I. Contracting Activity.

Department of the Air Force, Air Mobility Command, 628th Contracting Squadron, 101 E. Hill Blvd., Joint Base Charleston, SC 29404- 5021

II. Nature and/or description of the action being processed.

This Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to procure Grounds Maintenance Services for Joint Base Charleston (Air Base), South Carolina from Joppa Maintenance, 47 Lake Country Road, Meredith, NH 03253, incumbent contractor.

The estimated value of this contract action is This procurement is required for the Air Force to continue providing critical Grounds Maintenance Services for the JB CHS - AB for the period for two months while corrective action is being taken as recommended by a GAO Sustained Protest. Services shall be performed for two months.

III. Description of supplies/services required to meet agency needs.

Provide all management, tools, equipment, and labor necessary to perform grounds maintenance service for approximately

622.42 acres of land located at JB CHS-AB.

IV. Statutory authority permitting Other than Full and Open Competition.

IAW FAR Part 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The proposed action will allow for two (2) months of service for continued grounds maintenance services while corrective action is being implemented as recommended by a General Accountability Office (GAO) Sustained Protest. The basic period of the existing contract FA4418-04-C-0001 was awarded 25 Jan 2005 under a HUBZone competitive acquisition using source selection procedures. The period of performance initially expired 30 Sep 14.

The contract period of performance was extended from 1 Oct - 31 Dec ( 3 months) utilizing FAR 52.217-8 Option to Extend Services. Due to the large number of proposals received, the contract period of performance was extended a second time from 1 Jan 15 - 31 Jan 15 and again from 1 Feb - 31 Mar 15. A bridge contract was then put in place due to a GAO protest , 1 April - 30 June 2015. All extensions under FAR 52.217-8 Option to Extend Services have been exhausted. This follow-on 2 month contract is now required due to recommendations from a GAO Sustained Protest of the Hubzone competitive RFP FA4418-14-R-0012 that will result in a replacement contract. Any delay or break in services will have a critical impact and compromise mission capabilities.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

The Request for Proposal (RFP) was posted on FedBizOpps 23 September 2014, and proposals were received on 12 November 2014 under solicitation FA4418-14-R-0012.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer has determined the anticipated cost to the Government will be fair and reasonable based upon a comparison of the proposed price with prices found reasonable on previous purchases, and with the Government independent estimate.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

The Government relied upon the market research recently conducted for the Joint Base Charleston Grounds Maintenance solicitation, FA4418-14-R-0012.

The result of the market research for the current solicitation resulted in the determination HUBZone business concerns can most likely fulfill the requirements of this acquisition. Although no longer a certified HUBZone contractor, the incumbent contractor is a Small Business concern. It is not cost effective and time prohibitive to compete this action among interested HUBZone concerns as they are not able to meet the required performance start date of 1 July 15.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

None.

X. List of sources, if any, that expressed interest in the acquisition.

None.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

628 CONS/LGCA is currently reviewing proposals from solicitation FA4418-14-R-0012, that will result in a competitive award.
