The four key elements of VPP are management leadership and employee involvement, worksite hazard analysis, hazard prevention, and safety and health training.
VPP requires that contractors performing on Air Force installations provide their employees safety and health protection equal in quality to that provided to Air Force employees. However, the contractor will be responsible for managing their health and safety program.
Contractor injury rates shall be provided to the contracting officer annually or upon request. This information shall be provided to the contracting officer NLT 15 January each year. This information will include Total Case Incident Rate (TCIR) and Days Away, Restricted, Transferred (DART) cases at a minimum as referenced in OSHA 1904.7.
Contractors working on AF installations are not required to obtain VPP certification, however, they will be held to the higher safety and health of the AF installation. All contractors should become familiar with VPP, http://www.osha.gov/dcsp/vpp/index.html.

The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.

CLAUSES INCORPORATED BY FULL TEXT
52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (APR 2010)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-
(i) The Offeror and/or any of its Principals-
(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and
(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.; and
(D) Have ______, have not______, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;
head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
(End of provision)
52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
i.) Price ii.) Technical Capability iii.) Past Performance
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
Addendum to FAR 52.212-2:
BASIS FOR CONTRACT AWARD: This will be a competitive lowest price technicall acceptable (LPTA) source selection in accordance with FAR part 12 and FAR part 15 with the following facotrs:
Factor 1 – Price Factor 2 - Technical Capability Factor 3 – Past Performance
A. Initially offers shall be ranked according to price, including option prices. An offeror’s proposed prices will be determined by multiplying the quantities identified in the Pricing Schedule by the unit price for each item to confirm the extended amount for each.
B. This is a competitive lowest price technically acceptable source selection. No technically rated “Unacceptable” offers will be considered for award. The technical proposal will be rated as either “Acceptable” or “Unacceptable”.
In order for the technical proposal to be rated technically “Acceptable” it must be acceptable for all subfactors. Past performance will be determined as either “Acceptable” or “Unacceptable”. An offeror’s proposal must receive a rating of “Acceptable” for the technical proposal, as well as a rating of “Acceptable” for past performance in order to be considered for award. Offerors with no relevant and recent past performance same/similar to the RFP requirement will receive a rating of “Unknown.”
C. Proposals that are unrealistic in terms of the technical proposal or price may be rejected at any time during the evaluation process. The Government may determine a competitive range of offers and enter discussions with all offerors in the competitive range, if needed.
D. The Government shall select for award the lowest priced proposal rated technically “Acceptable” and “Acceptable” rating for past performance. To be rated “Acceptable” in past performance, the offeror must be determined to have postitive recent and relevent past performance The Government intends to award without discussions with respective offerors, but reserves the right to conduced discussions if deemed in its best interest.
E. EVALUATION FACTORS:
Factor 1 – Price Proposal
1. An offeror’s proposed prices will be determined by totaling the prices in the complete itemized price schedule. The extended amount must equal the total of associated items in the complete itemized price schedule for each proposed year of performance. The price evaluation will assess the reasonableness and affordability of the proposed total evaluated price. The Government may assess the realist of proposed pricing where an offeror’s total evaluated price is deemed too low and cannot realistically support successful performance for the entire performance period of the contract. The burden of credibility of price rests solely with the offeror. The following evaluation criteria shall apply:
(a) Price Realism: Proposed price will be evaluated to determine if it is unrealistically high or low in relation to the Government’s Independent Cost Estimate and the offeror’s technical/management approach.
(b) Reasonableness: The offeror’s proposal will be reviewed to determine if the proposed price is reasonable.
(c ) Completeness: Price Proposals will be evaluated to determine whether the offeror provided sufficient data as required by the solicitation and the Contracting Officer during the evaluation. Offerors must completely fill in the pricing in Section B CLINS as well as the Pricing Schedule.
(d) The lowest priced technically acceptable offer(s) whose price is determined to be realistic, reasonable and complete based on the above criteria will be determined the best value to the Government for award.
