Appendix A – Archdiocese for the Military Services, USA Application Process

1. GENERAL INFORMATION

1.1. Environment: The Altus Air Force Base (AFB) Chaplain Corps mission is tailored to the mission of the 97th Air Mobility Wing mission. We provide for the religious and spiritual needs of Air Force members, their families, and other authorized individuals.

1.2. Scope of Responsibilities: The Auxiliary Catholic Priest (Contractor) will support the Altus AFB Chapel by conducting Catholic religious services, administering rites and sacraments, and overseeing the preparation of ecclesiastical documents to record such services. Services will include Sunday Masses, Baptisms, Holy Day of Obligation Masses, and special Masses. See paragraph 2 below for specific descriptions of services.

1.3. Contracting Officer (CO). The CO will appoint a primary and alternate Government representative for management of the day to day activities of the contract. The identity, title, and authority of this representative will be provided in writing to the Contractor after contact award.

1.3.1. Contracting Officer’s Representative (COR): The COR is responsible for monitoring and inspecting the Contractor’s performance. The Contractor will consult with the COR for resolution of problems or questions regarding this Performance Work Statement. The Contractor will be notified of any and all noncompliance, and will be given the opportunity to correct, if possible, nonconforming work.

1.4. Place of Performance: The primary place of performance is Bldg 301, Altus AFB Chapel located on Altus AFB, OK. The Contractor may be required to occasionally travel away from the normal place of performance as required by the COR.

2. DESCRIPTION OF SERVICES

2.1. The Contractor will conduct Catholic religious services, administer rites and sacraments, and oversee the preparation of ecclesiastical documents and record such services in support of the Altus Air Force Base Chapel.

2.2. Contractor shall meet with the COR on a monthly basis to review and obtain the schedule of services for the upcoming month.

2.3. Dress and appearance standards are business casual or appropriate religious garments, anything outside of that will be approved by the COR.

2.4. Contractor shall be at the respective place of worship and prepared for each service no later than 15 minutes prior to the designated starting time of any service, and no later than 15 minutes prior to the designated starting time of any Special Services or rites.

2.5. The services that are provided by the Contractor are for active duty service members, dependents, DoD civilians and other authorized personnel of the Catholic faith.

2.6. Off-base services are not included in this contract. Requesting parties are responsible for the cost of any auxiliary priest services provided by the Catholic Auxiliary Priest.

2.7. The Contractor shall be required to coordinate efforts with chapel personnel and work in a multi-denominational and pluralistic religious environment to include, but not limited to, Catholic, Protestant, Jewish, and Orthodox faiths. The Contractor shall be required to provide all services in accordance with (IAW) Catholic, Archdiocese for the Military Services, (AMS) faith requirements.

2.8. Contractor shall complete the monthly user file for Air Force Chaplain Corps Activity Reporting System (AFCCARS) on the day service is performed. If unable to gain access to the military computer network to complete the file, then a like report shall be provided to the COR no later than the next duty day.

2.9. The Contractor must understand that privileged communication is protected communication IAW Military Rule of Evidence 503. Under this rule, “a person has a privilege to refuse to disclose and to prevent another from disclosing a confidential communication by the person to a clergyman or to a clergyman’s assistant, if such communication is made either as a formal act of religion or as a matter of conscience.”

2.10. Complete initial and annual training on Privileged Communication, Child Care Criminal History Background Checks, Family Advocacy Program, and Sexual Assault Prevention and Response policy. This training will be scheduled or provided by the chapel staff.

2.11. Limitations

2.11.1. Performance includes only those services, sacraments and rites associated with the Catholic faith. The Contractor WILL NOT perform or conduct:

- Unit engagement (visitation in units)

- Counseling, other than what is required for sacramental reasons (i.e., marital, confession, etc.)

- Leadership advisement

2.11.2. IAW Air Force Instruction 52-101, paragraph 3.7.2. Civilian Clergy. Personnel who serve in Civil Service positions or as Contractors. These individuals are NOT chaplains and WILL NOT use the duty title of “chaplain”.

