SECTION 1

1. Description of Services. The contractor shall perform recycling collection and transportation, for the Base at Lajes Field, Azores. These requirements shall be performed in accordance with the Final Governing Standards (FGS) Environmental Protection for the Department of Defense (DoD) Operations in the Azores, Portugal, all local and commercial standards and this Performance Based Work Statement (PWS). The contractor is encouraged and expected to use an innovative approaches to efficiently and effectively accomplish the service in a timely manner that fosters pride and ownership in the work performed.

1.1. Collection Requirements.

1.1.1. Routes/Schedule Submittals. The contractor shall establish vehicle routes and collection schedules and submit to the Contracting Officer prior to start of contract performance. No changes to the schedule or haul route shall take place without coordinating with the Contracting Officer. Frequency tables are located at Appendix 1.

Route and schedule changes shall be submitted to the Contracting Officer, and will be coordinated with the contracting officer representative (COR) prior to its implementation. Additionally, the contractor shall notify COR of any conditions that may interrupt the schedule of performance such as disposal sites backed up, delays due to security measures, exercises, vehicle breakdowns, blocked containers, etc. Collections as a result of these delays shall be performed by the end of the next working day.

1.1.2. Unscheduled Collections. The Contracting Officer may require the contractor to make unscheduled collection, disposals, and relocation of containers for special events or other occasions. The contractor shall respond within 24 hours of the event.

1.1.3. Route Parameters. The hours of operation for recycling collection services shall be Monday through Friday, between 0800-1700, excluding Portuguese Holidays.

1.1.4. Points of Collection/Relocation. Collection locations for recyclable materials are shown in Appendix 1. Changes in recycle container location either contractor initiated or Government directed must be approved by the Contracting Officer or designated representative. The contractor shall perform these relocations within one workday after notification. (See Appendix 1 for workload data.

1.1.5. Containers. The Government will provide all recycling containers. The Government will provide a bilingual (Portuguese/English) sign that shall be affixed to the front of the container identifying acceptable materials:

1.1.6. Maintaining Containers and Collection Area. The contractor shall position bulk containers for customer ease in depositing recyclable materials. The contractor shall also position containers to minimize interference with adjacent parking areas, sidewalks, roadways, overhead utilities, trees, and other potential obstructions. The contractor shall return all containers to their original location after servicing, in an upright position with the lid securely in place (closed).

The contractor shall ensure containers are emptied prior to exceeding their capacity and shall pick up any litter or waste inside and surrounding the container during the collection. All debris on the ground within 10 feet of the container, whether dropped by the contractor or by base personnel, shall be picked up by the contractor during collection. The contractor shall maintain containers to ensure they are free of odors, dirt, debris and pests. The contractor will notify the Contracting Officer in writing of missing or deteriorated containers.

1.1.7 Recycling Trailers. The contractor shall ensure that the recycling trailers located, one behind building T-576, and the others across building T-717 and T-768, are emptied prior to any bin exceeding 80% of its capacity and shall pick up any litter or waste surrounding the container during the collection.

1.1.8. Base-Wide Collection Areas. The contractor shall provide weekly collection of recycling materials in the base-wide collection areas as established in Appendix 1. These areas include, but are not limited to, office building areas, food service, and recreation areas.

1.1.9. Weighing of Vehicles. When transporting full semi-truck loads of recyclables (e.g. cardboard), vehicle weighing will be required. Accurate weights of all other recycled materials (i.e. mixed loads) shall be obtained using the scales located at the City of Angra Recycling Center. The contractor shall submit a monthly report that includes weight tickets that reflect the disposed tonnage figures, date of disposal, and type of vehicle.

1.2. Disposal.

1.2.1. Off-Base Disposal. The contractor shall dispose of recyclable materials at an off-base recyclable processing center. Disposal shall be in accordance with existing local and host nation regulations.

The contractor shall be responsible for any permit or fees associated with the use of the City of Angra Landfill Recycling Center or other off-base disposal locations.

1.2.2. Disposal of Non-Marketable Materials. The contractor shall be responsible for proper disposal of non-marketable recycling materials, collected at recycling points, at an off-base disposal facility.

This includes any recyclable materials rejected for any reason.

1.2.3. Recyclable Materials Processing. At a minimum, materials collected through the curbside recycling program in the building areas shall include corrugated cardboard, newspaper, aluminum cans, tin cans, magazines, glass (clear, brown, and green beverage containers and jars), plastics, paper (white, computer, mixed), mixed waste paper (cereal boxes, beverage container boxes, junk mail, etc.), and electrical and electronic waste (televisions, telephones, radios, computers, etc.).

Workspace materials consist mainly of corrugated cardboard and paper (white, computer, mixed, shredded). The contractor is responsible for properly sorting, packaging, baling, and processing all recyclable materials. Contractor shall perform collection as required from all workspaces identified in Appendix 1.

