About this file
This document is a Sole Source (Including Brand Name) Justification for Simplified Procedures for Certain Commercial Items. It provides the rationale for awarding a sole source contract to American Pacific Plastic Fabricators, Inc. (APPF, Inc.) for the procurement of LAMS liners.
The justification explains that the LAMS and associated liners are proprietary to Clamshell Structures, Inc., which holds the relevant patents. Clamshell Structures, Inc. is going out of business, but has authorized APPF, Inc. to continue manufacturing the Clamshell panels and liners. Other vendors would not be able to produce compatible liners, as the LAMS specifications are proprietary. The contract was awarded to APPF, Inc. on a sole source basis for $2,970,000 on September 11, 2024. The liners are needed to maintain temperature ranges inside the LAMS for low observable aircraft maintenance and operations. Without the liners, the government's capabilities would be diminished.

Sole Source (Including Brand Name) Justification - Simplified Procedures for Certain Commercial Items
CONTROLLED UNCLASSIFIED INFORMATION
March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 3 of 4 designs of Clamshell Structures, Inc. are proprietary to Clamshell Buildings and are covered by US Patent #4,583,331 issued on 04/22/1986, along with other patents subsequent thereto. Clamshell Structures, Inc. is the sole source and authorized supplier of Clamshelters and the related parts. Clamshell Structures, Inc. has manufactured and sold tension fabric buildings (Clamshelters, also called “Clamshells” or “Clamshell Buildings”) and the related parts for Clamshelters since 1983. Clamshell Structures, Inc. has not licensed to any other party the right to sell Clamshelters or the related parts. Other vendors would not be able to make a liner compatible with a LAMS built by Clamshell Structures, Inc. because Clamshell Structures, Inc. would not release their proprietary build specifications.
Per the manufacture, the life expectancy if installed on arrival is 7-10 Years. If stored in a climate controlled location the lifespan is also 7-10 years. If stored in a non-environmentally controlled warehouse the lifespan is only 1 year. Amentum (WRM Contractor in the AOR) will be storing these inside their temperature controlled warehouses.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Market Research was conducted on 27 Jun 24 to the extent practicable commensurate to the complexity and estimated dollar amount of this requirement IAW FAR 10. It was determined that Clamshell Structures, Inc. was the only vendor with the capability of providing the specific supplies as the parts needed are proprietary to Clamshell Structures, Inc.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
It is anticipated that the Contracting Officer will be able to determine that the price is fair and reasonable based on market research, comparison of the proposed price with prices found reasonable on previous purchases, comparison to the Independent Government Estimate, and a comparison with similar items in a related industry; all IAW FAR 13.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
AFICC Launch Pad - A search was conducted on the AFICC Launch Pad to determine if there were any existing strategic sourcing initiatives that could be utilized for the purchase of the LAMS Liners. The search yielded no results.
AbilityOne - A search was conducted on the AbilityOne supply list to determine if the program could be utilized for the purchase of the LAMS Liners. The search yielded no results.
GSA Advantage - A search was conducted on GSA Advantage to determine if there were any GSA contracts that could be utilized for the purchase of the LAMS Liners. Clamshell Structures, Inc. was found on GSA with GSA Contract No. 47QSWA23D005F.
Vendor Outreach - An inquiry was sent to the Business POC of Clamshell Structures, Inc., Jennie Westling at jennie@clamshell.com, to determine if the LAMS Liners were included on the company's GSA contract schedule.
Jennie responded stating that the liners were not included on the company's GSA contract and that they were only an open market item. Jennie also provided the company's Sole Source Certification stating that Clamshell buildings are proprietary and covered by U.S. Patent #4,583,331 issued on 22 Apr 86. Additionally, Clamshell Structures, Inc. has not licensed to any other party the right to sell Clamshelters or the related parts.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
1 ETSG has purchased LAMS Liners in the past. Under contract FA491323P0021, awarded 1 Sep 23, four liners were purchased for $136,750.00 each, $547,000.00 total. This contract was awarded on a Sole Source basis to Clamshell Structures, Inc. The Justification and Approval document was approved IAW FAR 13.106-1(b)(1), Soliciting from a Single Source. The basis of the justification was that Clamshell Structures, Inc. was the only

CONTROLLED UNCLASSIFIED INFORMATION
March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 4 of 4 manufacturer that provides the insulated liners for the LAMS that are currently stored in WRM facilities.
Sourcing from another vendor would have resulted in receiving different liners that would not be compatible with the LAMS in WRM.
LAMS are NSN'd items that can be ordered through the Air Force supply system for a multitude of uses. The LAMS are used for more than Low Observable Aircraft Maintenance and OPLAN. For most of the uses, it is not a necessity to have liners installed. This explains why there are currently more LAMS in WRM than there are liners. The liners are an addition to the LAMS and are not NSN'd items, and are only purchased/used in certain scenarios to include Low Observable Aircraft Maintenance. The Joint Standardization Board-Expeditionary Shelters & Basing Equipment (JSB-ESBE) catalog lists NSN 5410-01-533-7395 as the only NSN under LAMS.
There is only one manufacturer part number associated with NSN 5410-01-533-7395; it is proprietary to Clamshell Structures, Inc. Currently, along with current storage inventory, AFCENT has another 60 LAMS ordered through the Air Force supply system.
The liners work as insulation for the LAMS allowing them to maintain temperature ranges inside the LAMS suitable for Low Observable Aircraft Maintenance that HVAC units cannot maintain alone. Without the liners, the impact of not purchasing them eliminates the ability to perform Low Observable Aircraft Maintenance, and would diminish capabilities to a point that would jeopardize OPLAN operations.
X. List of any sources that expressed, in writing, an interest in the acquisition.
Not Applicable
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Until another LAMS manufacturer is added to the NSN in the Joint Standardization Board-Expeditionary Shelters & Basing Equipment (JSB-ESBE) catalog, requirements owners will continue ordering LAMS from Clamshell Structures, Inc. through the Air Force supply system. Thus, requiring sole source awards made to the same company for the LAMS liners.
Another option to remove barriers would be for Clamshell Structures, Inc. to release their propriety specifications of the LAMS and authorize third party companies to manufacture and distribute customizable off-brand liners to fit the existing LAMS (not to be confused with a brand name requirement). It is important to note however, that Clamshell Structures, Inc. has be manufacturing these liners themselves since 1986.
