1. DESCRIPTION OF SERVICES.

The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other items and services necessary to perform integrated solid waste management collection services at MALMSTROM AIR FORCE BASE MISSILE ALERT FACILITIES (MAFs), MT. The contractor shall perform to the standards in the contract as well as all local, state, and federal regulations. Estimated workload factors are in Appendix A; container sizes, locations and frequency schedule are identified in Appendix B; and collection areas are in Appendix C.

1.1. COLLECTION REQUIREMENTS.

1.1.1. Integrated Solid Waste Management.

Empty Municipal Solid Waste (MSW) containers as identified in Appendix B. The contractor may propose adjustment to the schedule at any time to the Contracting Officer (CO). The contractor and Facility Managers (FMs) for each MAF shall monitor fill capacities during the first 30 days of performance. No changes are allowed to the schedule without CO coordination. When the contractor completes service at a location, there shall be no litter, waste, or recyclable material on the ground within a 10 foot radius of the container.

1.1.2. Points of Collection.

Collection stations for refuse are shown in Appendix C. Containers shall be located in a designated location outside the fenced area of each MAF, unless otherwise indicated.

The contractor shall position containers for customer ease in depositing MSW. This may require repositioning of containers from time to time at the direction of the on-site FM and the CO. The contractor shall also position containers to minimize interference with adjacent parking areas, roadways, overhead utilities, trees, and other potential obstructions.

1.1.3. Inclement Weather Schedule.

The contractor shall collect MSW during periods of inclement weather. In cases of severe weather, the CO or FM may authorize exceptions. When exceptions are granted, the contractor shall make up all missed collections within 24 hours after the severe weather has terminated, unless the CO authorizes additional time.

1.1.4. Cubic Yard Capacity.

Proposed capacity of containers is indicated in Appendix B. The contractor is encouraged to identify changes to the capacity of containers and/or pickup frequency to improve the overall efficiency of MSW removal, and to submit these changes to the CO. No changes shall be made until the proposed change is coordinated with the CO for approval.

1.1.5. Maintaining Containers and Collection Area.

The contractor shall return the containers to their original location after servicing, in an upright position with the lids securely in place (closed). The contractor shall also be responsible for immediately cleaning up any spills, debris, etc., on the ground within 10 feet of the container when servicing a location, which may occur during servicing of containers. All refuse on the ground within ten feet of the container, whether spilled by the contractor or placed there by Government personnel, shall be picked up by the contractor during collection. The contractor shall collect debris placed at collection stations; for example, tree branches, sacks, cartons, boxes, cans, tied bundles, or other containers. The contractor shall be responsible for keeping collection areas free of refuse and debris.

1.1.6. Government-Approved Containers.

All MSW containers and recycling bins provided by the contractor must be accepted by the CO and FM prior to start of performance.

1.2. DISPOSAL.

The contractor shall transport and dispose of all solid waste at a licensed off-base disposal site selected by the contractor. A copy of the landfill(s) operating permit that material is transported to shall be provided to the CO. Disposal shall be in accordance with existing local, state, and federal regulations. The contractor shall be responsible for any permit or fees associated with the use of off-base disposal locations. The contractor shall ensure all waste is contained to prevent any leakage, spillage, blowing, or dumping of waste while in transport and all loads are properly secured before entering public highways.

1.3. EQUIPMENT MAINTENANCE.

The contractor shall maintain all containers ensuring they are free of unpleasant odors, dirt, debris, and pests. All containers must remain in good, workable condition, with no leaks and remain easily accessible. The contractor shall be responsible for all cleaning, painting, repair and other maintenance, which shall be accomplished off-site at the contractor’s location.

Trucks and trailers used for hauling and collecting should be free of excessive odor, dirt, debris, and pests. The contractor shall furnish replacement containers for all containers removed unless previously approved by the CO and FM. Contractor vehicles and equipment shall not have any waste or equipment leaks such as oil or hydraulic fluid. Should any contractor vehicles or equipment have any leaks, the contractor is responsible for immediate cleanup.

2. GENERAL INFORMATION.

2.1. SERVICE SUMMARY.

The Contractor service requirements are summarized into performance objectives that relate directly to successful contract performance. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement.

Contractor shall inform employees of the Government’s Combating Trafficking in Persons (CTIPs) zero tolerance policy.

2.4

0 Deficiencies permitted.

2.1.1. Customer Complaints.

The CO will receive, investigate and make final determination of the validity of customer complaint(s). Validated customer complaints shall be re-performed after notification by the CO.

