CLAUSES INCORPORATED BY FULL TEXT
52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (AUG 2011) (DEVIATION)
(a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times, the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(b)(1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(i) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
(i) 52.203-13, Contractor Code of Business Ethics and Conduct (APR 2010) (Pub. L. 110-252, Title VI, Chapter 1 (41 U.S.C. 251 note).

252.232-7003 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS AND RECEIVING REPORTS (MAR 2008)
(a) Definitions. As used in this clause--
(1) Contract financing payment and invoice payment have the meanings given in section 32.001 of the Federal Acquisition Regulation.
(2) Electronic form means any automated system that transmits information electronically from the initiating system to all affected systems. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests. However, scanned documents are acceptable when they are part of a submission of a payment request made using Wide Area WorkFlow (WAWF) or another electronic form authorized by the Contracting Officer.
(3) Payment request means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.
(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests and receiving reports using WAWF, in one of the following electronic formats that WAWF accepts: Electronic Data Interchange, Secure File Transfer Protocol, or World Wide Web input. Information regarding WAWF is available on the Internet at https://wawf.eb.mil/.
(c) The Contractor may submit a payment request and receiving report using other than WAWF only when--
(1) The Contracting Officer authorizes use of another electronic form. With such an authorization, the Contractor and the Contracting Officer shall agree to a plan, which shall include a timeline, specifying when the Contractor will transfer to WAWF;
(2) DoD is unable to receive a payment request or provide acceptance in electronic form;
(3) The Contracting Officer administering the contract for payment has determined, in writing, that electronic submission would be unduly burdensome to the Contractor. In such cases, the Contractor shall include a copy of the Contracting Officer's determination with each request for payment; or
(4) DoD makes payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System).
(d) The Contractor shall submit any non-electronic payment requests using the method or methods specified in Section G of the contract.
(e) In addition to the requirements of this clause, the Contractor shall meet the requirements of the appropriate payment clauses in this contract when submitting payments requests.

5352.201-9101 OMBUDSMAN (AUG 2005)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
(c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, HQ AF Global Strike Command/A7K 41 Orville Wright Ave, Suite 202, Barksdale AFB, LA 71110-2415 , 318-456-6336, AFGSCA7K@barksdale.af.mil. Concerns, issues, disagreements, and recommendations that cannot be resolved at the MAJCOM/DRU level, may be brought by the concerned party for further consideration to the Air Force ombudsman, Associate Deputy Assistant Secretary (ADAS) (Contracting), SAF/AQC, 1060 Air Force Pentagon, Washington DC 20330-1060, phone number (703) 588-7004, facsimile number (703) 588-1067.
(d) The ombudsman has no authority to render a decision that binds the agency.
(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.