2.11.3. The Contractor shall not receive any stipend for services provided IAW this performance work statement.

2.12. If a substitute Priest is required, he will be of equal competence to the Contractor and acceptable to the COR. Notice of substitution is given to the COR at least five days prior to the scheduled service or function, where possible. Absences are detailed in para 6.21. below. Prior to any performance, the proposed substitute must provide the COR with evidence of ecclesiastical endorsement as described in Section 3 below. Contractor shall be responsible for payment to any subcontractor.

3. CONTRACTOR REQUIREMENTS

3.1. The Contractor must be in good standing with the Archdiocese for the Military Services (AMS) and provide written evidence of ecclesiastical endorsement for each Catholic Priest performing services. This certification is completed using Department of Defense Form 2088, Statement of Ecclesiastical Endorsement. This certification will be submitted to the COR prior to contract award. Award is contingent on endorsement by the AMS.

3.2. IAW Air Force Instruction 36-2005, paragraph 5.1.3. Qualification and Requirements.

Applicants must possess 120 semester hours of undergraduate credit from an accredited college or university; and possess a Master of Divinity (normally 90 semester hours) or an equivalent theological degree, (usually acquired in 3 years), or have completed 3 full time resident years of graduate level study in theology or related subjects leading to ordination and ecclesiastical endorsement that qualifies the applicant to perform professional functions as a chaplain.

3.3. The Contractor must be able to read, write, speak and understand English fluently. English shall be the only language used with regard to this contract for written correspondence, discussions and other business transactions.

3.4. Background Check. IAW Department of Defense Instruction (DoDI) 1402.5, each individual working with children under the age of 18 in conjunction with this contract must successfully complete a federally mandated criminal history background check (conducted by the Base Chapel) which will include a National Agency Check w/ Inquiries (NACI) and an Installation Records Check (IRC). Failure to satisfactorily complete the criminal history background check shall result in termination of the Service Agreement.

3.5. A résumé shall be included with bid submissions, past performance reports, work references and all supporting documentation to show that the Contractor meets the above requirements.

3.6. Ability to administer both the documentation of services performed and the timely rendering of payment for services (if used) is required.

3.7. Registration. Contractor must be registered in System for Award Management (SAM) before providing a quote on contract.

3.8. Payment. Rate will be based on a competitive quote. Quotes submitted will contain the individual’s name and price quote per unit. The Contractor will be responsible for filing any applicable social security, federal, or state taxes. Contractor will be required to submit monthly invoices through Wide Area Workflow (WAWF) before payment is made. The Defense Finance Accounting Service (DFAS) will make payment within thirty (30) calendar days of receipt of a valid invoice.

4. PERFORMANCE SCHEDULE

4.2. Performance Times:

Sunday Mass (including Reconciliation/and or Baptism): 8:00am-10:00am

Holy Day of Obligation, Penance, Confirmation, and Special Mass: date and time provided to Contractor by the COR during monthly meeting described in paragraph 2.2. NOTE: Baptisms are held before Sunday Mass. Baptisms are not charged independently from Mass.

5. GOVERNMENT/CONTRACTOR FURNISHED PROPERTY

5.1. Government Furnished Supplies and Equipment. All Catholic service supplies and equipment required will be provided by the 97th Air Mobility Wing Chapel. The Contractor may be provided government computer access to conduct duties associated with contract performance and to complete monthly reports. This access is dependent on if the Contractor completes required training and checks IAW DoD and AF policies. The Contractor will be required to use his or her own personal vehicle, and shall not be reimbursed for mileage incurred. The Contractor shall coordinate all support requirements with the COR.

5.2. Government Furnished Building. The Government shall be provided the areas and facilities to conduct services. Contractor shall be provided an area for private counseling and to conduct duties associated with contract performance when required.

5.2.1. Clean-Up/Housekeeping. The Contractor shall maintain facilities and work sites in a clean, neat, and professional appearance at all times.

