I. Contracting Activity.

The Contracting Activity is Department of the Air Force, Air Education and Training Command (AETC), 42nd Contracting Squadron, Maxwell AFB, AL 36112- 6334. The Requiring Activity is Department of the Air Force, Air University/Holm Center, Maxwell AFB, AL 36112-6334.

II. Nature and/or description of the action being processed.

This sole source justification is being issued to allow for the single award of a new firm-fixed price Indefinite Delivery/ Indefinite Quantity (IDIQ) contract to Turning Technologies, LLC. using Simplified Procedures for Certain Commercial Items in accordance with FAR Part 13.5. Turning Technologies, LLC. physically located at 255 W. Federal Street, Youngstown, OH, 454503-1207; Cage Code: 31XY1; NAICS: 334118, Size Standard: 1,000 EMP; Socioeconomic Category:

Small Business.

III. Description of supplies/services required to meet agency needs.

of this acquisition is for the establishment of an IDIQ contract to allow for individual orders of the TuringPoint Cloud (TPC) systems, manufactured by Turning Technologies, LLC, as required by the Air Force Junior Reserve Officer Training Corp (AFJROTC) are currently in use to support more than 880 AFJROTC detachments, 1,900 instructors, and 125,000 students across the nation. These systems integrate with current AFJROTC curriculum and allow instructors to promote student interaction and to gauge lesson retention in real time. Each system

IV. Statutory authority permitting other than full and open competition.

This acquisition is being issued under the authority AFFARS 5313.501-10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The items under this justification are peculiar to one manufacturer, Turning Technologies, LLC. Turning Technologies is the sole distributor for TurningPoint branded hardware and software. The TPC systems (and older versions) are currently in use throughout the 880 AFJROTC detachments. The unique or specialized nature of this requirement is that AFJROTC Curriculum has been integrated with Turning Technologies' system software. This design links publisher-designed PowerPoint slides with interactive response system questions through a Turning Technologies designed instructional model known as the FIT Model. Over 3,000 questions (both teaching and test questions) have been written into the system software. Also, Turning Technologies hardware uses a proprietary centralized software management module known as Device Manger (DM) which brokers the communication between the hardware and the software.

Over the past six (6) years ,Turning Technologies brand products have been fully embraced by all four military services with JROTC programs. This requirement will allow for additional suites to be purchased in order to expand the use of the current systems within the JROTC program and allow for the replacement (refresh) older versions.

The Government has invested dollars on the Turning Technologies brand. This amount is based on the following contracts:

The current requirement has an estimated ceiling price of for one (1) base year and four (4) one year options. The total estimated value of this acquisition (including option years) is more than what has been previously invested in the system over the past six years. In addition, the time required to start working with a different student response system or digital chalkboard company would result in duplication of cost and effort not expected to be recouped through competition. It is imperative that all AFJROTC units be equipped with the same system to ensure continuity in the program and to take advantage of joint-developed course ware that has TPC integrated into its content.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

A Sources Sought Notice (SSN) was posted to the Federal Business Opportunity (FedBizOpps) website on 24 June 2019 with a response due date of 1 July 2019 to determine if any other vendors could provide the student clickers for JRTOC in accordance with the provided Statement of Requirements (SOR). One company (Turning Technologies, LLC) responded to the notice stating that they could fulfill the Government's requirement.

An Intent to Sole Source (ISS) notice was posted to FedBizOpps on 16 August 2019 with responses due by 22 August 2019. This notice yielded no additional responses from industry.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer has determined that the anticipated cost will be fair and reasonable. This is based on historical purchases for the same items. These historical purchases were determined to be fair and reasonable. It is anticipated that the prices proposed on the current procurement will be similar to previous purchases.

To ensure the final price is fair and reasonable, the Contracting Officer will use the price analysis techniques and procedures contemplated in FAR 13.106-3(a)(2). It is anticipated that the following specific techniques will be used:

1) Comparison of the proposed price with prices found reasonable on previous purchases (FAR 13.106-3(a)(2)(ii)). These products have been previously purchased for AFJROTC (see paragraph V above). This provides a useful baseline to compare the proposed prices with previous prices for the same items.

2) Current price lists, catalogs, or advertisements (FAR 13.106-3(a)(2)(iii)). These items meet the definition of a commercial item IAW FAR 2.101. The proposed prices can be compared to available price lists to help determine reasonableness.

3) Comparison to an independent Government estimate (FAR 13.106-3(a)(2)(vi)). A comparison of the proposed prices with the IGE can help determine price reasonableness.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Market research was conducted by the customer using a web search for various classroom interactive polling systems.

Although there are other available systems, none are compatible with the existing Turning Technologies' system that is required.

Additionally, an Intent to Sole Source and a Sources Sought Notice was posted to FedBizOpps, as described in Section VI above. These notices yielded no additional responses from industry.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

None.

X. List of any sources that expressed, in writing, an interest in the acquisition.

None.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

At this time, no other manufacturers' products can satisfy this requirement. Turning Technologies is the only manufacturer that offers a product compatible with the existing system. If AFJROTC contemplates a complete replacement (vs. a refresh) of the system in the future, then other classroom polling systems will be considered.