MANUFACTURING SPECIFICATIONS
Manufacturing Specification for Double Wall Diesel Truck Mounted Tanks
PART 1.0
SCOPE
Furnish (5EA) 10 carbon steel or equivalent, double wall storage tanks UL approved or equal, in accordance with the definitions given. The tanks shall be manufactured by typical process for any diesel fuel. Tank capacity & description shall be listed within this specification.
PART 2.0
MATERIALS
2.1 Carbon Steel or equivalent
The tanks shall be manufactured with material used for normal manufacturing of storage tanks or approved equal. All color and paint pigments may be as desired by the customer or as designated by the tank manufacturer, to include exposure to sunlight and diesel fuel without failure. The tank manufacturer may not supply a copy of the mechanical property table as used to manufacture the specified tank, but materials similar to Underwriters Laboratories UL 142 is requested.
PART 3.0
TANK CONSTRUCTION
3.1 Design Parameters
The tanks shall be designed to withstand stress value to hold no greater than 110 gallons when mounted in truck box or on a flat bed, with an adequate safety factor. Tanks will have uniform wall thickness of metal throughout the entire internal surface area of vessel. Underwriters Laboratories UL 142 certification is not required, but should be similar in construction.
3.2 Appearance
The finished surface shall be as free as practical from visual defects such as foreign inclusions; air bubbles, pinholes, and craters. All welds and edges where openings are cut into the tanks shall be trimmed smooth enough to not cut or puncture human skin.
3.3 Dimensions and Tolerances
The tank dimensions shall be measured externally. The tolerance on the outside length shall be plus or minus 3% on the long edge. The square end tolerances can be as much as 10%, with a preference to be as close as possible. The measurements shall be in the horizontal position. All tanks shall have a minimum 90 gallons and maximum of 110 gallons. Internal tank dimensions shall be up to manufacturer as long as double wall tank specifications are met. See attached sheet for exterior dimensions- (5 tanks 84” long by 18“square, 5 tanks 42” long by 24 “square)
PART 4.0
DESCRIPTION OF VESSEL
4.1 Tank Design
The design of the vessel shall be flat bottom, closed top, and seamless in construction. The top of the outer (Secondary) tank shall include two female 2” NPT openings to the inner tank, centered on the narrow dimension but each one approximately six inches from the tank ends. One opening is to be used for fill and vent access accommodating 2" Male Vented Locking Fill Cap provided by the manufacturer.
(2” Triplex Vent) Part Number: 0037-02-2030 The second female two inch NPT opening is to be utilized by customer for the pump assembly (customer furnished pump). The internal tank shall have a one half inch or three quarter inch NPT drain bung welded so that the internal tank (primary) can be drained to within one inch of the bottom of the tank. The plug will be provided by the customer. The dimensions of the primary tank and secondary tank shall be designed to allow for inspection of leakage of the internal tank. This can be a bung welded to the outer tank in either of two positions. On the lower edge the same side as the drain opening, or on the top in any convenient location to accommodate a dip stick to verify internal tank integrity. The outer tank shall provide a weather shield for the inner tank, restricting the elements from entering and a flush mount drain to purge any condensation. Tank(s) shall withstand an air pressure test of 3 - 5 psi.
The outer tank shall be flat bottom in construction and shall have a minimum of two angles welded on the bottom sidewall that extend lengthwise (longest dimension) providing a means to mount the tank. The angles shall also provide an area for the placement of bottom discharge fittings. The angles shall also provide stability and reinforcement for the outer tank for installations that require frame restraint system. No provision for lifting devices for tank placement is necessary except for the angles on the bottom edge. Angle iron welded on mounts shall be of thickness to support fully loaded tank at 3 G’s.
The inner and outer tanks shall be fastened together with permanent welds for handling and movement after mounting. The inner and outer tanks shall be separated enough to allow free flow of fluid in case of inner (primary) tank failure.
Wall thickness for both primary and secondary vessels will be uniform throughout. Leak testing and structure integrity shall be the responsibility of the manufacture. Thickness of material will be consistent throughout. Tank shall not be designed to support any accessory equipment except the fuel pump when installed according to manufacturer's instructions and limitations. Tank(s) shall be capable of storing diesel fuel only at ambient temperature, not to exceed 120 degrees Fahrenheit. Internal baffles shall be provided when span exceeds 36 inches of length(two baffles in a 84 inch span, one baffle in a 42 inch span). Baffles shall have a minimum internal one inch top and bottom openings acrross the width.
Part 5.0
Accessories
5.1 Side Wall Fittings
Fitting shall pass through the sidewall of both the primary and secondary tank on the flats provided by the secondary tank. 1 each ¾ or ½ fitting shall pass through the sidewall of the primary and the secondary tank. The fitting shall be a metallic NPT fitting. The metallic fitting shall be constructed out of material compatible with the tank contents consistent with the rest of the tank material. All mounting material shall be compatible with the tank contents and construction material. The sidewall fittings shall be constructed in a manner as not to expose cross sections of walls and to prevent leakage between the two tanks. Fittings shall be located on the same lower sidewall of the storage tank. Tank shall be shipped with vent and fill cap only and tank openings taped or sealed, no discharge nozzle or pump included. No additional fitting installation will be required. Anchor bolts supplied by the customer.
Underwriters Laboratories UL 142 does not apply but similar manufacturing techniques are requested.

Not Required 5.8 Inspection and Test Procedures Testing shall be done on all tanks to ensure a leak proof seal on all installed fittings and welds. No impact tests required. Tank capacity must be between 90 and 110 gallons measured and documented upon delivery. Tank must be able to mount in the bed of F450 box and flat bed with installed angle mounts accommodating the frame width (mount bolts supplied by the customer).
5.9 Interstitial Leak Detection System
Each tank shall be installed with a leak detection system to detect liquids within the interstitial space between the primary and secondary tank. Leak detection shall be physical/visual only.
Visual indication and drain may be collocated for the external tank and in the same area as the internal drain. The individual drains may not be on opposite sides or the ends.
