MEMORANDUM FOR RECORD

SUBJECT: Liquidated Damages Summary

RFP: FA487719RA013 – Wells 4 & 9 Repair

1. In accordance with FAR 36.206, FAR 11.5, and DFARS 236.206, liquidated damages will be assessed for each calendar day of delay required to complete work on subject contract. Timely performance is so important that the Government may reasonably expect to suffer damage if the performance is delinquent and the extent or amount of such damage would be difficult or impossible to estimate accurately or prove. Liquidated damages for the personnel regarding Davis-Monthan AFB construction projects were determined in accordance with AFI 65-503, tables A20-2 and A26-1.

2. As a minimum, liquidated damages in the amount of $186.10 for the first day and $116.17 for each day thereafter will be charged, based on the following factors:

a. The contractor has complete control of pace of work.

b. The contract provides liquidated damages for delay of work for each calendar day of the contract.

c. Considering the requirement, the rate of assessment is reasonable.
