ADDENDUM TO 52.212-2, EVALUATION – COMMERCIAL ITEMS (NOV 2021)

The following is inserted as new paragraph (d) of the provision:

(d) BASIS FOR CONTRACT AWARD

This is a competitive 100% Small Business Set-Aside firm-fixed price best value acquisition conducted in accordance with Federal Acquisition Regulation (FAR) Parts 12 and 15 in which competing offerors’ combined past performance information and technical acceptability will be approximately equal to price.

By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. All technically acceptable offers will be treated equally except for their prices and performance records. Any proposal with an unacceptable Technical rating will not receive further evaluation. Failure to meet a requirement will result in an offer being determined unacceptable.

The Government reserves the right to award a contract to other than the lowest Total Evaluated Price (TEP), if the difference in the Past Performance Confidence Rating of another offeror justifies the higher price premium. In that event, the Source Selection Authority will make an integrated assessment best value award decision using the TEP and the Past Performance Confidence Rating. The evaluation process will include the following:

Factor 1 – Technical Evaluation

Factor 2 – Past Performance

Factor 3 – Price

All proposals will be ranked by total evaluated price (TEP). The Government shall then evaluate proposals for technical acceptability and past performance in order of their price rankings, lowest to highest. Evaluations will cease once a technically acceptable and a “Substantial Confidence” performance confidence assessment rating is identified, or all offerors have been evaluated (whichever occurs first). If the technical factor is rated Unacceptable, the overall rating is Unacceptable and the proposal will not be evaluated further. The Contracting Officer (CO) will then make a best value award decision which will include the offeror with a Substantial Confidence performance assessment rating (if found) and all technically acceptable offers with TEPs lower than the TEP of the offeror with the Substantial Confidence performance assessment rating. For example: five technically acceptable offers are received; the offerors with the first and second lowest TEP offers have performance assessment ratings less than Substantial Confidence, but the offeror with the third lowest TEP has a performance assessment rating of Substantial Confidence. The CO would make a best value award decision among those three offerors.

Factor 1 – Technical Evaluation. The Government will evaluate technical proposals on a pass/fail basis and assign an Acceptable or Unacceptable rating as described in Table 1 below. Proposals will be evaluated for technical acceptability. A rating of unacceptable in one or more technical subfactor will constitute an overall rating of Unacceptable for the technical evaluation. The offeror’s proposal shall, at a minimum, address each of the subfactors outlined below as they apply to the Performance Work Statement (PWS), in Attachment 1. The subfactors is met when the offeror shall provide evidence or demonstrates that they can complete all work stated in the PWS, and outlined in Proposal Preparation Instructions, PART 1-Technical Solution and subfactors. The evidence could be previous contracts with accompanying Statement of Work or Performance Work Statement, company website showing where the requested technical solution has been implemented, or any other means that will validate such evidence.

Simply rephrasing or restating the Government’s Technical Solution or requirements will not be accepted and will be given an Unacceptable rating. The Government will analyze the offeror’s Technical Proposal and will assign a rating of Acceptable or Unacceptable as described below in Table 1.

Table 1. Technical Acceptability Ratings, Defined

Rating Definition Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Factor 2 – Past Performance. The offeror shall provide evidence of least (1) one but no more than (3) three past performance reports within the past 3 years that is relevant to this requirement. The Government will evaluate the quality of the offeror’s past performance by analyzing past performance reports received and other past performance information data independently obtained from Government and/or commercial sources which may include, but not limited to: Contractor Performance Assessment Reporting System (CPARS), the Past Performance Information Retrieval System (PPIRS); Federal Awardee Performance and Integrity Information System (FAPIIS); or other databases.

Performance Confidence Assessment. The purpose of the past performance evaluation is to assess the degree of confidence the Government has in the offeror’s ability to meet the solicitation requirements based on the offeror’s demonstrated record of performance. The Government will combine the recency, relevancy and performance evaluations of all of the efforts considered for the offeror to assign a Performance Confidence Assessment of Substantial Confidence, Satisfactory Confidence, Neutral Confidence, Limited Confidence or No Confidence as described below in Table 2.

Table 2. Past Performance Confidence Assessment Ratings

Rating Description

Substantial Confidence

Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence

Based on the offeror’s recent/relevant performance record, the Government has an expectation that the offeror will successfully perform the required effort.

Neutral Confidence

No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can reasonably be assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence

Based on the offeror’s recent and relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent and relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Factor 3 - Price. The Government shall conduct a price evaluation of all offers. The Government will evaluate an offer by adding the total price for all CLINs. The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price. Evaluation of prices will determine if they are compatible with the scope of the effort, are not unbalanced and are neither excessive nor insufficient for the effort to be accomplished. It is expected that the competitive nature of this acquisition will drive price reasonableness and fairness; however, the Government reserves the right, if it deems appropriate, to make these determinations by means of one or more price analysis techniques.