1.3. Reports and Records.

1.3.1. The contractor shall provide a monthly report to COR POC detailing total weight (in metric tons) for waste generated, seven calendar days after the end of each month. Report shall accompany each monthly invoice.

SECTION 2

2. Services Summary. The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement and is the point that divides acceptable and unacceptable performance of tasks. These thresholds are critical to mission success. The Government expects the contractor to perform at a minimum, the identified acceptable levels throughout the life of the contract and the contractor’s performance shall be a significant consideration when exercising contract option year(s) and evaluating recommendations for future Government contracts and/or awards.

3.1. Government Furnished Equipment. All recycling containers and three recycling trailers (ref para 1.1.7.)

are provided and owned by the Government. The contracting officer representative (COR) will provide keys to ensure outdoor bins are locked and secured before and after service is provided.

3.2. Security Forces and Fire Protection. In the event of an emergency, Security Forces or the Fire

Department can be reached by dialing 911 from an on base phone. Dialing 295-571-911 from an off base line or cell phone will also reach dispatch for emergency services.

3.3. Telephones and Computers. Contractor personnel shall not use Government telephones, cell phones, and computer equipment.

SECTION 4

4. General Information.

4.1. Contract Manager. The contractor shall provide a contract manager who shall be responsible for the performance of the work under this contract. The contract manager shall have full authority to act for the contractor on all matters relating to daily operations for this contract. The name of this person and an alternate(s) shall be designated in writing to the Contracting Officer prior to the contract start date. The contract manager and alternate(s) shall be able to read, write, speak, and understand English fluently.

4.1.2. Contractor Employees. Contractor personnel shall maintain a neat, clean, and professional appearance at all time. Contractor personnel must be easily recognizable by a distinctive uniform with company name or visible name tagged.

4.1.3. Conduct of Employees. The contractor is fully responsible for the supervision, performance, and conduct of his/her employees at all times while performing under this contract. The contractor shall NOT allow any employee to perform work under this contract while under the influence of alcohol, drugs, or any other incapacitating agent. Security Forces personnel on base have the right to deny entry to the base or remove from the base any contractor employee for misconduct which endangers the health and/or safety of people or property or for reason of security.

4.1.4. On Base Driving. Contractor shall ensure employees have a current and valid local driver’s license and proper insurance. All vehicles shall be operated in accordance with base traffic regulations and are subject to search at any time by Security Forces.

4.1.5. Safety. The contractor shall adhere to all local safety guidelines at all times when performing on the

Installation. Examples include, but are not limited to, wearing safety equipment and using proper precautions when operating machinery.

4.2. Quality Control. The contractor shall develop and maintain a written Quality Control Plan (QCP) to ensure the requirements of the contract are provided as specified and performance objectives are met. One copy of the QCP shall be provided to the Contracting Officer not later than the pre -performance conference.

4.2.1. Quality Control Plan. The plan shall include, as a minimum, a description of all services listed in the PWS. The Quality Control Plan shall address the frequency of inspections, procedures to identify, prevent, and ensure non-recurrence of defective services. It must specify the areas to be inspected on either a scheduled or unscheduled basis. The Quality Control Inspector (QCI) will perform the inspections.

4.2.2. Work Schedules. The contractor shall arrange his performance of work to minimize interference with normal conduct of Government business. The contractor shall establish a work schedule, which includes all required tasks, for each area for all buildings. Any changes made to the scheduled tasks and/or days of performance shall be submitted to the Contracting Officer in writing and will be approved by Contracting Officer at least five days prior to the effective date.

4.3. Quality Assurance. Quality assurance is a systematic plan of all actions necessary to provide confidence that services will conform to established requirements and satisfactory performance is achieved. The Government shall inspect contractor’s performance. Inspections will be conducted in accordance with the Performance Plan (PP) with the intent of verifying compliance with contract requirements.

4.4. Hours of Operation. Base normal operations hours are Monday through Friday, 0800 to 1700. There may be mission situations that require the contractor to work other than normal hours. Some of these situations are military exercises, contingency operations, or weather emergencies. When the contractor’s access to a work area conflicts with the Air Force’s mission requirements, the contractor shall (re)schedule the work to minimize any disruptions. Such scheduling may require work to be accomplished at times other than normal duty hours.

4.4.1. National Portuguese Holidays. The contractor is not required to provide services on the following National Portuguese Holidays:

4.4.2. Down/Family/Goal/Minimum Manning Days. Contractor shall coordinate with facility managers to schedule work on: Goal, Down, Family and/or Minimum Manning days. If access and/or required escort(s) are provided, then the contractor shall perform the regularly scheduled service.

4.5.1. Key and Lock Combination Control. All keys issued for the contractor’s use are only for the outdoor containers and containers sheds. The contractor shall establish and implement methods of making sure all keys issued for the contractor’s use are not lost or misplaced and are not used by unauthorized persons. The contractor shall immediately report to the COR or Contracting Officer any occurrences of loss, unauthorized use, or unauthorized duplication of keys.

