JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

Department of the Air Force, Air Combat Command, Contracting Squadron, 325 th

CONS/LGCB,

501 Airey Ave, Suite 5, Tyndall AFB FL 32403-5526. This action is a “Justification for Other

Than Full and Open Competition” in accordance with FAR 6.302-1(a)(2)(iii)(B).

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

A. This Justification and Approval (J&A) authorizes use of other than full and open competition procedures to procure Watercraft Operations and Maintenance from Florida Offshore Inc., 3605

Thomas Drive, Panama City, FL, 32408-7365.

B. This action will be a modification to an existing firm-fixed price (FFP) contract FA4819-10-

C-0004. The resulting action will be a unilateral FFP modification to the current contract for a 6-month extension (1 October 2014 – 31 March 2015) in accordance with FAR clause 52.217-8, Option to Extend Services, which was included in the solicitation and incorporated into the original contract award. This extension will permit the continuation of performance of the current contract while the requirement is being recompeted.

ATRS to continue watercraft operations and maintenance in support of the 53 rd

Weapons Evaluation Group’s weapons testing mission by retrieving aerial targets and keeping the launch corridor clear in the Gulf of Mexico.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS

ITEM DESCRIPTION:

The contractor shall furnish adequate supervision, labor, materials, equipment, and tools necessary to perform Watercraft Operations and Maintenance Services at Tyndall AFB FL. This service includes operating three 120-foot drone recovery vessels and two smaller patrol vessels to recover aerial targets and support range safety and salvage operations. This contract also supports Air Force aerial target support for DoD users in the Gulf Ranges.

PERIOD OF PERFORMANCE:

1 October 2014 through 31 March 2015

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

The authority for this action is 10 USC 2304(d)(1)(B)(ii), as implemented by FAR 6.302-

1(a)(2)(iii)(B), Only One Responsible Source

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICA-

TIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE

AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

A. This is a 6-month contract extension for Watercraft Operations and Maintenance services that will continue to be used by the 53 rd

WEG for the foreseeable future. This service has been contracted out for the past 25 years. The extension action is required to permit continuous services for an additional 6-month period of performance while the requiring organization, nd

ATRS, is in the process of acquiring and awarding a follow-on contract for these services.

FAR 6.203-1(a)(2)(iii) (B), Only One Responsible Source, contains the applicable statutory authority permitting other than full and open competition for the contemplated modification.

This reference reads, “Services may be deemed to be available only from the original source in the case of a follow-on contract for the continued provision of a highly specialized service when it is likely that award to any other source would result in -- (B) Unacceptable delays in fulfilling the agency’s requirements. A modification to extend the current contract will ensure continuous services.

B. The current contract expires on 30 September 2014. The Government estimates that the time required to compete this contract requirement (including the time required to evaluate proposals and determine technical acceptability), coupled with the time to bring a new contractor up to full performance level, would result in unacceptable delays in fulfilling the agency’s requirements. It is anticipated that the source selection for the follow-on contract will take 6 months. Any delay or break in these services would have a critical impact to the 53 rd

WEG’s mission. Without the proposed action, the 53 rd

WEG would have to forego mission critical services until the follow-on contract is awarded which is an unacceptable delay. The incumbent contractor is the only available source to immediately continue this service during the interim period without mission degradation. There are no other current contract vehicles to facilitate the use of another source.

Additionally, the Air Force does not have the organic resources necessary to meet these mission requirements and must have continued contract support. This requirement is to satisfy a bona fide need that exists in FY15 and will utilize available FY15 funds.

C. The potential damage to the government is significant and will result in serious injury to the rd

WEG mission at Tyndall AFB FL. Air Force aerial targets require sea-based corridor clearance in the Gulf of Mexico for the QF-4, QF-16, and the subscale aerial targets. This contract is charged with recovery operations of downed targets. Hazards to maritime transportation and navigation are strictly enforced by Department of Commerce, US Coast

Guard, and NOAA. These federal agencies place the liability of hazards to navigation for floating aircraft debris on the Air Force. Continuing performance under the current contract with the incumbent contractor is in the Government’s best interest for the reasons cited above..

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

The 82

ATRS is currently in the process of soliciting a follow-on contract to provide

Watercraft Operations and Maintenance services at Tyndall AFB FL. A sources sought synopsis was issued on 14 April 2014, # FA4819-14-R-0005, to conduct market research to determine the availability and capability of small businesses capable of providing direct sea support for search and recovery for subscale drone targets and related equipment at Tyndall AFB Florida. The draft performance work statement and a Government-provided equipment listing were attachments that identified the types of vessels used in the performance of the contract. There were seven replies received in response to the synopsis. A new solicitation for these services is being developed for a competitive acquisition which will be set-aside for Small Business concerns.

The award of the follow-on contract for these services is estimated as early as 13 February 2015 and/or no later than 31 March 2015.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

IAW FAR 15.404-1(b) the contracting officer utilized price analysis to determine that the prices were at a fair and reasonable price during a competitive source selection process for these services. This extension is being exercised in accordance with FAR 52.217-8, Option to Extend

Services. FAR 52.217-8 requires the contractor to continue performance of services within the limits and at the rates already specified in the current contract. Prices established in the current contract were determined to be fair and reasonable based on price analysis and adequate competition in accordance with FAR 15.404-1(b)(2)(i).

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT

CONDUCTED
