Section C: Justification for Soliciting from a Single Source or Brand Name

(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in --
(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or
(B) Unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C. 2304(d)(1)(B).
Section D: Efforts to Obtain Competition
The Government posted a sources sought to the Governmentwide point of entry--www.fbo.gov--asking for alternative solutions to meet the Government requirement. As a result of that sources sought and through oral dialogue with various companies in this market, to the knowledge of the Government, no other solutions exist to fulfill this requirement which restricts competition for this acquisition.
Section E: Steps to Preclude Future Single Source or Brand Name Awards
The Government completed exhaustive efforts to find alternative items that could meet the requirement owners specifications.
Market research did not yield sufficient results to preclude the usage of brand name requirements for this acquisition. Until the market changes no further steps will be taken to preclude future single source awards as long as Scorpion machines are the only machines that will fit the mission critical criteria required by the acquisition.
