I. Contracting Activity.
Justification for Other Than Full and Open Competition 81st Contracting Squadron / LGCB (AETC) Keesler AFB, Biloxi, MS
II. Nature and/or description of the action being processed.
This action will be accomplished by issuing a firm fixed price contract to Valor Network Inc., 7 Hemptor Road, New York, NY 10956. The estimated total cost is for a 12- month base period and four (4) 12-month option periods. Below depicts the estimated quantity of items being acquired. Quantities are based on historical data/yearly averages.
III. Description of supplies/services required to meet agency needs.
The 81 MDTS requests sole source procurement from Valor Network Inc. to provide interpretations and reports on diagnostic images performed at Keesler Medical Center and sent via electronic transfer to Valor Network. The 81 MDTS Radiology Department has the technician manning, patient orders, and radiology equipment to perform a number of exams/diagnostic imaging studies each duty day.
Due to the shortage of providers, the volume routinely exceeds the capability of the radiologists to interpret and report within the DoD required time frames per study. Outsourcing the demanded overflow will enhance the ability for physicians to appropriately treat the patient in a timely manner.
Valor Network Inc. has the equipment capability and USAF authorization to electronically extract these radiological diagnostic imaging studies, the MS licensed physician staff to interpret and report on the radiologic diagnostic imaging studies/exams, as well as the ability to place the reports into the DoD Composite Healthcare Computer System (CHCS). Access to CHCS allows Valor to input data in patient’s medical record in the same manner the Keesler radiologists would so that the ordering physician gets the results; maintaining continuity of care and patient reporting. Valor Network Inc. is the only USAF vendor with this authorization and capability to seamlessly interface with the patient electronic medical record (CHCS), reference paragraph V below for more information on CHCS/ DIACAP/RMF approvals.
Interpretation types: X-Ray (digital plain radiographs) 5,210; Computed Tomography (CT) 3,200;
Magnetic Resonance Imaging (MRI) 50; Ultrasound 1,050; and Nuclear Medicine 20.
IV. Statutory authority permitting other than full and open competition.
10 USC 2304(c)(1) as implemented by FAR 6.302-1 Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
Valor Network Inc. is the only company that can provide this service. While there may be many other companies capable of satisfying teleradiology services, Valor Network Inc. is the only vendor granted access by the Air Force Surgeon General's Office to the USAF electronic patient medical record system (CHCS) with Department of Defense Information Assurance Certification and Accreditation
March 2018 FOR OFFICIAL USE ONLY Page 4 of 5
Process (DIACAP) approval with the USAF. In order to reliably provide services to produce urgent and routine reports within required time-frame, remote connectivity must be established. Without approval and access to CHCS and DIACAP, the vendor will not be able to remotely connect through the Air Force's Network firewall to interpret and report on the patient's medical records. No other vendors have received USAF authorizations from the Air Force Surgeon General to electronically interface with CHCS for the purpose of interpreting and reporting on radiologic diagnostic images/ exams.
Accordingly, Valor Network Inc. is the only firm capable of providing the services described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirements.
The Air Force Surgeon General's Office estimated that obtaining the appropriate CHCS and DIACAP or RMF authorizations required to perform this contract could take 12-18 months. The impact this delay would have on the patients could lead to further medical complications in the future by not receiving prompt radiological diagnostic interpretations. Awarding to any other source would result in substantial unacceptable delay. In addition all providers must be licensed in the state of Mississippi, the licensing process historically takes 6-8 months.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
This acquisition requires a synopsis in accordance with FAR 5.201.
A Sources Sought was issued on 12 March 19; number KAFBTeleradiology20; titled: Teleradiology Services. The sources sought closed on 20 March 19 with two responses received.
Response were received from VetMed Group LLC., and Warrior Medical Supply Company.
Neither VetMed Group LLC nor Warrior Medical Supply Company provided documentation of an approved Department of Defense Information Assurance Certification and Accreditation Process (DIACAP) or Risk Management Framework (RMF) approval with the USAF. While VetMed Group LLC stated they were ready they did not provide proof they were approved and capable of providing the service at the beginning of the Period of Performance. VetMed Group LLC also stated they had Radiologists ready to perform the service but did not provide documentation of the required Mississippi state license.
Previous acquisition was a sole source award. Contract FA301016C0006.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The estimated cost for this acquisition is anticipated to fair and reasonable. Price analysis will be utilized in accordance with FAR 15.404-1 comparing prior purchases for the same and similar items in order to ensure a fair and reasonable price is negotiated.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by posting a sources sought synopsis of the proposed acquisition, advising industry of the pending
March 2018 FOR OFFICIAL USE ONLY Page 5 of 5 acquisition and soliciting inquiries from interested parties.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
N/A
X. List of any sources that expressed, in writing, an interest in the acquisition.
See block VI above.
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Due to the unique capability and authorization required by the USAF and lengthy process to acquire approval for connecting to the Air Force network systems, the best way forward to promote competition is to provide the companies that responded to the sources sought the information required to complete the RMF process. Our intent is to provide them with the information to complete RMF process at approximately the end of year three. This will allow sufficient time for contractors to complete the lengthy process which will further promote competition.
