COMBINED SYNOPSIS/SOLICITATION
FA462020QA211
Missile Trainer Repair 8 July 2020
This is a combined synopsis/solicitation for commercial items prepared in accordance with (IAW) the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
The Request for Quotation (RFQ) number FA462020QA211 for FY20 Missile Trainer Repair shall be used to reference any written quote provided under this RFQ.
The following solicitation document, incorporated provisions, and clauses are in effect through Federal Acquisition Circular FAC 2020-06; Effective 5 June 2020.
This acquisition is being issued as a Sole Source requirement to Green Mountain Research, Inc. in accordance with FAR 13.106-1(b)(1) the NAICS Code of 333318, with a small business size standard of 1,000 Employees. All prospective offeror must be registered in the System for Award Management (SAM) at www.sam.gov . Lack of SAM registration will make an offeror ineligible for award. The Unit Small Business Specialist is Mr. Michael Gilbert, at 509-247- 4880; link to USAF Small Business, http://www.airforcesmallbiz.af.mil; link to SBA, http://sba.gov.
The purpose of this combined synopsis and solicitation is for the repair and installation of equipment for the MANPAD 7 system in accordance with the attached Statement of Work (SOW). The contract CLIN structure is detailed below:

The contractor shall provide all labor, parts, tools, and supervision required to refurbish and upgrade the SA-7B Missile Trainer.
The contractor shall provide the following:
Install (1) GMR Designed Customized Li-Ion Battery Pack.
Install and refurbish (1) new seeker and (1) BCU. PART# CST-LIBP-2020A SA-7B Trainer
QA Test for Thermal Guidance and Operational Testing for the existing MANPADS 7 training simulator, Part
Number GMR2017‐MSIM‐0003, and (1) Long Wave Infrared (LWIR) Camera.
The contractor shall include all shipping cost required to provide the above-mentioned services and parts to and from Fairchild AFB, WA.
FAR Provision 52.212-1, Instruction to Offerors–Commercial Items (MAR 2020), applies to this acquisition and is incorporated by reference. As prescribed in FAR 12.301(c), the following addendum is provided for this solicitation:

Firm Fixed Priced quotes: The resultant contract will be Firm Fixed Priced, accordingly, pricing is not subject to revision and/or negotiation if selected for contract award. Quotes shall include pricing for all work to be performed in the contract CLIN structure description.
Subparagraph (8); All vendors must be registered and active in the System for Award Management (SAM) at https://www.sam.gov/portal/public/SAM/ at time of quote submittal to be considered for award. Vendors must complete all necessary fill-ins and certifications in the on-line Representations and Certifications and return the provision FAR 52.212-3, Offeror Representations and Certifications

Subparagraph (9); Amendments - Vendor will acknowledge, sign and submit with their quote all solicitation amendments
Paragraph (c); first sentence revised as follows: The vendor agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the quote.
To assure timely and equitable evaluation of the quotes, vendors must follow the instructions provided in FAR 52.212-1 and are required to meet all solicitation requirements, failure to meet a requirement may result in an quote being ineligible for award. The government’s terms, conditions, and respective clauses contained within this solicitation are prescribed IAW the FAR, and are not subject to conditionally proposed revisions or changes requested by offerors.
Paragraph (f); Quotes must be sent as stated below, if provided by any other method, incomplete, or missing required items, quotes may not be considered. If submitting via email, it is recommended a read/delivery receipt is attached to the email.

Note: If quotes are mailed or hand delivered, an electronic version of all documents must be provided at time of submission. Beware, “.zip” files are not an acceptable format for the Air Force Network and will not go through government email systems.
Paragraph (g); Interchanges: The government intends to award a contract without Interchanges with respective vendors. The government however, reserves the right to conduct Interchanges, with all, some, or none of the vendors, if deemed in its best interest.
FAR Provision 52.212-2, Evaluation-Commercial Items (OCT 2014)
(a) Pursuant to FAR 12.602 contract award will be made using Simplified Acquisition Procedures IAW FAR 13.106. The government will award a contract resulting from this RFQ to the responsible vendor whose quote, conforming to the RFQ, will be most advantageous to the government, price and other factors considered. The following factors shall be used to evaluate quotes:

(b) Options. The government will not be using options for this acquisition.
(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the government may accept a

FAR Provision 52.212-2, Evaluation-Commercial Items (OCT 2014), applies to this acquisition. As prescribed in FAR 12.301(c), the following addendum is provided for this solicitation:
FAR clause at 52.212-4, Contract Terms and Conditions-Commercial Items (OCT 2018), applies to this acquisition with the following Addendum: Paragraph (c) of this clause is tailored as follows: Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the government.
Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.

52.204-20 Predecessor of Offeror. (Jul 2016)
(a) Definitions. As used in this provision–
“Commercial and Government Entity (CAGE) code” means–
(1)An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity; or
(2)An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. Alternative Line Item Proposal (Jan 2017)
(a) The Government recognizes that the line items established in this solicitation may not conform to the Offeror's practices. Failure to correct these issues can result in difficulties in acceptance of deliverables and processing payments. Therefore, the Offeror is invited to propose alternative line items for which bids, proposals, or quotes are requested in this solicitation to ensure that the resulting contract is economically and administratively advantageous to the Government and the Offeror.
(b) The Offeror may submit one or more additional proposals with alternative line items, provided that alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation. However, acceptance of an alternative proposal is a unilateral decision made solely at the discretion of the Government. Offers that do not comply with the line items specified in this solicitation may be determined to be nonresponsive or unacceptable.

