I. Contracting Activity.

II. Nature and/or description of the action being processed.
a. This Justification and Approval (J&A) is being requested to authorize the use of other than full and open competition procedures to procure Air and Missile Defense Operational Test Suite (AMDOTS) Remote Monitoring Units (RMU) Extended Warranty Support from Protogate Inc.
b. Currently, there is Only One Responsible Source and No Other Supplies or Services that will satisfy agency requirements.
This is a new procurement (firm-fixed price)contract with one (1) Six Month Base in the amount of $51,022.36 and three (3) option years warranty in the amount of $102,044.14 per year (Total Contract amount $357,156.49.)
III. Description of supplies/services required to meet agency needs.
The Freeway Monitor product was developed by Protogate, Inc. in response to the AMDOTS project request for a standardized monitoring capability. Within the AMDOTS project, the Freeway Monitor product is referred to as a Remote Monitoring Unit (RMU). The RMU provides data collection and storage, with limited analysis for Missile Warning, Air Mission, and Space Sensor message collection and stand-alone post-test analysis capability. Stored data format is standardized across all locations which greatly reduces the post-test analysis time and costs over previous methods of data collection.
Each RMU system is comprised of a Protogate Freeway server box containing one or more ICP2432B Intelligent Communication Processors (ICP) for monitoring serial communication lines. The ICP boards tap into existing serial lines through the use of EIA-232/EIA-530 monitoring cables, also known as Y-cables. The Y-cables prevent the RMU from interacting with any operational system. Some RMU systems also contain additional Network Interface Cards (NIC) for monitoring operational Ethernet connections.
The RMU software consists of the Monitor daemon running on the Freeway server. The daemon collects data from the ICP and NIC boards, and stores the data on the Freeway hard drive. The daemon also provides a user interface for configuration and control of the serial and Ethernet connections. Each ICP board runs one of Protogate's standard protocol software products (such as ADCCP, Mode I, Milstar, etc). The type of protocol software loaded on the ICP boards vary from site to site.
The RMU system is completely self-contained for data collection. The output data generated by the RMU consists only of data files that contain records of individual messages obtained by monitoring the target communication circuits. Each message record within the files include the date/time received, the decoded short name of the message recognized, the size of the message, and either a HEX or ASCII representation of the entire message received, including checksum. Stored message data is extracted from the RMU using a dedicated Ethernet connection that can be optionally connected to the SIPRNET or local hub. For sites where network connections are not available, message data may be written to a DVD disc and physically removed from the site.
Protogate supplies all the hardware and software components of the RMU system except for the equipment needed to physically tap into existing lines. These devices are normally patch panels (for serial lines) or Ethernet taps (for IP connections) and are provided by the customer. The remaining components are all proprietary to Protogate, Inc. As such, the RMU can only be maintained by Protogate since they are the sole developer/ manufacturer of these components. Since the Freeway Monitor product was developed, Protogate has provided the AMDOTS project with hardware and software maintenance support. Hardware support normally includes equipment repair and replacement. Software support normally includes bug fixes and updates.

IV. Statutory authority permitting Other than Full and Open Competition.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
a. Protogate Inc. has over 25 years of legacy and specialty protocol experience. Protogate's employees have developed one of the industry's most unique and extensive protocol libraries. There are over 100 legacy and specialty protocols available for use on Freeway servers, including MILSTD 1200, MILSTAR, MILSTD 1300B, Asynchronous Wire Service (AWS), and a wide variety of military and radar protocols required by the AMDOTS program. A single Freeway can accommodate multiple protocols with a different protocol running on each communications board in the enclosure. Additionally, Protogate Freeway Server is an existing component of the AMDOTS program since 48 have been deployed in the field between FY06 through FY18.
b. Currently, Protogate Inc. is the only company qualified to produce the items required items such as the serial data cards and associated software because of proprietary rights. This software cannot be readily duplicated and/or maintained by any other vendor. NC3 has made efforts to research additional sources for similar items but none were available due to copyright laws. No other source met all requirements. Protogate is the only responsible source with the necessary design, manufacturing, production, and process data capable of providing and extended warranty that meet the minimum requirements for form, fit, and function of the AMDOTS RMU this corporate knowledge can only be provided by Protogate Inc. and cannot be acquired elsewhere.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
NC3 conducted a web search (Google) for potential sources to provide warranty services and requested of the incumbent if they had any US distributors capable of providing services. Additionally, a sources sought posted on May 29 which resulted in no responses aside from Protogate. At this time there are no other vendors identified to provide the required services.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
Extended Warranties vary between 15-20%, per year, of total equipment value. Total amount to re-procure the AMDTOS RMUs is over $900,000, making the cost for the Extended Warranty fair and reasonable. The costs for the Protogate RMUs vary based on the unique configuration and model of each unit, a total list of the 52 RMU configurations was provided by Protogate Inc. The estimates provided by Protogate are based on commercial hardware/software maintenance pricing. Special discounts are given to us at commercial price minus the discounts (45% in base and two (2) option years).

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Research was conducted and identified AMDOTS maintains proprietary rights of their equipment due to the specific hardware and software they contain. It was further determined that due to the software copyright laws held by Protogate Inc. and the proprietary nature of the hardware Protogate Inc. is the only vendor that could offer the level of support required. Additionally, a sources sought posted on May 29 which resulted in no responses aside from
Protogate.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
RMU Freeway Servers from Protogate have previously gained DoD Information Assurance Certification and Accreditation Process (DIACAP) Accreditations and current DoD Risk Management Framework (RMF) Accreditations in similar roles within ITW/AA architecture and are currently fielded as part of the Communications Processing System (CPS). NC3 has spent approx. $2.8M deploying RMUs to the field and supporting NC3 operations. Protogate has just recently made the RMUs capable of Two Factor Authentication (2FA) which is a DoD CIO requirement.
X. List of sources, if any, that expressed interest in the acquisition.
A sources sought posted on May 29. No competitors aside from Protogate have expressed interest.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
If or when a subsequent acquisition for this service is required, additional market research will be performed along with a sources sought and a review of any new and relevant technologies which might be available.
