Performance Work Statement Charter Boats

1. Description of Services.

The contractor shall provide four crewed vessels for four separate 24 hour operating windows (4 vessels per operating window). The operating windows are 24 hours “dock to dock” and will be 24 hour periods starting at 1100L on 23, 26, and 30 Oct. The vessels shall carry government passengers to act in a training capacity. The vessels shall arrive at the designated points, maintain station keeping, and deploy a swimmer to be recovered by helicopter. If the helicopter is unable to recover the swimmer, the active duty rescue swimmer onboard will recover the swimmer. The vessels shall, safety permitting, respond to requests from the senior military member on board to alter her course or speed within the vessel’s capabilities during the operating window in order to achieve a desired effect.

a. Location: The vessels shall depart from/return to a marina in the San Diego area. The operating area of the vessels shall be on the ocean within 150NM of San Diego. Vessels will not be more than 100NM from shore if “Near Coastal” license is a factor. The government shall provide vessels with the desired point and time to reach during the operating window.

The point and associated in position time shall be achievable at a vessel speed of 15 knots.

b. Types of Acceptable Vessels: In this section, a vessel is defined as a seaworthy ocean vessel that meets the following specifications:

i Longer than 59 feet.

ii Has enclosed cabin space with a seating area and tables that can be used for equipment storage and staging.

iii Has onboard power and a minimum of 1x outlet that are US standard 120V/60Hz AC

(powered by inverter or engine(s)) or 12V DC located in an enclosed cabin.

iv Has at least one (1) head.

v Equipped with a functional marine VHF radio, AIS transponder, and EPIRB/PLB.

vi Man overboard (MOB) recovery equipment.

vii Capable of operating in moderate sea states and weather within 150NM of San Diego.

Must be capable of operating in at least Beaufort Level 5 conditions.

viii Capable of operating in day and night conditions and being underway for 48 hours to include adequate fuel supply and crew available for watch standing.

• Definition of Crew Boat: A crew boat is a vessel that meets all the requirements from section

1.b. in addition to the capability to carry 18 passengers and travel at a speed greater than 15 knots in average weather conditions. Additionally, it must have berthing for at least 10 passengers.

• Definition of Open Ocean Tug: An open ocean tug is a vessel that meets all the requirements from section 1.b. in addition to the capability to carry 6 passengers and travel at a speed greater than 5 knots.

c. Government Use of Vessel: The captain of the vessel must be willing and able to deploy government swimmers from the vessel, maintain overwatch, and, if necessary, position the vessel to recover the swimmers. The government shall provide a trained medic and rescue swimmer.

d. Acceptable Variations on Scheme of Maneuver: The contractor shall perform one of the following permutations of acceptable vessel distribution depending on contractor’s vessel availability:

i Two Crew Boats and Two Open Ocean Tugs: The contractor shall provide two crew boats, one of which is herein referred to as the “training boat”, and the other as the “white cell boat”. Additionally, the contractor shall provide two Open Ocean Tugs, which shall be prepositioned at a rendezvous point at contractor discretion. The training boat shall proceed to her designated location while responding to inputs from the senior military member onboard to alter her course and speed to present desired effect. The white cell boat shall proceed to rendezvous with two open ocean tugs, from which the government will transload up to 6 passengers on to each open ocean tugs. After the transload, the tugs and the white cell boat shall proceed to their designated locations. After the completion of the training, the tugs shall rendezvous with the white cell boat and transload the government passengers back to the white cell boat, following which all vessels shall return home.

ii Three Crew Boats and One Ocean Tug: The same as section 1.d.i., saving that the additional crew boat shall proceed to her designated location while the white cell boat shall rendezvous with only one ocean tug.

iii Four Crew Boats: All crew boats shall proceed to their designated locations.

e. Notification of Operating Times/Location: 24 hours before the window starts, the government shall provide the vendor with locations for the vessels to be and an associated time to arrive to and depart from the location. The vendor shall immediately notify the government if weather or sea state prevents the vessel(s) from reaching the desired point/time.

f. Failure to Deliver: If the vessels fail to reach the point at the time specified by the government the funds set aside for the execution of that contract shall be refunded. If the event was due to circumstances beyond the contractor’s control (unforecast weather etc.), then the funds shall not be refunded.

g. Unexpected Delays: The vendor shall provide the government with an hourly rate for extension of the operating window beyond 24 hours for up to an additional 12 hours (totaling 36 hours) in the event of unexpected delays.

