Section A: General Contract Information
Contracting Activity: 7 CONS/LGCB
Project/Program Name: MIDS-LVT 1 Radio Parts
Purchase Request/Identification Number: F1R10G7052AW02
Estimated Contract Cost (including Options): $70,000.00
Section B: Description of the Supplies/Services Required
Multi-functional Information Distribution System (MIDS) radio parts to complete a functional ground terminal. Mobile Rack with Voice Control Unit + Headset MIDS-LVT1. The ViaSat MIDS-LVT Mobile System will have a transportable case for the MIDS-LVT(1) terminal and its variants. It will include everything required to operate a MIDS-LVT(1) terminal, minus the radio (R/T-1840(c)/U) and power supply(VA-016308-0002). The contractor shall provide the power unit, cooling tray LVT1, control, cabling, and attenuator/terminator. The customer (7 OSS), will insert their radio system into the ViaSat unit and expect to have a fully functional system --ready to use. The total estimated value of this contract is $70,000.00.
Section C: Justification for Soliciting from a Single Source or Brand Name
The statutory authority permitting one responsible source is FAR 6.302-1(a)(2)/10 U.S.C. 2304 (c)(1).
For this particular acquisition, Joint Tactical Radio System (JTRS) are mandated by the 21 August 1997 Mission Need Statement (MNS) for the Joint Tactical Radio (JTR) and the 23 March 1998 'Operational Requirements Document (ORD) for Joint Tactical Radio (JTR)' (See attachment 1 ORD).
Additionally, the Multi-functional Information Distribution Systems must interface with DOD mandated Joint Tactical Radio Systems (JTRS). These radios are able to utilize new waveforms or, radio signal frequencies that are added via upload from the MIDS. Obtaining a non-brand name radio would require the installation of new radio types in ground vehicles, and using circuit board swaps in order to upgrade, causing a drastic increase in time and manning when new protocols are mandated. ViaSat, the MIDS-LVT Contractor has mass produced parts to support Multi-functional Information Distribution System-Low Volume Terminal/Joint Tactical Radio System (MIDS-LVT/JTRS) systems in the past. In 2015, a five-year $479M contract was awarded to the Navy for MIDS-LVT/JTRS systems (See attachment 2 Navy Contract). This was not inclusive to the United States Air Force.
ViaSat is the only company capable of providing MIDS with interoperability with Joint Tactical Radio Systems (JTRS) as they are the only company still producing the necessary ground terminal cooling tray (See attachment 3 Selected Acquisition Report
(SAR)).
Section D: Efforts to Obtain Competition
Customer did multiple Internet searches with all known vendors that supported DOD MIDS systems. It was determined that ViaSat was that only company that had replacement parts needed for this particular system. All vendors that had DOD related contracts were no longer supporting the MIDS LVT-1 system. ViaSat is willing to build up this system to meet the unit's needs with parts they have on hand. Section E: Steps to Preclude Future Single Source or Brand Name Awards
The nature of this particular procurement precludes sourcing the repairs from another vendor. MIDS LVT-1 is uniquely different from a standard Multi-functional Information Distribution (MID) for Joint Tactical Radio (JTR) ground systems. The ground terminal cooling tray was not mass produced after the ship and aircraft contract was completed. The only other company capable of building JTRS MIDS; Data Link Solutions, LLC was contacted and is unable to provide the terminal cooling tray for our Joint Tactical Radio Systems (JTRS). ViaSat is the only company that is able to meet acquisition needs. See attachment 2; Navy Contract for reference to Data Link Solutions, LLC and their current DOD contract.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