6. GENERAL AND ADMINISTRATIVE

6.1. Records Management. The Contractor shall manage all data created for government use or legally controlled by the Government, in support of the functional activity or required by AF publication, IAW with the AF records management procedures in Air Force Instruction (AFI) 33

- 322, Records Management Program, paragraph 10, Air Force Manual (AFMAN) 37- 123,paragraph 7.4, Air Force Manual (AFMAN) 37-138, paragraph 2.13, and the Air Force Records Disposition Schedule (AF RDS) located at https://afrims.amc.af.mil/rds_series.cfm or http://www.amc.af.mil/shared/media/document/AFD-060803-003.pdf

6.1.1. Contract Files. The Contractor shall maintain complete and accurate files of documentation, records, and reports required under the terms of this contract in accordance with AFI 131-401. The Contractor shall not allow access to the files by any government agency, non- Governmental agency, or individual agency, or individual unless specifically authorized by the Contracting Officer. Files shall be made available to the Contracting Officer or designated representative upon request. All files will become the property of the Government and shall be turned over the Contracting Officer at the completion or termination of this contract.

6.2. Air Force Antiterrorism (AT) Program. The AT program seeks to deter or limit the effects of terrorist acts against the AF by giving guidance on collecting and disseminating timely threat information, providing training to all AF members, developing comprehensive plans to deter and counter terrorist incidents, allocating funds and personnel and implementing AT measures. In accordance with AFI 10-245 paragraphs 2.18 and paragraph 2.25, DOD Contractors and sub-contractor personnel shall be offered Level 1 - AT Awareness Training. AT Awareness Training may be accomplished by either a Level I - qualified instructor, or by completing the "Force Protection" computer based training (CBT) course on the Advanced Distributed Learning System (ADLS) https://golearn.csd.disa.mil/kc/login/login.asp or the Defense Technical Information Center (DTIC) at https://atlevel1.dtic.mil/ at for individuals without access to NIPR, possessing a CAC card, nor enrolled in DEERS. Compliance with the training will be monitored by the contracting officer representatives.

6.2.1. Altus Air Force Base has an antiterrorism program that is responsible for helping secure and protect the base and its personnel from terrorist attacks. As a Contractor working on Altus Air Force Base, you and your sub-contractors are required to obey all orders from Security Forces, and adhere to all security measures implemented as a result of Force Protection Condition changes (security posture changes). Additionally, you and your sub-contractors are expected to report to base security forces any suspicious activities, packages, or items you see while conducting surveillance of the installation, unauthorized personnel requesting access to the installation, or somebody asking a lot of questions about the base. In an effort to help familiarize you, your employees, and sub-contractors about antiterrorism, Altus Air Force Base has an antiterrorism binder with all of the pertinent information for awareness training available for review at the Pass and Registration Office located at the south gate (building #428) of Altus Air Force Base, Oklahoma.

6.3. Pass and Identification. The Contractor shall ensure the following pass and identification items required for contract performance are obtained for employees and non-government owned vehicles requiring access to Altus AFB to perform contract requirements:

6.3.1. The Contractor is responsible for providing information to assist in completing background checks for those employees requiring access to Altus AFB. This information shall consist of, but not limited to, the following: full name to include first, middle, last, social security number, date of birth, address, driver's license number and state of issue, number of years resident of the State of Oklahoma and Jackson County. This information will be protected under the procedures listed under the Privacy Act of 1974. A background check must be completed prior to unescorted access. Those Contractor employees whose background checks reveal adverse criminal history may be denied access to Altus AFB.

6.3.2. The Contractor is responsible for tracking and retrieving badges from employees upon separation, termination and/or completion of business on Altus AFB, Oklahoma. Badges from employees no longer working on the contract must be turned in to the Contracting office within 30 days of leaving.

6.3.3. Businesses may lose base pass privileges if they fail to control use of badges or do not return them upon completion of use. Excessive abuse may result in termination or a decision not to exercise option periods for this contract. Employees who abuse their badge privileges by attempting base access beyond the dates, times, locations or specified work and other limitations may be subject to revocation of base access.

6.4. Traffic Laws. The Contractor shall comply with all Altus AFB base traffic rules and regulations at all times while on the installation.

