AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901) FAR 6.302-1 - 10 U.S.C. 2304(c)(1), Only One Responsible Source and No Other supplies or Services Will Satisfy Agency Requirements

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Honeywell International is the only company that can provide personnel, parts, and service to meet the requirements of the EMCS in order to maintain an operational status that is within established regulations and guidelines. Honeywell does not give data rights, nor does it provide system parts to any third party contractors. The 55th Civil Engineering Squadron has estimated a cost between eight and ten million dollars to replace the system to another non-proprietary system that accomplishes the same task. Therefore, Honeywell International is the only responsible source and no other services will satisfy the governments requirement, thus justifying the use of sole sources procedures for this acquisition.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A sources sought was posted (FA4600-19-R-0005 on 14 Nov 2018) with only response, Honeywell. Because Honeywell does not allow third parties access to its proprietary information, the government does not anticipate that any other offeror could meet the requirement. Therefore the government has not made further efforts to solicit from other potential sources.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The vendor currently supplies the same and similar services to multiple other military installations and private entities.

This information allows the contracting officer to have a high confidence level in the anticipated price to the Government being fair and reasonable. If required, other than certified cost and pricing data may be requested.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

The previous contract was a sole source to Honeywell Inc. due to the proprietary nature of the requirement. Honeywell Inc. confirmed that it continues to be the sole owner of the proprietary support service for the proprietary EMCS systems installed on Offutt AFB, and there are no other authorized/certified companies that can work on the system.

A sources sought was posted (FA4600-19-R-0005 on 14 Nov 2018) with only response, Honeywell.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Replacement parts and software are manufactured only by Honeywell International. The EMCS system contains several panels that only communicate on Honeywell's proprietary system without any open standards.

X. List of any sources that expressed, in writing, an interest in the acquisition.

None.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition

If the Government receives information regarding Honeywell releasing the system from it’s proprietary status, the requirement may be competed in the future.
