C. To assure timely and equitable evaluation of quotes, offerors must follow the instructions contained herein.

Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify an exception to the solicitation terms and conditions and provide complete accompanying rationale. Quotes must be complete, self-sufficient and respond directly to the requirements of this solicitation. The response shall consist of two (2) separate parts; Part I – Price Proposal; Part II – Past and Present Performance Information.

D. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists, no additional cost information will be requested. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness an affordability of the price.

E. Specific Instructions:

1. PART I – PRICING – Submit original and one (1) copy

(a) Complete Blocks 12, 17a, 30a, 30b, and 30c of the Standard Form (SF) 1449. In doing so, the offeror accedes to the contract terms and conditions as written in the RFQ. The RFQ constitutes the model contract.

2. PART II – PAST AND PRESENT PERFORMANCE INFORMATION

(a) Offerors are required to submit past and present performance references on at least three (3) but no more than five (5) specific related contracts/work efforts that are very relevant and active within the last three (3) years and which demonstrate the ability of its current organization to perform the proposed effort. Contracts should be similar in size, scope and complexity as the work described in the RFQ and may include contracts with the federal government, state and local government agencies and commercial customers. Offerors shall send Past and Present Performance Questionnaires attached to the RFQ to their past and present performance references. The questionnaire recipient will email or fax the completed questionnaire DIRECTLY to the CONTRACTING POINT OF CONTACT listed in paragraph E, NO LATER THAN THE STATED CLOSING DATE OF THE RFQ. THE OFFEROR

IS TO PROVIDE ALONG WITH THEIR OFFER/QUOTE A LIST OF THE CONTRACTORS

PROVIDING A PAST AND PRESENT PERFORMANCE QUESTIONNAIRE. THIS LIST WILL

CONTAIN THE NAME OF THE CONTRACTOR, POINT OF CONTACT (POC) AND VALID PHONE

NUMBER. ASSURE THE CONTRACTOR UNDERSTANDS TO FAX THE COMPLETED

QUESTIONNAIRE DIRECTLY TO THE FAX NUMBER LOCATED IN PARAGRAPH d OF THE QUESTIONNAIRE. If you are aware that one or more of your references are in the Contractor Performance Assessment Reporting System (CPARS), please provide this information directly to the Government. The Government reserves the right to obtain information relative to present and past performance on its own, in addition to that provided by the offeror.

(b) Your quote will be evaluated in accordance with the criteria listed in FAR 52.212-2, Evaluation— Commercial Items (Jan 1999), paragraph (a). The evaluation of past and present performance information will take into account past and present performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition. The offeror whose quote represents the best value to the Government will be selected for award. It should be noted that there is no obligation on the part of the government to make an award to any offeror in response to this request. It is our intent to evaluate quotes and award without discussions; however, we reserve the right to hold discussions.

(c) Past and present performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past and present performance information to the prime contractor. Because a prime contractor is a private party, the government will need that consent before disclosing subcontractor/teaming partner performance information to the prime during exchanges. Failure to provide signed subcontract consent may delay evaluation of performance or could result in the information not being considered in the evaluation.

(d) Failure to provide accurate past and present performance information could delay review of your proposal and/or result in less than an optimal evaluation rating simply because information is unavailable.

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Past Performance

2. Price

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

ADDENDUM TO FAR 52.212-2

BASIS FOR CONTRACT AWARD: This is a competitive acquisition conducted using Simplified Acquisition Procedures in accordance with Federal Acquisition Regulation (FAR) Part 13.5, Test Program for Certain Commercial Items . Procedures outlined in FAR 13.106-2 will be used to evaluate offers. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

mailto:joseph.pasqualucci@us.af.mil

A. Price evaluation will consider the total of the base period and all options.

B. Using questionnaires, the Contracting Officer shall seek relevant performance information on offers as necessary based on (1) the past and present efforts provided by the offeror and (2) data independently obtained from other Government and commercial sources. Relevant performance includes performance of efforts involving ambulance services, which are similar or greater in scope, magnitude and complexity than the effort described in this RFQ. The Government reserves the right to seek information on higher priced offerors if none of the lower priced offerors receive an “Exceptional” performance assessment. The purpose of the past and present performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in the RFQ, based on the offeror’s demonstrated past and present performance. Past and present performance regarding predecessor companies, key personnel who have relevant experience or sub-contractors that will perform major or critical aspects of the requirement will be considered as highly as past and present performance information for the principal offeror.

C. Evaluation shall be based only on price and past performance, and the award determination shall be an assessment of the overall best value to the government, both factors considered. The government reserves the right to award to other than the lowest priced offer if it represents the best value to the government.

D. Offerors are cautioned to submit sufficient information in the format specified in the Addendum to FAR 52.212- 1, Instructions to Offerors—Commercial Items. Offerors may be asked to clarify certain aspects of their offer or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.

E. The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (DEC 2012)
