Section A: General Contract Information

Contracting Activity: 92nd Contracting Squadron, 110 W Ent St, Fairchild AFB WA 99011-8568

Project/Program Name: FY20 CES Magnesium Chloride

Purchase Request/Identification Number: FA462020QA306

Estimated Contract Cost (including Options):

Section B: Description of the Supplies/Services Required

The 92d Civil Engineer Squadron (CES) is requesting the use of other than full and open competition for the purchase of 25,000 gallons of Magnesium Chloride Street Deicer (FreezGard Zero CI Plus). The proposed FreezGard Zero Plus is required to maintain base streets during winter operations. The acquisition will be as a Brand Name requirement under the authority of FAR part 13.106-1(b)(1).

Section C: Justification for Soliciting from a Single Source or Brand Name

The removal of snow and ice from base streets is a mission critical requirement at Fairchild AFB. The Government must be able to maintain the streets at all times to meet mission requirements. The Magnesium Chloride Street Deicer (Freezgard Zero CI Plus) has a chemical composition that is unique to the brand and manufacturer. The purchase and use of the Freezgard Zero CI Plus is necessary to meet our needs for the following reasons:

A. Research accomplished by AFCEC revealed the unique chemical composition of each Snow and Ice Control (SNIC) product in accordance to their manufacturer. Additionally, there is a lack of warranty from a manufacturer for the safety of their product if it is mixed with another manufacturer. Companies will not guarantee the compatibility, storage safety, toxicity, handling procedures, and performance if mixed with anther product.

B. Over the past 5 years Fairchild AFB has purchased and utilized Freezgard Zero CI Plus Liquid Deicer for snow and ice control. 92 CES utilizes one (1) 30,000 gallon above ground tank for the storage of the liquid deicer. Additionally, there are two (2) 1,000 gallon tank trucks that are used for the distribution of the dicer during winter winter operations. Currently, there is a 15,000 gallon supply of Freezgard Zero CI Plus contained in the storage tank. The current supply levels limits the number of sources/manufactures that provide the same chemical composition for the product.

C. AFI 32-1001 Civil Engineering Operations, Chapter 13 Snow and Ice Control Program governs the usage of snow and ice control methods. Paragraph 13.3.2.4 states "All products shall be used as recommended by the manufacturer." Manufacturers do not guarantee their product will work as designed if mixed with another product. There is also no guarantee against damage caused by the mixing of different products. The use of another product or manufacturer will likely cause damage to the storage tank and trucks. This would result in disruption of 92 CES's Snow and Ice Control operations. Furthermore, the damage of Fairchild AFB's property would not be covered by the manufacturer if the recommendations for the safety of their product are not followed, thus causing unnecessary incurred costs by the government.

E. In accordance with AFI 32-1001, the only Snow and Ice method practical for this requirement is the use of Magnesium Chloride Street Deicer (Freezgard Zero CI Plus) or sand. The use of sand is limited due to environmental concerns and regulations. The use of Freezgard Zero CI Plus Liquid Deicer is essential to satisfy the Government's requirement.

Section D: Efforts to Obtain Competition

Market research revealed no other SNIC product meets the listed chemical requirements of the Magnesium Chloride Street Deicer currently in storage at Fairchild AFB. Accordingly, purchasing Freezgard Zero CI Plus Liquid Deicer is the only acceptable product to prevent mission delays. The 92 CES will experience significant decrease in snow removal capabilities due to equipment damage and degradation as described in section C above.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

At this time, there are no plans locally, or the command level to dispose of or replace the existing 15,000 gallons of Freezgard Zero CI Plus Magnesium Chloride road deicer. Future planning at the command level may allow for other products to be considered, but current stocks need to be depleted first. When acquisition for complete replenishment is required, we will conduct market research and solicit the requirement to the maximum extent possible. Until such time, 92 CES will have the continuous need for Freezgard Zero CI Plus deicer to ensure 100% product compatibility.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(ii), that the circumstances of this contract action deem only a brand name acquisition is reasonably available.
