About this file
This document is a Questions and Answers (Q&A) file addressing five key inquiries regarding a small business set-aside supply acquisition for cleared unmanned aircraft systems under NAICS 336411. The acquisition involves foreign-manufactured Parrot ANAFI UKR drones, with the internal program designation "Bracer Forger Drones."
The Government clarifies that the Non-Manufacturer Rule is inapplicable to this acquisition because the estimated value falls at or below the Simplified Acquisition Threshold (SAT), and therefore no waiver is required. Regarding acceptable configurations, contractors should reference the updated Specifications document for clarification on whether the standard Parrot ANAFI UKR or ANAFI UKR GOV configuration applies and whether the XLR extended-range battery is required. Price reasonableness will be determined using historical award data and competitive market quotes received in response to the solicitation, rather than GSA Advantage pricing alone. Delivery is FOB Destination to 368 TRS, Building 1703, Fort Leonard Wood, Missouri 65473 (DoDAAC: F3V5F5), with standard commercial packaging and marking; no RFID or UID marking is required. Inspection and acceptance will occur at the receiving activity. Invoicing must be submitted electronically via the Wide Area WorkFlow (WAWF) system as a combined Invoice and Receiving Report document, with payment terms set at Net 30 days in accordance with the Prompt Payment Act.

1. Non-Manufacturer Rule. This is a small business set-aside supply acquisition under NAICS 336411 for a cleared unmanned aircraft system that is foreign-manufactured. Has the Government obtained a non-manufacturer rule waiver (individual or applicable SBA class waiver), or does the Government consider the non-manufacturer rule inapplicable to this acquisition?
Answer: The Non-Manufacturer Rule (NMR) is inapplicable to this acquisition. In accordance with RFO 19.104-3 and SBA regulations at 13 CFR 121.406(c), the Nonmanufacturer Rule clause (FAR 52.219-33) does not apply to standard small business set-aside acquisitions with an estimated value at or below the Simplified Acquisition Threshold (SAT). Therefore, an NMR waiver is not required.
2. Acceptable make/model. CLIN 0001 references "Bracer Forger Drones," while Attachment 2 (Specifications) corresponds to the Parrot ANAFI UKR family. Please confirm the acceptable configuration(s) — e.g., Parrot ANAFI UKR or ANAFI UKR GOV — and whether the XLR (extended-range) battery is required, so that all quotes are submitted on a common basis.
Answer: The Government clarifies the requirements as follows: "Bracer Forger Drones" is the internal program designation. Please see updated Specifications.
3. Pricing benchmark. The Parrot ANAFI UKR is listed on GSA Advantage. Will the Government treat GSA-listed pricing as the basis for price reasonableness?
Answer: Historical award data and competitive market quotes received in response to this solicitation will be used to determine price reasonableness
4. Delivery and acceptance. Please confirm delivery is FOB Destination to 368 TRS, Bldg 1703, Fort Leonard Wood, MO 65473, and identify any inspection/acceptance procedures or packaging and marking (e.g., RFID/UID) requirements.
Answer: Delivery is confirmed as FOB Destination to: 368 TRS, Bldg 1703, Fort Leonard Wood, MO 65473 (DoDAAC: F3V5F5). Inspection and acceptance will be performed by the receiving activity at destination. Standard commercial packaging and marking apply; there are no specific RFID or UID marking requirements for this order.
5. Invoicing and payment. Please confirm invoicing via WAWF and the Government's standard payment terms (e.g., Net 30).
Answer: Confirmed. Invoicing must be submitted electronically via the Wide Area WorkFlow (WAWF) system as a "Combo" document (Invoice and Receiving Report).
Government payment terms are Net 30 days in accordance with the Prompt Payment Act