6.5. Physical Security. The Government will not be responsible in any way for damage to the Contractor’s supplies, materials, vehicles, equipment, and property or to Contractor personnel’s personal belongings that are damaged or destroyed by fire, theft, accident or other disaster, including terrorist attack. Contractor personnel and any representative of the Contractor entering Altus AFB shall abide by all security regulations and shall be subject to security checks.

6.6. Safety Requirements And Reports. The Contractor shall perform all work in a safe manner as required by OSHA Safety and Health Requirements and follow all DoD Safety regulations. The Contractor shall provide a verbal and written notification to the COR within twenty four (24) hours of an employee accident resulting in death, injury, occupational disease, etc.

6.6.1. The Contractor shall be knowledgeable of and shall comply with all applicable federal, state, and local laws, permits, Department of Defense (DOD), AF, and base requirements and instructions required for the performance of the duties outlined in this PWS. The Contractor shall ensure policies and procedures are established that protect the safety and welfare of customers, employees, and the community to minimize or eliminate any safety or environmental risks. Any safety issues shall be reported immediately to the COR.

6.7. Hours of Operation. Normal duty hours of operation are 0730 to 1630, Monday through Friday.

6.7.1. Emergency, After Normal Duty Hours, Weekends, and Holidays. The Contractor may be required to work after normal duty hours, weekends, or holidays to complete all Catholic religious support services for Altus Air Force Base. The Contractor will not be paid for any overtime hours. The Contractor shall notify the COR of any work performed after duty hours, weekends, or holiday, for informational purposes only. All such work as described in this paragraph shall not be subject to separate negotiations, but shall be included as part of the basic bid.

6.8. Inspection and Acceptance. Services performed under this contract are subject to inspection by the COR at the completion of each task. Inspection of the performance of this contract will be conducted by use of a checklist utilizing random sampling, and/or customer feedback. The Contractor shall promptly correct unsatisfactory service at no additional expense to the Government. The office having responsibility for inspection and acceptance is the Altus AFB Chaplain’s Office.

6.9. Fraud, Waste, and Abuse. The Contractor shall practice utilities conservation. The Contractor shall be responsible for operating under conditions that prevent the waste of any utilities used. The Contractor shall be responsible for maintaining proper conduct and good discipline within the Contractor occupied work area(s). Contractor personnel shall be encouraged to be alert to report to the COR any suspected situations of fraud, waste, and abuse, or other intentionally dishonest conduct against the Government observed during, or in the performance of this contract.

6.10. Conservation of Utilities. Contractor personnel shall practice utilities conservation and shall operate under conditions that preclude waste of Government furnished utilities.

6.10.1. Contractor must comply with all environmental requirements to include completion of required General EMS Awareness training. Contact 97 CES/CEAN for training accessibility.

6.11. Laws. The Contractor shall comply with all local state, and federal laws and regulations that control any work performed. The Contractor shall comply with and keep informed of any changes to these laws and regulations throughout the period of the contract. The Contractor is a recognized professional in their area and is expected to be knowledgeable of all laws and regulations pertaining to their profession.

6.12. Permits, Licenses and Certifications. Unless otherwise specified in this contract, the Contractor shall obtain all necessary permits, licenses, and certifications; give all required notices; and comply with applicable federal, DoD, Air Force, state, county, and local laws, codes, and regulations in performance of the requirements of this contract. The Contractor shall maintain records of such requirements and make the documentation available to the Government for review.

6.13. Government Limitation of Liability. The Government shall not be responsible in any way for damage to Contractors' supplies, materials, equipment and Contractor personnel's personal belongings that are damaged or destroyed by fire, theft, accident or other disaster.

6.14. Contractor Liability

6.14.1. The Contractor shall, at own expense, defend any suits, demands, claims, or actions in which the United States might be named as a defendant, arising out of or as the result of the Contractor’s performance of work under this contract, whether or not such suit, demand, claim or action arose out of or was the result of the Contractor’s negligence. This shall not prejudice the right of the United States to appear in such a suit, participate in a defense and take such action as may be necessary to protect the interest of the United States. Nothing in the above provision shall in any way limit other remedies available to the United States as provided by law, or waive rights of the United States as provided by law.

