52.212-1 Addendum to -- Instructions to Offerors-Commercial Items.

(1) Submission: As part of an offerors quote they are required to:

(a) Clearly identify an “or equal” products by

(i) Brand name, if any; and

(ii) Make or model number;

(b) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and

(c) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification.

(2) DEADLINE: Offers must be submitted no later than Tuesday, 2 April 2019 by 10:00AM EST. Any questions regarding this solicitation must be submitted not later than Tuesday, 26 March 2019 by 10:00AM EST. Any questions submitted after this date, may not be answered. Submit offers or any questions to the attention to:

52.212-2 -- Evaluation -- Commercial Items (Oct 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

BASIS FOR AWARD: Lowest Price Technically Acceptable. This solicitation has been designated as Brand Name or Equal IAW FAR 52.211-6, a technical advisor will compare an offerors proposed product/s against the requirements of the Statement of Objective (Attachment # 4) and the brand names salient physical, functional, or performance characteristics to determine technical acceptance (reference attachment 5). “Equal” products will be evaluated by a technical advisor for compatibility/functionality review and rated IAW Table A-1 (as provided below). Documents submitted in response to this solicitation must be fully responsive to and consistent with the following (if applicable): (1) Requirements of the RFQ Cover Sheet (i.e. Complete Vendor Information) (2) Attachment #4, Statement of Objectives (3) Attachment #5, Salient Characteristics and (4) government standards and regulations pertaining to this requirement.

Unacceptable Quote does not offer product(s) that are Brand Name or Equal as defined in FAR 52.211-

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
