About this file
This is a Sole Source Justification document for a bridge contract to procure Municipal Solid Waste Management (MSWM) services for Joint Base San Antonio (JBSA). The 502d Contracting Squadron intends to award a one-time firm fixed-price contract to Perry Management of South Dakota LLC for a five-month period from 1 September 2025 to 31 January 2026. The contract covers solid waste collection and disposal services across multiple JBSA installations, including Lackland, Randolph, Fort Sam Houston, Camp Bullis, Canyon Lake military recreational areas, and Seguin Airfield.
The justification for sole source procurement stems from the need to avoid service interruption and minimize transition costs. The current contract is expiring, and the six-month extension option has been fully utilized. A Notice of Intent was posted on Sam.gov with zero responses, and the follow-on procurement is undergoing a source selection process that could take up to two years. The acquisition will use a 100% small business set-aside, with multiple small businesses having previously expressed interest in the requirement. The total estimated contract value is redacted, but the contract is being awarded to ensure continuous municipal solid waste management services without operational gaps.

I. Contracting Activity.
This document constitutes justification and approval for use of other than full and open competition for the acquisition described herein, under the authority of FAR 13.501(a). This acquisition is being issued by the 502d Contracting Squadron/JBKAA, on behalf of the 502d Civil Engineering Squadron, JBSA Lackland, TX.
II. Nature and/or description of the action being processed.
Based on the circumstances below, 502d CONS requests review and approval for other than full and open competition which authorizes and approves the procurement specific to one contractor, Perry Management of South Dakota LLC, herein referred to as Perry Management. The Government intends to award a one time firm fixed Bridge contract to avoid a gap in services and ensure uninterrupted operations. The contractor is identified as a small business under NAICS 562111 - Solid Waste Collection Services.
III. Description of supplies/services required to meet agency needs.
The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other items and services necessary to perform installation-wide Municipal Solid Waste (MSW) collection/disposal to include asbestos disposal service. Municipal Solid Waste collection services at JBSA installations include Lackland (LAK), LAK-Chapman Annex, Randolph (RND), Fort Sam Houston (FSH), Camp Bullis (CB), Canyon Lake military recreational areas and Seguin Airfield in accordance with all local, state, and federal laws, regulations, standards, instructions, commercial practices or international agreements.
The total estimated value of the acquisition is Period of performance: 1 September 2025 - 31 January 2026.
IV. Statutory authority permitting other than full and open competition.
10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901), as implemented by FAR 13.501(a)
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The municipal Solid Waste Management (MSWM) Refuse services at Joint Base San Antonio (JBSA) are currently provided by Perry Management under contract FA301620D0024. The estimated value of the follow-on procurement is as a Source Selection under FAR Part 15.3. The six-month extension under FAR Clause 52.217-8, Option to Extend Services, has been fully utilized. With the current contract expiring on 31 August 2025, there is insufficient time to award a new contract beforehand.
Given the essential nature of these services, any interruption would pose serious risks to health and overall quality of life at JBSA. Pursuing maximum competition or awarding to a different contractor would introduce additional costs by implementing a transitional period for the new contractor to mobilize equipment and personnel at both the beginning and end of the contract, thereby extending both the bridge PoP and the new award PoP, potentially leading to a service gap.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
In accordance with FAR Subpart 5.2, a Notice of Intent (NOI) to solicit and award a Sole Source Firm Fixed Price Bridge Contract to Perry Management with a period of performance of 01 September 2025 - 31 January 2026 was posted to Sam.gov on 7 July 2025. There were zero responses to the NOI. However, one contractor inquired on the status of the recompete.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
As the Contracting Officer I hereby determine that pricing will be fair and reasonable based on the proposal analysis techniques found in FAR 15.404-1(b).
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market research was conducted as part of the solicitation for the follow-on requirement.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
A significant factor contributing to using Other than Full and Open Competition is based upon the follow-on requirement as it is going through robust and meaningful discussions with offerors, as mandated by true source selection procedures.
The source selection process can take anywhere from a year to two years to complete. It is also important to note that the Source Selection Authority is a General that has not delegated authority down to the lowest level which contributes to the additional time it has taken to get specific documents approved. We are actively managing the remaining steps to minimize further delays.
X. List of any sources that expressed, in writing, an interest in the acquisition.
Zero responses were received in response to the Notice of Intent.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
A solicitation using a 100% small business set aside was used during the follow-on procurement's solicitation. Multiple small businesses provided interest in the procurement. This requirement will continue to be competed to the maximum extent practicable on all future follow-on contracts.
XII. Certification by the Contracting Officer.
As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