6.14.2. The Contractor is considered an independent contractor, and not an agent of the government. During the performance of these provisions, the Contractor will be liable and will hold harmless the government against all actions or claims for damages to persons and property due to the fault, negligence, wrongful act, or wrongful omission of the Contractor or their agents.

The Government is not responsible for damage to personal supplies or equipment of the Contractor.

6.14.3. The Government will not be responsible in any way for damage to the Contractor’s supplies, materials, equipment, or to personal property as a result of fire, theft, accident, natural disaster, or other events.

6.14.4. The Contractor is liable for all damages to government real property, when it has been determined by competent authorities that damages were due to Contractor personnel or sub- Contractors negligence.

6.15. Damage to Government/Private Property. Damages to government buildings, equipment, or vegetation are addressed in the FAR contract clause 52.237-2 “Protection of Government Buildings, Equipment, and Vegetation.” The Contractor shall be liable for repair/replacement for any Government or private property damaged by Contractor personnel, vehicles, equipment, or negligence. The Contractor shall immediately advise the COR of any damages and provide an action plan for repairs or replacement.

6.16. Indemnification. The Contractor agrees to indemnify and hold the Government and the Department of the Air Force harmless, whether in tort or in contract, for any and all loss or liability for injury to or death of service provider personnel in transit to, from or during the period of attendance at any of the required locations in support of this production.

6.17. Dispute Process. Any grievance by the Contractor should be resolved at the lowest level.

The reporting levels are as follows: Contracting Officer Representative and then the Contracting Officer.

6.18. Government Quality Assurance. The Government will periodically evaluate the Contractor’s performance by appointing a chapel representative to monitor performance to ensure services are received. The representative will evaluate the Contractor’s performance in accordance with the PWS.

6.19. Government Remedies. The Contracting Officer shall follow the requirements of FAR 52.212-4, Contract Terms and Conditions for Commercial Items (May 1997), for Contractor’s failure to correct nonconforming services.

6.20. Periods of Absence. The Contractor is required to give the COR a two-week notice of any period of absence. The Contractor will provide a subcontractor to perform services in their absence as described in paragraph 2.12. above.

6.21. Key Control. The Contractor shall be responsible for keys provided to the Contractor by the government. Keys shall not be lost, misplaced, or duplicated by Contractor personnel, nor used by unauthorized Contractor personnel. The Contractor shall develop and implement procedures to insure that keys issued to the Contractor by the Government are safeguarded.

6.21.1. The Contractor shall report any occurrence of duplicated, misplaced, or lost keys to the COR within 24 hours after discovery of occurrence, and submit a written report to the COR by close of business the next workday. The written report shall provide complete details relating to duplication, misplacement, or loss. In the event a key is duplicated, misplaced, or lost, all locks and keys for that system will be replaced at the discretion of the Government. The Contractor shall reimburse the government for replacement of locks or rekeying required as a result of keys being duplicated, misplaced, or lost by Contractor personnel. The Contractor shall also reimburse the Government for any government property lost or stolen as a result of unauthorized key duplication, misplaced key, or loss of key by the Contractor or Contractor personnel.

6.22.1. Local operating instructions will be provided on an as needed basis.

6.23. Contractor Manpower Reporting. The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Air Force (or applicable service) via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.

6.23.1. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY) which runs 1 October through 30 September. While inputs may be reported any time during the FY,all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help desk.

APPENDIX A

ARCHDIOCESE FOR THE MILITARY SERVICES, USA APPLICATION PROCESS

Step 1 Must complete an application for the AMS endorsement and faculties.

Step 2 Obtain and submit to the AMS a letter stating:

a. Permission from the Diocesan Ordinary or religious superior

b. Dallas Charter statement

c. Proof of Youth Protection Training.

d. A letter of approval from the designated Catholic Chaplain at Altus AFB

Chapel.

Step 3 After AMS faculties are granted, request from the AMS Chancellor that a DD

Form 2088 be faxed to the Altus AFB Chapel (580) 481-7487. Send to the Attention Of: Superintendent, Chapel Operations.
