or within their Contractor-owned, or privately owned vehicles while on JBER.
4.13.2.4. Cell Phone Usage. Driving or being in physical control of a motor vehicle on JBER, while operating a cellular phone or like device, is prohibited unless the vehicle is safely parked or unless the driver of the vehicle is using a hands-free device. The wearing of any other portable headphones, earphones or other listening devices (except for hands-free cellular phones) while operating a motor vehicle is also prohibited. Contractors or their employees who fail to comply with this policy are subject to loss of driving privileges on JBER.
4.14. Insurance. The contractor shall, at its own expense, obtain and maintain during the entire performance of this contract, the necessary insurance as required by FAR 52.228-5, Part 28.3. The minimum amounts of insurance will be maintained IAW FAR 28.307-2.
4.15. Privacy Act. The Contractor shall adhere to the Privacy Act, Title 5 of the U.S. Code, Section 552a and applicable agency rules and regulations when handling such information.
4.16. Environmental Control. The Contractor shall comply, and assure that all subcontractors comply, with all applicable federal, state, and local laws, regulations, ordinances, policies and standards related to environmental matters.
4.16.1. Asbestos. The Contractor shall comply with Section 29 CFR 1910.1001(j)(7)(iv). VTE may be located in facilities that may contain asbestos containing material (ACM) or presumed asbestos containing material (PACM). The Contractor (not the Government) shall determine if any exposure to ACM may result in performing work under the contract.
4.16.2. Hazardous Materials. The Contractor shall submit a list of all hazardous materials and the associated Safety Data Sheets (SDSs), to the CO/COR and 673d CES/CEIEC, Environment Flight prior to the use of any hazardous materials. The Contractor must receive approval from the Environment Flight for all hazardous materials prior to transporting them onto JBER. The Contractor shall inform the CO/COR and the Environment Flight of any proposed changes to the approved hazardous material list and must gain prior approval for any new additions before use.
4.16.3. Hazardous Waste. The Contractor shall manage all generated hazardous waste (HW) applicable to large quantity generators (LQGs) of HW and all universal waste (UW) applicable to large quantity handlers of UW, in accordance with federal regulation (40 CFR) applicable to hazardous and universal waste management, and with the JBER OPlan 19-3, Environmental Management Plan.
4.16.3.1 Hazardous Waste Determination. The Contractor shall determine if waste generated by contract activities are considered hazardous. Waste determinations shall comply with 40 CFR, Part 261, Subpart C. Information from a Safety Data Sheet (SDS), knowledge of a waste generating process, and/or results of laboratory analysis of a representative sample of the waste, may be used to determine if waste is hazardous. The Contractor shall provide, 673 CES/CEIEC, HW Program Manager, copies of information used to make each waste determination.
4.16.3.2. Hazardous Waste Tracking. All products that meet the criteria of HW must be bar coded and tracked until permanently removed from Government property.
4.16.3.3. Hazardous Waste Employee Training. The contractor shall train all employees, and maintain documentation of training, as required by state and federal regulation applicable to HW or UW generated by the contractor's activities on JBER.
4.16.3.4. Manifests. The Contractor shall provide, 673 CES/CEIEC, HW Program Manager, all manifests (OMB Control number 2050–0039) on EPA Form 8700–22, and, if necessary, EPA Form 8700–22A, and all waste determination documentation (as required by 40 CFR) for each HW item to be transported off of the installation. The 673 CES/CEIEC, HW Program Manager, will review documents for compliance and then sign the manifest. The completed manifest must accompany all HW transported off of the installation. Contractor personnel are not authorized to sign manifests. The JBER USEPA number AK8570028649 must be used on all manifests accompanying HW generated on and transported off of the installation. The Contractor is responsible for obtaining all necessary manifest forms, for proper completion of each as required, and for assignment of manifest numbers.
4.16.3.5. Hazardous Waste Transportation. The Contractor shall ensure all HW is transported by licensed HW transporters to a designated and permitted HW treatment, storage, or disposal facility and must comply with all related requirements within 40 CFR, 49 CFR, and JBER OPLAN 19-3. The contractor shall not use the JBER HW support contract, and shall not bring any HW or UW to any JBER satellite accumulation area, the JBER central accumulation area, or the Resource Conservation and Recovery Act (RCRA) permitted storage facility on JBER.
4.16.3.6. Contact and Reporting. The Contractor shall make all contact and provide all applicable reports, when required by 40 CFR 262.42 (Exception Reporting), to the Environment Protection Agency (EPA) Regional Administrator. The Contractor shall provide the CO/COR and 673 CES/CEIEC, HW Program Manager documentation of contact and copies of required reports.
4.16.3.7. Spills and Releases. The Contractor shall immediately notify the CO/COR and appropriate emergency responders if the Contractor spills or releases hazardous material or other substance contained in 40 CFR 302 into the environment. The Contractor is responsible for all costs associated with clean-up and restoration, including any applicable fines and/or penalties. The Contractor shall maintain a spill plan as required by federal, state, and local laws and regulations.
