JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

Defense Technical Information Center Software, Networks, Information and Modeling & Simulation (SNIM) Contracts No. FA1500-10-D-0001 through – 0009

I. AGENCY AND CONTRACTING ACTIVITY

Agency: Defense Technical Information Center (DTIC)

Contracting Activity: Department of the Air Force, Air Force Installation Contracting Agency (AFICA), DTIC Information Analysis Center (IAC) Program contracting support office (AFICA/KD), Offutt AFB, NE

II. NATURE AND/OR DESCRIPTION OF THE ACTION

This Justification and Approval (J&A) authorizes the use of other than full and open competition procedures for the Department of Defense (DoD) to exercise the Option To Extend Services provisions of the current SNIM contracts (FA1500-10-D-0001 through – 0009) to extend the ordering period for up to six additional months. The Federal Acquisition Regulation clause 52.217-8, Option To Extend Services, was included in the original solicitation and initial award. The SNIM contracts are currently scheduled to expire 31 May 2015. The intent is to extend the present ordering period of the Basic Contracts for up to six months from 1 June 2015 through 30 November 2015. This will consist of an initial 4-month base period, and two 1-month option periods. This extension will permit the continuation of performance of the current SNIM contracts while the requirement is recompeted as the Cyber Security Technical Area Tasks contract (CSTATs, FA8075-14-R-0001), which is projected be awarded around 1 October 2015. Exercising these options will not increase the overall $2B ceiling value (amount of all orders that can be issued) of the SNIM contracts. The Government intends to extend the contract pricing with the nine incumbent contractors to cover the management reporting requirements of the basic contracts. The Government estimates the total cumulative additional amount of cost for all nine contracts to be approximately $23,000.00. The contracts will be extended within the time period of this J&A to allow for the continued capability to award orders supporting DoD and other Government agency’s SNIM Research, Development, Testing & Evaluation (RDT&E) requirements only as long as necessary to execute the acquisition procedures and complete source selection activities for the competitive follow-on contract.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

Under the direction of the DTIC IAC Program Management Office (DTIC-I), SNIM is a non-commercial, Cost-Plus-Fix-Fee, multiple award contract vehicle that was awarded on a competitive basis to support the DTIC IAC Program. Under individually competed and separately funded orders, the SNIM contractors perform large, complex, scientific and technical RDT&E and/or RDT&E related advisory and assistance service requirements that are within the SNIM focus areas of software data and analysis, networks, information assurance, modeling and simulation.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 USC 2304(c)(1), as implemented by FAR 6.302-1, only one responsible source or a limited number of responsible sources, and no other supplies or services will satisfy agency requirements.

V. DEMONSTRATION THAT THE CONTRACTORS’ UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

Continuing performance under the SNIM contracts with the incumbent contractors is in the Government’s best interest for the reasons cited below:

A. Uninterrupted Mission Support: The nine incumbent contractors are the only responsible sources that already have the capability, resources, clearances, and working relations with government entities in place to perform the SNIM requirements that will assure the continuity of operations during the contemplated 6-month period without interruption and impact to DTIC’s IAC Program mission.

B. Increased/Duplication of Costs: Executing each individual SNIM requirement outside of an established IDIQ contract structure would require the same acquisition cycle process as is followed for the CS TATs acquisitions or other open market procurements. This would only further increase and/or duplicate costs for all interested and potential offerors as well as for the Government.

C. Use of Alternative Contracts: Per DFARS 235.010(b) “For DoD, the Defense Technical Information Center is responsible for collecting all scientific and technical reports.” Even though this is specified the likelihood that all Scientific and Technical Information (STI) is captured across the DoD is marginal at best. Not all end users having SNIM type mission requirements may be familiar with DTIC or the above regulation, nor is it likely that the requirements written under other contract vehicles include a deliverable of STI to DTIC. Thus, the continuance of the SNIM contracts is the best solution for DTIC to successfully meet its mission and ultimately for the Government to realize the benefits the contracts and the IAC program provide in generating and collecting STI that can be used over and over again through the performance of critical SNIM requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE

A special notice synopsis indicating the Government’s intent to extend the SNIM contracts performance period up to 6 months was posted to the FedBizOpps website on 6 May 2014. The notice stated that information received by close of business 21 May 2014 would be considered by the Government for the purpose of determining whether to conduct a competitive acquisition. No companies responded with expressed interest or identified capability to satisfy the SNIM requirement(s), nor were any objections received from industry regarding the Government’s intent to extend the existing contracts.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The extension of the management reporting requirements of the basic contracts will use the established contract rates that were established under competitive conditions. Individual orders will be competed in accordance with the existing multiple award contracts under the Fair Opportunity process.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

As stated in Section VI above, a special notice synopsis was posted and no responses or objections were received. Based on this market intelligence, no firms other than the incumbent contracts have been identified that are interested in performing the SNIM requirements within the required J&A timeframe.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

An interruption in the ability to award critical requirements under the SNIM contracts will cause harm to DTIC’s mission to acquire, analyze, disseminate, and generate critical STI, as well as the RDT&E mission requirements of the DoD and other federal agencies. This could ultimately lead to catastrophic consequences regarding national security and defense. A SNIM contracts extension ensures the community has the uninterrupted ability to perform critical and timely DoD and other Government agency missions generating invaluable STI while the Government is pursuing a competitive follow-on contract.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

None. See Sections VI and VIII.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

The CS TATs acquisition will be conducted using full and open competitive procedures, with a small business set-aside where the Government will seek to award a pool of prime contracts to small businesses, as well as a pool of prime contracts that will be competed on a full and open basis. Small businesses will elect to compete in either or both pools.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by signature on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility and form a basis for the justification, are complete and accurate.
