This solicitation amendment updates cost descriptions for reimbursable contract line item numbers on a security gate preventive maintenance services contract for Luke Air Force Base. The amendment modifies CLINs 0004, 1004, 2004, 3004, and 4004 to clarify that reimbursable gate repair parts will be billed based on actual costs with any supplier discounts passed to the government. Evaluation criteria are also amended to specify the lowest price technically acceptable process for award where technical acceptability is determined first, followed by selection of the lowest total evaluated price inclusive of all option years. Questions are due by February 16th with answers by February 22nd. Award will be to the responsible offeror providing the lowest total evaluated price for an acceptable technical proposal.

Evaluation Factors for Award

The following clauses were modified:

52.212-2 - Evaluation-Commercial Products and Commercial Services. Nov 2021 hereby reads as follows:

As prescribed in , the Contracting Officer may insert a provision substantially as follows:12.301(c)

Evaluation-Commercial Products and Commercial Services (Nov 2021)

FA488723Q00090001

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, technical acceptability and price will be considered. Contract award will be made to the contractor found technically acceptable with the lowest Total Evaluated price (TEP). Technical rating will not be an evaluation factor, but rather it will first be determined whether or not the contractor meets technical acceptability, and then the proposal will be evaluated based on the Total Evaluated price (TEP). Reimbursable CLINs identified in the CLIN schedule will not be evaluated as part of the TEP. The government will conduct the use of Lowest Price Technically Acceptable (LPTA).

1) Technical Acceptability - Technical acceptance is based on the proposal conforming to the overall specifications set forth in the performance work statement (PWS). The offeror is required to submit a statement indicating acknowledgment of the requirement in the PWS and that the proposal meets and can perform the requirement as stated in the PWS.

2) Price - An offeror's Total Evaluated Price (TEP) will be determined by the sum of all separately priced CLINS as presented in Supplies/services section. If a separate CLIN and a TEP (as applicable) are not included, or are not clearly stated, miscalculated and/or understandable, the offer will be rejected as non-responsive.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