Factor 2 – Technical Capability
1. The technical area will be evaluated on an “Acceptable” or “Unacceptable” basis. If the proposal received is determined to be “Unacceptable”, the offeror may be excluded from competition, and they may not progrress to the next round of evaluations. Each proposal achieving an “Acceptable” rating will enter the third round of evaluations, which is past performance. If the Contracting Officer determines that discussions will be necessary, the Contracting Officer may include in the competitive range, offers with an initial unacceptable rating on any evaluation factor. During competitive range negotiations, the Government will engage in meaningful discussions regarding each offer with the intent to allow the offor to revise its offer to address and perceived weakness or deficienies.
2. The primary overall objectives to be considered involve the following questions:
(a) Will the warehouse afford proper protection to the property to be stored?
(i) The warehouse must have adequate protection from contamination, theft, fire, flood, rain, moisture, windstorm, or other hazards. The customer and Contracting Officer may request the advice and/or opinion of the law enforcement authority in determining the adequacy of a spearate storage location for firearms.
(ii) Storage methods such as proper stacking, ventilation, locator systems, and access for firefighting and inspection.
(b) Is the company capable of performing the required services properly?
3. Technical Subfactor Standards:
(a) The offeror shall provide proof of current Regional Storage Management Office (RSMO) certification and certification of contractor capacity. RSMO certification must remain current throughout the life of the contract.
The offeror shall provide information to demonstrate how its equipment, personnel, facilities, teaming arrangements, etc. will allow them to meet the stated minimum daily requirements as defined in the Defense Transportation Regulation (DTR), Part IV, Personal Property, Appendix D. The offeror must provide proof of current RSMO certification.
(i) Complete the following and return with proposal:
A. DD Form 1811 ―Pre-Award Survey of Contractor’s/Carrier’s Facilities and Equipment. This form must be certified by RSMO as described in paragraph a of this section. Include any supporting documentation that may be applicable to this form.
Inability to produce a certified 1811 will make the proposal technically unacceptable.
Additional inspections may be conducted by RSMO/TO when in the best interest of the Government and/or to ensure protection of DOD personal property in storage (DTR Part IV para D3).
B. FAR Clause 52.247-2 ―Permits, Authorities, or Franchises.
(ii) Offeror must provide a listing of all warehouse locations intended for storage. All facilities intended for storage of goods under the resultant contract shall be made available to the Government in this listing. The Government will review the certified DD1811 and supporting documentation of all warehouse locations intended for strorage in accordance with the attachment, Appendix D – Pre-award Survey Guidelines. Based upon the governments‘ review, grade-ratings of A, B, C, D, or E will be assigned to each offeror during the proposal evaluation process.
(b) Acceptability of Offeror’s information provided in FAR Clause 52.247-2 “Permits, Authorities, or Franchises.”
(c ) Adequacy of Quality Control Plan. The QC Plan will be evaluated based on how the offeror defines its organizational responsibilities, and procedures to ensure adequate performance of required services.
Factor 3 – Past Performance
1. The contracting officer shall seek relevant performance information based on (1) the references provided by the offeror using questionnaires and (2) data independently obtained from other government and commercial sources. The Past Performance evaluation results in an assessment of the offeror’s probability of meeting the solicitation requirements. Offerors must receive a past performance rating of “Acceptable” to be eligible for award.
(a) Ratings. The Past Performance factor will receive one of the ratings described below.
(b) Evaluation Process. The past performance evaluation considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the solicitation requirements. In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror’s Past Performance proposal volume and information obtained from other sources available to the Government, to include, but not limited to: the Past Performance Information Retrieval System (PPIRS); Federal Awardee Performance and Integrity Information System (FAPIIS); Electronic Subcontract Reporting System (eSRS), or other databases; and
TABLE 2- PAST PERFORMANCE EVALUATION RATINGS
Rating Description
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past…
