Section L - Instructions, Conditions, & Notices to Offerors or Quoters

Proposal Instructions

A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications and technical requirements. Failure to meet are requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of two (2) separate parts, Part I - Price Proposal and Part II - Technical Proposal

B. The Contracting Officer (CO) has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the CO will review this determination and if, in the CO's opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the CO determines that adequate price competition no longer exists, offerors may be required to submit information to the extent necessary for the CO to determine the reasonableness of the price.

C. Exchanges of source selection information between Government and offerors will be controlled by the Contracting Officer. Email may be used to transmit such information, only if the email can be sent encrypted, and must include "Source Selection Information - See FAR 2.101 and 3.104"in the subject line of the email. Otherwise, source selection information will be transmitted via direct mailing or facsimile. In order to facilitate the sending and receiving of encrypted emails, offerors must use MS Outlook email configured to support encryption or a different email product that is S/MIME compatible and configured to support encryption. If you intend to submit your source selection information via encrypted email, you will need to contact the Buyer/Contracting Officer indicated on the face page of the solicitation prior to that first submittal to exchange certificates used for encryption. To ensure the process is working correctly, send a test encrypted message first (without including any source selection information).

Otherwise, source selection information will be transmitted via direct mailing or AMRDEC SAFE at https://safe.amrdec.army.mil/safe/guide.aspx.

When submitting source selection information via email, file suppression utilities, to include but not limited to zip files, will not be accepted.

D. Specific Instructions

1. Part 1 - PRICE PROPOSAL/CONTRACT DOCUMENTS

- Submit 2 hard copies (one original/one copy) plus 1 electronic copy (CD)

- Email/Electronic submissions will be accepted. Contractor not required to use actual USPS/FedEx/UPS, etc.

(a) The offer must complete the following sections within the RFP:

i. Part I, Section A (SF 1442, Blocks 19-20C).

ii. Part I, Section B - Painting Bid Schedule - Use Attachment 2.

iii. Part IV, Section K, Representations, Certifications, and other Statements of Offeror. Provision 52.204-8 will need to be submitted. Register for the System for Award Management (SAM) at www.sam.gov to complete this. Active SAM registration is required to be considered for award.

(b) The Government is not requesting certified cost or pricing information. Price will be evaluated in terms using techniques established in FAR 15.404-1 to ensure the Government receives a fair and reasonable, balanced price. The contractor shall include in the prices for the items listed in the Bid Schedule all costs for work in the specifications, whether or not specifically listed in the Bid Schedule. The Government reserves the right to request data other than certified cost or pricing data.

(c) Quantities listed in the Painting Bid Schedule are ESTIMATED annual quantities only. Unit pricing provided in the Bid Schedule will be used to issue Task Orders for individual requirements.

Bonding: The offeror shall provide proof from the offeror's bonding company that their firm has, as a minimum, $1M in available bonding capability.

2. Part 2 - TECHNICAL PROPOSAL (Limit, 10 pages)

- Limited to no more than the stated limitations below. Submit 2 hard copies (one original/one copy) plus 1 electronic copy (CD). Email/Electronic submissions will be accepted. Contractor not required to use actual USPS/FedEx/UPS, etc.

The technical proposal shall be prepared in accordance with these instructions and shall be evaluated in accordance with the evaluation criteria and evaluation standards in Section M, Evaluation Factors for Award.

Technical proposals shall be used by the evaluators to determine offeror's ability to perform the required painting requirements.

Experience in execution of no less than three (3) successfully completed painting projects. Of the three (3) successfully completed painting projects, two (2) must be equal to or more than $10,000.00; and one (1) must be equal to or more than $50,000.00. The projects selected for review must demonstrate at least one (1) successfully completed painting interior paint project and at least one (1) successfully completed painting exterior paint project.

All three (3) projects must be completed within 3 three years of the close of this solicitation.

Provide a project summary for each construction project IAW the format at Attachment 3, Painting Project Summary (References).