Exceeding the performance threshold for performance objective in any one month period may result in a warning or letter of concern from the CO.

Exceeding the performance threshold for performance objective for any two, or more consecutive or non-consecutive months during a contract period may constitute an immediate Progress Meeting with the Multi-functional Team. All remedies shall be in accordance with the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance.

2.1.2. Quality Control.

The contractor shall accomplish all inspection and testing needed to ensure that the services acquired conform to contract requirements before they are tendered to the Government.

2.1.3. Government Remedies

The CO shall follow FAR 52.212-4, Contract Terms and Conditions-Commercial Items, for contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

2.2. HOURS OF OPERATION.

2.2.1. Hours.

Collection shall take place from 0730-1630. Collection outside these hours shall require prior approval of the CO and FM.

2.2.2. Holidays.

Collection falling on Federal Holidays may be resumed the following day. Recognized federal holidays are:

New Year’s Day - 1 January Martin Luther King Day - 3rd Monday in January Washington’s Birthday - 3rd Monday in February Memorial Day - last Monday in May Independence Day - 4 July Labor Day - 1st Monday in September Columbus Day - 2nd Monday in October Veteran’s Day - 11 November Thanksgiving Day - 4th Thursday in November Christmas Day - 25 December

2.2.3. Transition Period.

A 30 day transition period will be incorporated into the startup of this contract in order for the contractor to have the appropriate time to purchase the refuse containers needed to perform.

2.3. SECURITY & SAFETY REQUIREMENTS.

The containers must have the option to be secured with a lock to prevent unauthorized use. If a lock is required, the FM on duty will be responsible for unlocking the container for MSW pick-up. If the container is not unlocked in a timely manner and the contractor is unable to perform MSW service, the service will be forfeited and the contractor will be paid the rate stated in the contract.

2.3.1. Special Qualifications.

All employees shall be trained and experienced in their trade IAW industry standards.

IAW Montana Public Service Commission (PSC), Montana Code Annotated (MCA) section 69-12-324, a Class D motor carrier certificate shall be obtained by the Contractor.

All applicable licenses for vehicles and vehicle operation will be obtained by the Contractor.

2.3.2. Work Environment.

The requirements of this contract occur on a military installation and delays due to exercises, contingencies, and real world security measure are part of the work environment and cannot be considered cause for an adjustment in price. On special occasions the CO and FM can waive the requirement for the scheduled collection to which the contractor will be compensated at the established site rate.

2.3.3. Protection of Real Property.

The contractor shall protect all government property, including grounds, resulting from operations. The contractor shall immediately report any damage to government property to the CO and the FM. The contractor shall repair or replace all damage to real property including grounds, as approved by the CO at no additional expense to the government. All damage by the contractor shall be repaired within five (5) workdays by the contractor with materials of like type, quality, and finish by skilled craftsmen of the trades involved.

2.3.4. Safety Requirements and Reports.

The contractor shall perform work in a safe manner as required by OSHA Safety and Health Requirements. Provide a verbal report to the CO as soon as possible of each occurrence of an accident resulting in death, injury, occupational disease, or adverse environmental impact. Provide a completed copy of required Accident Investigation Reports to the CO within five (5) calendar days of each occurrence.

2.3.5. Anti-Terrorism (AT) Awareness Training.

When requested by the contractor, the Government will provide AT level-1 awareness training in accordance with AFI 10-245. The objective of the training is to provide personnel with requisite knowledge necessary to remain vigilant for possible terrorist actions and enable employment of AT tactics, techniques, and procedures. AT awareness training will be provided by an authorized instructor.

2.3.6. Combating Trafficing in Persons (CTIP).

In accordance with FAR 52.222-50, Combating Trafficking in Persons, the Contractor shall notify its employees of The United States Government's policy prohibiting trafficking in persons, described in paragraph (b) of this clause and the actions that will be taken against employees or agents for violations of this policy. Contractors, subcontractors and their employees shall not:

• Engage in any form of trafficking in persons during performance of the contract.

• Procure commercial sex acts during performance of the contract.

• Use forced labor in the performance of the contract.

2.3.6.1. Combating Trafficking in Persons Training.

The DoD CTIP website is http://ctip.defense.gov/. The website includes DoD policy on CTIP, CTIP training information, and links to the National TIP hotline, the DoD IG website, the Department of State Office to Monitor and Combat Trafficking in Persons, and other Government and non-Government organization websites.

2.4. LABOR REPORTS:

The contractor shall report ALL contractor labor hours (including subcontractor hours) required for performance of services provided under this contract via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www/ecmra.mil. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help desk.
