ADDENDUM TO FAR 52.212-2, EVALUATION OF OFFERS

(d) BASIS FOR CONTRACT AWARD: This is a competitive Lowest Price Technically Acceptable (LPTA) in accordance with Federal Acquisition Regulation (FAR) Parts 12 and 13, and Department of Air Force FAR Supplement (DAFFARS) Part 13. By submission of its quote in accordance with the instructions provided in clause FAR 52.212-1, Instructions to Quoters Commercial Items, the quoter accedes to the terms of this model contract. Failure to meet a requirement may result in a quote being determined unacceptable. Award will be made to the lowest price quote that meets the acceptability standards for non-price factors

1. Price Quote

The lowest quote will be evaluated for price reasonableness. It is expected that the competitive nature of this acquisition will drive price reasonableness; however, the Government reserves the right, if it deems appropriate, to make this determination by means of one or more techniques as described in FAR Part 13.

Unreasonable or unbalanced prices submitted may be grounds for eliminating a quote from further consideration if prices are determined to be incompatible with the scope of the effort to be accomplished and/or create performance risk on the basis the quoter does not understand the requirement.

2. Technical Acceptability

The technical offers will be evaluated against the following criteria:

a) The technical offer, Compressed Air System to be installed, meets the expectations of Statement of Work Section 3.0.

The governments technical evaluation team will evaluate the technical portion on a pass/fail basis, assigning ratings of Acceptable or Unacceptable.

Evaluation steps: Price Factor, Technical Acceptability and Past Performance:

Step 1: Evaluate all quotations for responsiveness.

Step 2: Rank all responsive quotations based upon the vendors Price Quote with the lowest priced offer being number one.

Step 3: Evaluate the lowest priced quote technical offer. Technical offers shall be evaluated with priority given to the lowest priced quote and proceed in ascending order. Once a technical offer has met or exceeded the acceptability standards IAW the solicitation, the evaluation process concludes, and no further technical offers shall be evaluated.

Interchanges conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for quote revision.

The Government intends to award a contract without interchanges with respective quoters. The Government, however, reserves the right to conduct interchanges if deemed in its best interest with one, some, or all of the quoters.

Unacceptable: Offer does not meet the minimum requirement of the solicitation.

Acceptable: Offer meets the requirement of the solicitation.

Award Notice

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offers specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