4.5.1.1. Master Keys. In the event keys, other than master keys, are lost or duplicated, the contractor may be required, upon written direction of the Contracting Officer, to re-key or replace the affected lock(s) without cost to the Government. The Government may, however, at its option replace the affected lock(s) or performs the re-keying and deduct the cost of such from the monthly payment due the contractor. In the event a master key is lost or duplicated, the Government shall replace all locks and keys for that system and the total costs deducted from the monthly payment due the contractor.

4.5.1.2. Prohibition of Keys. The contractor shall prohibit the use of keys issued by the Government by any persons other than the contractor’s employees. The contractor shall prohibit the opening of locked areas by the contractor’s employees to permit entrance of persons other than contractor’s employees engaged in the performance of scheduled work in those areas.

4.5.1.3. Return of Keys. The contractor shall return any issued keys to the Contracting Officer within 24 hours of receipt of written request from the Contracting Officer. In the event that the contractor cannot produce the requested key(s), the Government shall consider these keys as lost and shall take appropriate action as mentioned in paragraph 4.5.1.1.

4.5.1.4. Lock Combinations. The contractor shall control access to all Government provided lock combinations to preclude unauthorized entry.

4.6. Performance of Services during Crisis Declared by the National Command Authority or Overseas

Combatant Commander. Recycling services under this contract has been identified as NOT essential for performance during crisis. The contracting officer will notify the contractor of a crisis condition or any other condition limiting or excluding contractor employee’s access to the installation and its facilities; as soon as possible after security procedures have been implemented.

4.6.1. Performance of Services during Military Exercises or Operations. Work stoppages may occur during the execution of this contract due to military exercises or operations. During these times, access to areas supporting the exercise or operation may be curtailed or not allowed. During scheduled and unscheduled exercises or operations, the contractor should be prepared to move to other work locations or suspend operations at no additional cost to the Government.

4.7. Environmental and Hazardous Materials Requirements.

4.7.1. Environmental Laws and Regulations Compliance. The contractor shall comply with applicable Final

Governing Standards (FGS) for Portugal, permits, and commercial practice. The contractor shall establish policies and procedures to protect health and safety of personnel to minimize or eliminate risks of personnel safety and environmental pollution.

4.7.2. Environmental Spill Procedures. The contractor shall report and manage the releases/spills of hazardous materials in accordance with applicable local, FGS, USAFE, and the Lajes Field Hazardous Material Emergency Planning and Response Plan (HAZMAT plan). The contractor shall report incident(s) to 535- 6558 (from off base or cell phone – 295-57-6558). Release and/or spill of any hazardous substance or petroleum product shall be reported immediately by calling 911 (from off base or cell phone – 295-571-

911) stating location and type of spill. Liability rests solely with the contractor. Contractor shall be responsible for applicable fines from environmental regulatory agencies resulting from contract negligence.

4.7.3. Environmental Pollution Prevention. The contractor shall perform all work so as to minimize environmental pollution or degradation of the environment or natural/cultural resources. Open burning and burial of materials on base properties is prohibited.

4.7.4. Contractor Hazardous Material Usage Data Requirements. Storage of hazardous materials on base is not authorized. The contractor shall report any hazardous products/materials being used under the performance of this contract. The hazardous products/materials shall be identified in writing any and submitted it with the material safety data sheets to the contracting officer representative (COR). This data shall in turn be submitted to the Hazardous Material Office (HAZMART) who will input the data for tracking in the Enterprise Environmental, Safety, & Occupational Health Management Information System

(EESOH-MIS).

4.7.5. Asbestos/Lead. If suspected asbestos or lead based paint containing materials are encountered when performing any work under this contract, the contractor shall immediately stop work and notify the Contracting Officer or COR. Work will resume only after the area has been cleared by testing or by a certified Government inspector.

4.8. Smoking Policy. All personnel shall comply with the Air Force smoking policy (AFI 40-102 Tobacco Use in the Air Force, section 2) which states smoking is not allowed in any Department of defense facility.

4.9. Gate Control. Unscheduled gate closures by Security Forces may occur at any time and personnel entering or exiting the installation may experience delay. Privately owned vehicles of contractor personnel are subject to being searched pursuant to applicable regulations. The award of this contract does not create a right to have access to any military installation. Any violation of an installation regulation or local statute may result in the termination of the privilege to enter one or more military installations.

SECTION 5

5. Required documentation.

5.1. Contractor Required. Contractor shall submit all items listed a minimum of 10 days prior to start of contract.

5.1.1. Contractor Personnel Listing. Contractor shall provide a listing of all personnel that will be working under this contract.

5.1.2. Routes/Schedule. Contractor shall provide a detailed route and pick-up schedule (task, day, and time).

NOTE: Any requested changes shall be submitted to Contracting Officer 10 days prior to the change.
