I. Contracting Activity.

Organizational Activity: 341st TRS JBSA Lackland, TX 78236

Contracting Office: 502d CONS/JBKAA 1655 Selfridge Ave, Bldg 5450 JBSA Lackland, TX 78236

Request for Proposal Number: FA301618R0047

Project Name: Military Working Dog (MWD) Dog Food

II. Nature and/or description of the action being processed.

The anticipated acquisition will be a new Firm-Fixed Price Requirements contract between the Government and the awarded vendor supplying the specified brand name products for a period of one year.

III. Description of supplies/services required to meet agency needs.

The 341st TRS requires large quantities of Hill's Science Diet and Hill's Prescription Diet dog food. This food, manufactured by Hill's Pet Nutrition, is to be delivered on a recurring basis throughout the length of the contract. The contractor shall provide all necessary dog food within ten (10) calendar days of receiving an order to avoid the loss of dog food caused by spoilage and expired shelf life. Additionally, the contract shall ensure products sent reach the destination within three months of the product's manufactured date.

This requirement is for the sustainability of 750 to 1000 MWDs at any given time. The DoD MWD Program follows all policies stipulated in Army Regulation (AR) 40-905, Veterinary Health Services. Section 5-5a(2) of this regulation specifies that the U.S. Army Veterinary Service and the Director, DOD Military Working Dog Veterinary Service (DODMWDVS) shall determine the standard diet for the MWD Program. U.S. Army Veterinary Service and the Director, DODMWDVS have identified Hill's Science Diet dog food as an essential element to the MWD program, see attached letter from the DODMWDVS dated 9 February 2018.

Awarding a one (1) year contract would eliminate disruption in the availability of supplies which may create potential risks to the conformity of the MWD program and incur unduly costs for this anticipated and recurring requirement.

The type of appropriation for this acquisition is 3400.

The total estimated value of the acquisition is .

IV. Statutory authority permitting other than full and open competition.

AFFARS 5313.501 - 10 U.S.C. 2302b, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901)

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

Army Regulation (AR) 40-905, Veterinary Health Services, section 5-5a(2), precisely states MWDs are to be fed a standard diet which conforms to the specifications regarding metabolizable energy, digestibility, nutritional characteristics, and formulation, as determined by the U.S. Army Veterinary Service and the Director, DODMWDVS.

The Army tested the Hill's brand dog food in accordance with the the AAFCO standard, (https://petfood.aafco.org).

Part of their testing included weighing the animal's fecal matter to determine digestibility. When an animal's fecal matter weighed less in comparison to other formulas of food being tested, the evaluators could determine there was a higher nutritional absorption rate by the animal. The test results revealed that the Hill's brand had the highest absorption rates. Additionally, Hill's caloric content per serving was lower for the amount of nutrients absorbed compared to higher calorie brands that failed the absorbability test comparison. The evaluators determined that Hill's had a higher absorption rate and more efficient usage of calories.

Because of these test results, the Director, DODMWDVS has identified Hill's Science Diet and Prescription Diet , manufactured by Hill's Pet Nutrition, as the only veterinary rations authorized for MWDs. Dog food manufactured by Hill's Pet Nutrition conforms to the specifications required by AR 40-905. All MWDs within DoD must be fed a standardized diet. Medically, use of a standardized diet is essential. This standardized diet significantly reduces the incidence of gastrointestinal disorders, reduces the impact of stressors on performance and health, ensures more consistent weight maintenance and sustains high performance compared to feeding diets of unknown quality or consistency and compared to mixing products. The change in diet from Hill's Pet Nutrition dog food to an alternate brand will result in medical related maladies such as gastrointestinal ailments and disorders, performance health issues, obesity, liver failure, and kidney failure. Currently, the use of Hill's is standardized across the DoD. Changing the brand of food would not be conducive nor advantageous to the Government, as the diet is standardized from birth through their active service.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

a. Pet food recalls per the Animal Health Foundation was referenced and there were no food recalls for Science Diet nor Hill Country dog food.

b. A search on GSA Advantage using the terms "dog food" and "hill country" indicated that no product matches were

c. The Fedmall.gov from DLA site was researched. It was determined that only the 50 lb bags are available on FedMall

(NSN 8710-01-415-6950)

d. A sources Sought was posted on the federal business opportunities (FBO) website from April 4, 2018 through April 10, 2018. Interest was not shown in providing an alternative brand name.

e. A synopsis was posted on FBO on 01 June , 2018. The resulting solicitation and J&A will be posted on FBO.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The anticipated cost will be determined fair and reasonable based on price analysis to include comparison with prices obtained through competition, market research, and comparison with the independent government cost estimate.

Furthermore, various price analysis techniques as described in FAR 15.404-1(b), Proposal Analysis Techniques, will be utilized to determine the prices fair and reasonable. If this information is insufficient to determine the price fair and reasonable, FAR 15.402(a)(2) allows the Contracting Officer to obtain data other than certified cost or pricing data as necessary to establish a fair and reasonable price.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

Research conducted through Small Business Administration dynamic search on 02 April 2018 resulted in a list of possible sources under NAICS 311111 for Dog and Cat Food Manufacturing. Sources were contacted via email and inquiring of the possibility of a brand name purchase; one of five sources contacted confirmed brand name availability.

Additionally, research conducted via the internet indicated product is available through retailers such as PetCo, PetsMart, and Petsbarn, concluding that Hill's Pet Nutrition products are readily available in the commercial market.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Hill's Science Diet is currently the only dog food available from DLA on Fedmall.gov. However, the 50 lb bags that are available from Fedmall.gov capture the shipping costs and any additional fees associated with distribution by DLA.

The rate of use in the 341st's program is higher than an active duty kennel. Purchasing dog food on Fedmall.gov would be more costly for the government . Additionally, Fedmall.gov provides kennels CONUS and OCONUS the ability to purchase smaller quantities of dog food and assist in distribution worldwide.

X. List of any sources that expressed, in writing, an interest in the acquisition.

See Section VI above.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The 341 TRS will monitor any future guidance the U.S. Army Veterinary Service and the Director, DODMWDVS, provides regarding the use of additional brand name MWD rations and comply accordingly. As stated in the J&A for the current contract, which was approved on 4 February 2013, research shall continue to be conducted to find potential alternate sources that are able to fulfill the nutritional requirements for the MWD program. Since the approval of the previous J&A, the requirements cited in paragraph five (V) have not changed. Moving forward, the Government will continue to monitor policy changes in the Department of Defense Veterinary Services.

The planned award date for this new requirement is 1 October 2018.
