ADDENDUM TO 52-212-1, INSTRUCTION TO OFFERORS – COMMERCIAL ITEMS (JAN 2005)
To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of two separately bound parts, Part I – Technical Capability, and Part II – Price Proposal.
The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will evaluate proposals based on the following factors: Technical Capability and Price. Technical Capability and Price are equally important. A decision on the technical acceptability of each offeror’s proposal shall be made. Only those offerors determined to be technically acceptable will be considered for award. A rating of unacceptable will render the entire proposal unacceptable. The Government will determine technical acceptability as described by the evaluation factors. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to this solicitation in accordance with the evaluation criteria outlined at FAR 52.212-2 of the solicitation, titled “Evaluation –Commercial Items”. The following evaluation procedures will be used to evaluate offers:
EVAULATION PROCEDURES
Factor 1 – Technical Capability Factor 2 - Price
(i) Technical Capability Factor Assessment: The offeror’s proposal shall, as a minimum, address each of the following sub factors, as they apply to the Statement of Work (SOW). During evaluations of each proposal, the Government will assign each sub factor shown below a rating and a written narrative reflecting the sub factor’s strengths and weaknesses.
Technical Capability Subfactor 1 – Duly ordained Roman Catholic Priest in good standing Technical Capability Subfactor 2 – Ecclesiastical Endorsement from the Archdiocese for the Military Services (AMS) The following technical evaluation factors will be evaluated and rated according to the chart listed below:
Rating
Definition
Acceptable
Acceptable – meets minimum mandatory requirements.
Unacceptable
Unacceptable – does not meet minimum mandatory requirements.
(ii) Price Factor Assessment: The purpose of price evaluation is to determine if the price proposed is realistic for the work to be performed, reflects a clear understanding of the requirements, and is consistent with the unique methods of performance and materials described in the offeror’s proposal. This factor will not receive a rating.
The Government will evaluate options in accordance with FAR clause 52.217-5, Evaluation of Options, July 1990, as prescribed in FAR 17.208( c ) (1).
(2) DESCRIPTION OF FACTORS AND SUBFACTORS.
Factor 1 – Technical Capability
Description of Factor: The government will evaluate the technical proposals based on an acceptable/unacceptable standard. Each technical proposal will be reviewed and a determination shall be made as to whether it is acceptable or unacceptable based on the evaluation criteria described herein. If a technical proposal is determined unacceptable, the offeror will be excluded from the competition and they will not progress to the next round of evaluations.
Subfactor (1): Duly ordained Roman Catholic Priest in good standing Description of Factor: This factor evaluates the offeror’s good standing with the bishop of his diocese or the superior of his religious order in the Catholic Church and must be endorsed by document in accordance with the Statement of Work (SOW).
Subfactor (2): Ecclesiastical Endorsement from the Archdiocese for the Military Services (AMS) Description of Factor: This factor evaluates the offeror’s ability to provide written proof of permission from his diocesan bishop or religious superior to enter into the services as a priest in accordance with the Statement of Work (SOW).
Factor 2 – Price
(i) This factor will evaluate the cost proposal to determine price analysis and price reasonableness of the proposed total evaluated price.
(ii) An offeror’s proposed price will be determined by multiplying the quantities identified in the Price Schedule by the proposed unit price for each contract line item number (CLIN) to confirm the extended amount for each CLIN. The base period and option years will be totaled to determine the overall estimated price to be evaluated. All responsible offers that conform to the solicitation requirements will be ranked according to price
(iii) Offerors are specifically advised that, under this evaluation method, the government may determine that an offer is unacceptable if the prices are unbalanced between initial and each option year. Prices are unbalanced if they are significantly overstated or understated in relation to the actual cost of the work. This may be ground for eliminating a proposal from competition either on the basis that the offeror does not understand the requirement or the offeror has made an unrealistic proposal. By signing its offer, the offeror certifies that each price stated on each CLIN includes an appropriate apportionment of all costs, direct and indirect, overhead, and profit. Review of the offeror price data will consist of an analysis to determine the following:
(A) Price Analysis. All cost and financial information required by the RFP and amendment (s) there to have been submitted. One or more of the following techniques may be used to perform price analysis.
(1) Comparison of proposed prices received in response to the solicitation.
(2) Comparison if prior proposed prices and contract prices with current proposed prices received for the same or similar end items.
(3) Comparison of proposed prices with Independent Government Estimates (IGE).
(B) Price Reasonableness. Each proposal will be evaluated to determine whether the government considers the proposed price to be reasonable. The government will evaluate price reasonableness in relation to commercial or IGCE, or any other information used as a basis for comparison.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
