Solicitation FA330024Q00026 Questions to 42 CONS

1) REFERENCE Combined Synopsis and Solicitation, Page 3, Subfactor 1.1, the Government asks for FAA approved flight worthiness certificates for each aircraft to be used. It is best practice for certainty of execution to confirm that any aircraft offered to this solicitation has been actively flown in the last three months prior to contract award to ensure aircraft currency and safety of flight. Will the Government require this proof of flight currency to this solicitation to ensure safety of flight for the AFROTC Cadets who will be participating in this program?

RESPONSE: The Government will require proof of flight currency as described in Section III Quote Preparation, Part I (Technical), Subfactor S1.3. and subsequently in Section IV Basis For Award, Part I (Technical), Subfactor S1.3.

2) REFERENCE Combined Synopsis and Solicitation, Page 3 Subfactor 1.3, the Government asks that offerors provide a written statement verifying that all ejection seats for the aircraft to be used are active and operable. Will the Government also require proof of ejection seat currency to ensure safety of flight for the AFROTC Cadets who will be participating in this program? Currency items could include but are not limited to a) proof of non-expired life-limited ejection pyrotechnics; b) documented overhaul paperwork from a certified provider;

c) a documented FAA AIP program for ejection seats; and d) appropriately trained and certified maintainers, either via a certified third-party vendor and/or internal maintenance personnel trained by a certified training provider.

RESPONSE: The Government will require proof of ejection seat currency as described in Section III Quote Preparation, Part I (Technical), Subfactor S1.5. and subsequently in Section IV Basis For Award, Part I (Technical), Subfactor S1.5.

3) Will the government confirm that the offerors to this solicitation own the aircraft they are proposing? An Air Force commercial contract under FAR 12.6 and 13.5 as stated in solicitation FA330024Q00026 must comply with the FAA Federal Aviation Regulations. If any of the aircraft are leased and not owned, FAA regulatory provision 91.319(a) and (e) may apply and restrict the lessee from earning revenue from operating said aircraft. Will the Air Force comply with the additional FAA regulations governing the ownership of aircraft for this solicitation?

RESPONSE: The Government will not confirm that offerors own any aircraft provided to be used in the required services. Per PWS paragraph 4.3.2 Safety and Compliance, the Contractor is responsible for adhering to all FAA regulations.

4) As this is a 100% Small Business set-aside solicitation how will the Government ensure that

FAR 52.219-14 Limitation on Subcontracting is being complied with by all offerors prior to and after contract award?

RESPONSE: FAR 52.219-14 ‘Limitations on Subcontracting’ is included in FAR 52.212-5 ‘Contract Terms and Conditions Required To Implement Statutes or Executive Orders— Commercial Products and Commercial Services.’

5) Given the late notice of this solicitation, will the government entertain an operations start date later than 1 JUN 2024 for this program, to given time for mobilization of any Offeror to deploy aircraft for this requirement? If yes, what is the start date range that the Air Force is willing to accept?

RESPONSE: The Government has revised the operations start date (Period of Performance) to 06 June 24, but encourages offerors to mobilize their aircraft sooner if possible/practical.

6) As the Air Force is calling this solicitation Jet Introduction 3 (JETI) Program, is JETI an Air

Force Program of Record?

RESPONSE: Jet Introduction 3 (JETI-3) is not an Air Force Program of Record.