h. Provisioning: Government personnel shall provision their own food, water, clothing, and any bedding required. Contractor personnel shall likewise source their own provisions.

i. Restrictions: The contractor shall not record or take any photos or videos of government activities or equipment throughout this period of performance without the expressed consent of the senior ranking military member onboard the vessel. Each vessel shall be reserved exclusively for government use and not subcontracted for other activities. The contractor shall not disclose or discuss the nature or scope of military activities or involvement outside of direct coordination with the government.

j. Additional Services Provided by Contractor: The contractor shall provide 600 ft of 3/8’ floating line to be used to tether the swimmer to the boat. The contractor shall retain the line after this contract is completed.

General Information:

2. Contract Manager. The contractor shall have available an on-site contract manager, and mode of contact, who shall be responsible for the contract performance and can act for the contractor on all matters relating to the contract. The name of contract manager(s) and an alternate(s), who shall act for the contractor when the manager is absent, shall be designated in writing to the Contracting Officer. The Contract Manager and alternate must be able to read, write, speak, and understand English.

3. Contract Employees. The Contracting Officer reserves the right of the Government to restrict the employment under the contract of any contractor employee or prospective contractor employee identified as a potential threat to the health, safety, security, general well-being, or operational mission of the installation and its population.

4. Employee Restrictions. The contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest. The contractor shall not employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval in accordance with DoD Directive 5500.7, Standards of Conduct.

5. Military Members. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station, change in duty hours, or deployment.

Military reservists and National Guard members are may be subject to recall to active duty. The abrupt absence of these personnel could adversely affect the contractor’s ability to perform services. The absence of these personnel at any time shall not constitute an excuse for nonperformance under this contract.

6. Contractor Employee Appearance. Contractor personnel shall present a professional, conservative, and neat appearance. Contractor personnel shall dress in a professional manner, in appropriate attire befitting a professional environment, and in keeping with normally accepted commercial standards of dress for the work being performed.

7. Safety. The contractor shall comply with all applicable laws and safety regulations. Compliance with OSHA and other applicable laws and regulations for the protection of contractor employees is exclusively the obligation of the contractor, and the Government will assume no liability or responsibility for the contractor’s compliance or noncompliance with such responsibilities. The contractor is responsible for providing contractor employees with all necessary and required personal protective clothing and equipment.

8. Controlled Unclassified Information (CUI). CUI is unclassified information requiring safeguarding and dissemination controls, consistent with applicable law, regulation, or government-wide policy.

In accordance with Department of the Air Force Instruction (DAFI) 16-1403, Controlled Unclassified Information (CUI), the contractor shall protect CUI, regardless of its form, at all times in a manner that minimizes the risk of unauthorized disclosure while allowing for access by authorized holders.

Contractor personnel working with CUI shall be careful not to expose CUI to unauthorized users or others who do not have a lawful government purpose to see it. When not under continuous monitoring or physical control, the contractor shall store hardcopy CUI documents in a locked desk,file cabinet, or similar means, where only authorized personnel have access. The following are examples of CUI:

- Personally Identifiable Information (PII)

- Sensitive Personally Identifiable Information (SPII)

- Proprietary Business Information (PBI)

- Unclassified Controlled Technical Information (UCTI)

- Operational Information

- Protected Health Information (PHI)

- Sensitive but Unclassified (SBU) Information

- Financial Information

9. Protection of Personally Identifiable Information. Personally Identifiable Information (PII) refers to information that can be used to distinguish or trace an individual’s identity either alone or when combined with other information that is linked or linkable to a specific individual. PII may range from common data elements such as names, addresses, dates of birth, and places of employment, to identity documents, Social Security numbers (SSN) or other government-issued identity, precise location information, medical history, and biometrics. The contractor shall protect all PII encountered in the performance of services in accordance with Department of Defense Directive

5400.11, Department of Defense Privacy Program, and DoD 5400.11-R, Department of Defense Privacy Program. If a PII breach results from the contractor's violation of the aforementioned policies, the contractor shall bear all notification costs, call-center support costs, and credit monitoring service costs for all individuals who's PII has been compromised.

10. Reporting Requirements. Contractor personnel shall immediately report to an appropriate

Government authority any information or circumstances of which they are aware may pose a threat to the security of Department of Defense personnel, contractor personnel, resources, and classified or unclassified defense information