Telecommunications and Video Surveillance Services or Equipment.
(DEC 2019)
(a) Definitions. As used in this provision- Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
Contractors are not prohibited from providing-
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 2016) (a)As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. (2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018)
(a) Definitions. As used in this clause- Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.
Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.
Payment request and receiving report are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall-
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF.

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:
(1) Document type. The Contractor shall submit payment requests using the following document type(s):
(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.
(ii) For fixed price line items
(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer.
(B) For services that do not require shipment of a deliverable, submit either the Invoice 2in1, which meets the requirements for the invoice and receiving report, or the applicable invoice and receiving report, as specified by the Contracting Officer.

(iii) For customary progress payments based on costs incurred, submit a progress payment request.

5352.201-9101 Ombudsman. (OCT 2019)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

5352.223-9000 Elimination of Use of Class I Ozone Depleting Substances (ODS). (OCT 2019)
(a) Contractors shall not:
(1) Provide any service or product with any specification, standard, drawing, or other document that requires the use of a Class I ODS in the test, operation, or maintenance of any system, subsystem, item, component, or process; or
(2) Provide any specification, standard, drawing, or other document that establishes a test, operation, or maintenance requirement that can only be met by use of a Class I ODS as part of this contract/order.
[Note: This prohibition does not apply to manufacturing.]
(b) For the purposes of Air Force policy, the following products that are pure (i.e., they meet the relevant product specification identified in AFI 32-7086) are Class I ODSs:
(1) Halons: 1011, 1202, 1211, 1301, and 2402;
(2) Chlorofluorocarbons (CFCs): CFC-11, CFC-12, CFC-13, CFC-111, CFC-112, CFC-113, CFC-
114, CFC-115, CFC-211, CFC-212, CFC-213, CFC-214, CFC-215, CFC-216, and CFC-217, and the blends R-500, R-501, R-502, and R-503; and

(a) In performing work under this contract on a Government installation, the contractor shall:
(1) Take all reasonable steps and precautions to prevent accidents and preserve the health and safety of contractor and Government personnel performing or in any way coming in contact with the performance of this contract; and
(2) Take such additional immediate precautions as the contracting officer may reasonably require for health and safety purposes.
(b) The contracting officer may, by written order, direct Air Force Occupational Safety and Health (AFOSH) Standards and/or health/safety standards as may be required in the performance of this contract and any adjustments resulting from such direction will be in accordance with the Changes clause of this contract.
(c) Any violation of these health and safety rules and requirements, unless promptly corrected as directed by the contracting officer, shall be grounds for termination of this contract in accordance with the Default clause of this contract.

5352.242.9000 Contractor Acces to Air Force Installations. (OCT 2019)
IDENTIFICATION CARDS AND VEHICLE PASSES
All security requirements and procedures shall be coordinated with the 92d Security Forces Squadron.
Any traffic diversions or road closures will be coordinated with 92 SFS/S3, Bldg 2071, five (5) days prior to the diversion or closure. All activities of the contractor and his employees and subcontractors and their employees while on base shall be conducted in strict accordance with all base regulations, including those of the Fire Marshall as well as security directives.
All contractor employees required to enter FAFB in the performance of this contract must first be issued a Defense Biometrics Identification Card (DBIDS Card) for identification purposes. This identification must be readily accessible at all times within the confines of FAFB. If an employee is dismissed from employment, resigns, or if there is no longer a contractual requirement for the employee to enter FAFB, the contractor’s project manager or alternate shall ensure that the DBIDS Card and any other identification, i.e., vehicle passes, issued to the employee are expeditiously returned prior to final payment. If all identification is not provided, a portion of the final payment (to be determined by the Contracting Officer) shall be withheld pending its submission.
The contractor will be issued sufficient blank applications for issuance of DBIDS Cards. These applications are to be completed by electronic means or legibly in ink. Attach a front and back copy of your state driver’s license to the application. All ID credentials submitted shall be Real ID Act compliant and not contain any statement such as “Not for Federal Purposes” or any similar statement. These credentials will not be accepted for identity proofing. Contact 92 SFS/S3OEP, (509) 247-5071 for alternate acceptable forms of identification. The applications, when completed, shall be hand carried to Civil Engineering (CE) or Contracting Officer (CONS) for signature. After the application is signed, the Contractor shall hand carry the applications to the Security Forces Pass and Registration Section (92 SFS/ S3OEP), Bldg. 4325, FAFB. The Pass and Registration Section will process the applications within ten (10) workdays of receipt. Upon processing, the Pass and Registration Section will maintain the application for up to 30 days from the date submitted and then destroy the application. When processing is completed the applicant will appear, in person at Pass & Registration, to have the card issued.
Contractor identification cards will be issued for the performance period of the contract only, or for 1 year, whichever is the shorter period of time. Passes for contractor personnel where the performance period extends beyond 1 year, or where the contract is extended beyond the original scheduled completion date, will have to be reissued. Procedures for reissue will be the same for the original issue.
