About this file

This is a Determination & Findings (D&F) document justifying a sole-source procurement for commercial low-earth-orbit (LEO) satellite internet service. The contracting activity is 19 CONS (United States Air Force), and the total contract value is $21,500.00.

The requirement is to provide Starlink satellite internet kits with standard accessories, activation, and monthly internet service subscriptions for five months to support Morale, Welfare, and Recreation (MWR) activities at a remote, undisclosed location. The service must deliver reliable broadband internet connectivity to enable MWR operations, patron Wi-Fi access, recreational programs, events, point-of-sale connectivity, administrative functions, and backup connectivity when terrestrial internet is unavailable or degraded. The required service start date is December 2026. The sole-source justification is based on market research findings that terrestrial, cellular, fixed-wireless, GEO satellite, and alternative LEO satellite options cannot satisfy the requirement due to insufficient infrastructure at the remote site, existing provider inability to meet service within six months, coverage limitations, data-cap restrictions, and infrastructure extension lead times incompatible with the December 2026 deadline. Starlink is the only identified source capable of meeting all minimum requirements at the specified location within the required timeframe. The D&F cites regulatory authorities RFO 8.401 and GSAR 538.7104-3(a) for FSS Orders, RFO 11.204(a)(2)(ii) for Brand Name, RFO 12.102(a) for Commercial Products and Services, and RFO 13.101(b) for Noncommercial Products and Services. The Contracting Officer Richard Kelly SSgt USAF approved the determination on November 6, 2026.

DETERMINATION & FINDINGS

Authority to Solicit from a Single Source (at or below the SAT)

1. Agency and Contracting Activity: 19 CONS

2. Nature and/or Description of the Action: $21,500.00

Provide commercial low-earth-orbit (LEO) satellite internet service and associated user equipment for Morale, Welfare, and Recreation (MWR) activities at an undisclosed location]. The requirement includes Starlink satellite internet kits, including standard accessories required for operation; activation; and monthly internet service subscriptions for 5 months.

Service shall provide reliable broadband internet connectivity to support authorized MWR operations, patron Wi-Fi access, recreational programs, events, point-of-sale connectivity, administrative functions, and continuity of operations when terrestrial internet service is unavailable, degraded, or insufficient.

3. Citation to the Appropriate Regulation:

(Contracting Officer Instruction: Select the applicable authority for this acquisition)

RFO 8.401 and GSAR 538.7104-3(a) (FSS Orders): The circumstances of the acquisition deem only one source reasonably capable of providing the products, services, or solutions.

RFO 11.204(a)(2)(ii) (Brand Name): The particular brand name, product, or feature is essential to the Government's requirements, and market research indicates other companies' similar products, or products lacking the particular feature, do not meet the agency's needs or cannot be modified to meet the agency's minimum needs,.

RFO 12.102(a) (Commercial Products and Services): Only one source is available,.

RFO 13.101(b) (Noncommercial Products and Services): Only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand-name, or industrial mobilization),.

4. Findings:

The market research found that the requirement cannot be satisfied by the existing terrestrial, cellular, fixed-wireless, GEO satellite, or alternative LEO satellite options evaluated.

The site is remote and not currently served by sufficient terrestrial infrastructure. Existing provider cannot meet the requirement for at least 6 months. Installation of an alternative terrestrial solution would require infrastructure extension and lead time that is incompatible with the required service start date of December 2026.

Cellular and fixed-wireless services were also evaluated. These services do not meet the requirement because of coverage limitation and/or data-cap limitation.

Alternative satellite services were evaluated against the Government’s minimum requirements. No others could satisfy this requirement. The inability to meet these requirements would prevent the undisclosed location from reliably supporting MWR functions.

Starlink is the only identified source that meets all minimum requirements at the specified location and within the required timeframe, based on the documented research. The finding is based on functional requirements—not merely brand preference, prior use, or convenience.

5. Determination: Based on the findings above, the proposed sole source or brand name action is justified under the applicable regulation.

6. Signatory Authority: (Contracting Officer Instruction: In accordance with DAF Approval Authorities Matrix PM 26-C-11 Matrix Item 51 for RFO 13.101(b) actions and GSAR 538.7104-3(a) for FSS orders, the Contracting Officer is the approval authority for these determinations).
