MEMORANDUM FOR: MACC Best Value Task Order (TO)

SUBJECT: Task Order Proposal Request (TOPR), (Task Order Requirement)
This Task Order will be awarded based on:

1. An official proposal is hereby requested for one (Task Order Requirement) to support Luke AFB Multiple Acquisition Construction Contract (MACC) as outlined in your contract (contract #). Please reference the requirement title and your contract number in any proposal response.
2. The government contemplates the period of performance for this requirement (estimated) to be (date) through (date). An earlier start date is possible should the contractor and the Government come to a mutual agreement through a bilateral task order modification. You will be required to submit electronic invoices through Wide Area Workflow (WAWF) to the DFAS-Columbus payment office IAW DFARS 252.232-7003.
3. The Task Order (TO) awardee must, as a minimum, meet the requirements stated in the basic contract and Task Order Proposal Request.
4. The evaluation criteria, in relative order of importance for LPTA, base year only, are technical competance and price. An assessment will be made to determine the best value to the Government. The Government will use your previous performance on the MACC to evaluate past performance on this TOPR in addition to techincal and price for option years 1 through option year 4 for award under Tradeoff. Past performance will be weighted significantly higher than price. Under Tradeoff, your proposal will be determined to be either acceptable or unacceptable. The Construction Cost Breakdown Worksheet must be completed to satisfy the price section of your proposal. TO Request for Proposal (RFP) projects may be non-complex performance oriented tasks requiring minimal design, complex construction requiring design development for design-build construction, or a combination thereof. In rare cases, the TOPR may not have traditional plans and specifications as described herein, but may include sketches, and requests for catalog cut sheets, and other submittals.
(1) Task Order Issuance Procedures shall be in accordance with 1.3.2.6 of the Luke MACC Procedural Specifications as follows: Work under this contract will be ordered by written Task Orders issued on DD Form 1155 (Order for Supplies or Services) to the contractor by the Contracting Officer. Each awarded MACC contract will cite an individual contract number. The individual TOs will be placed in a sequential numbering system, which relate back to the basic contract and their assigned TO number. The Government will not be obligated to reimburse the contractor for work performed, items delivered, or any costs incurred, nor shall the contractor be obligated to perform, deliver, or otherwise incur costs except as authorized by duly executed TOs. TOs will be firm fixed price and clearly define the specific services to be performed or the performance desired. Each TO will contain applicable clauses.
(2) Fair Opportunity to compete for Task Orders shall be provided in accordance with DFARS 216.505-70. Competition for Task Orders shall be in accordance with 1.3.2.7 of the Luke MACC Procedural Specifications as follows: Notice of the intent to issue a task order shall be provided to all MACC contractors except as specified in paragraph. Any offers received shall be given fair consideration for award. Upon receipt of a project, contractors shall be encouraged to participate in site visits and submit proposals. Failures by offerors to participate responsibly in site visits and submit proposals may result in the Government’s not exercising the option to extend the contract and/or exclusion of the contractor from further competition. Occasionally (generally during the last quarter of the fiscal year), the Government will solicit offers for projects for which funds are not certified or readily available. Submission of proposals for these acquisitions is at the sole discretion of the respective MACC awardees and their declination to participate in any or all such solicitations will not reflect negatively upon them. Unless the Contracting Officer applies one of the exceptions noted below, each TO will be awarded as a result of competition to the contractor who offers the best value to the Government considering the criteria specified. The Contracting Officer’s decision as to the selection for award of a TO, under $10M, is not protestable unless the protest is on the grounds that the order increases the scope, period, or maximum value of the contract program. If the TO exceeds $10M, the offeror shall follow guidance under FAR 16.505(b)(1)(iii)(B). The Contracting Officer reserves the right to award a TO without competition based upon a determination that:
· The agency need for the supplies or services are so urgent that providing a fair opportunity would result in unacceptable delays;
· Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services being ordered are unique or highly specialized;
· The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
