I. Contracting Activity.

6th Contracting Squadron/PKB 2610 Pink Flamingo Ave., Suite 300 MacDill AFB, FL 33621

II. Nature and/or description of the action being processed.

New firm-fixed price purchase order for the acquisition, delivery, and installation of 75 Synexis Sphere and 19 Synexis Sentry Dry Hydrogen Peroxide anti-microbial air purifying devices, one year's worth consumable supplies for these devices, and five travel storage cases.

III. Description of supplies/services required to meet agency needs.

Acquisition, delivery, and installation of Dry Hydrogen Peroxide (DHP) anti-microbial air purifying devices designed to be used safely within occupied indoor workspaces on a 24/7 basis. Must reduce or eliminate live microbial burden in the space and provide coverage of up to 1200 square feet per device and operate on 110v US AC power. Purchase will include one year's worth consumable supplies for these devices, and travel storage cases. Estimated value is $278,900.00

IV. Statutory authority permitting other than full and open competition.

The procedures in FAR subpart 13.5 were used in accordance with 41 U.S.C.1901

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Synexis BioDefense is currently the sole developer of Dry Hydrogen Peroxide (DHP), and Hydrogen Peroxide Gas Technology. They have the patent for making DHP.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

The solicitation with the sole source justification will be posted to beta.sam.gov for 14 days. Any offerors believing they can provide the required DHP Technology other than Synexis BioDefense with all of the features and functions of the requirement described above may provide evidence for consideration. Evidence must support the offeror's claim they can provide this technology. All qualified sources may submit a response, which if timely received, will be considered.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The government will request the price be less than or equal to the lowest price paid by Synexis' best customers. Several federal agencies have purchased Synexis units recently and the prices paid will be used as a point of comparison.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Online research was conducted to identify other air purification technology that meets USCENTCOM's requirements, but USCENTCOM requires dry hydrogen peroxide technology and Synexis BioDefense is the only company that manufactures the devices. Refurbished Office Furniture Inc is the only authorized reseller for the central Florida region.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

The Synexis Dry Hydrogen Peroxide technology is patented and currently Synexis is the only company that manufacturers and sells these devices. Only the DHP technology will achieve the required safe antiviral/anti-microbial

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Prior to any additional acquisitions, market research will be conducted to determine if any other suppliers are available.
