SECTION I DESCRIPTION OF PROPOSED ACTION

PURPOSE AND NEED FOR ACTION- Fencing of B1994 play area is beginning to fail as a result of underlying retaining wall settling and cracking. Replacement of the retaining wall and fencing is necessary in order to provide a safe a secure location.

DESCRIPTION OF PROPOSED ACTION AND ALTERNATIVES –Preferred Alternative: Repair (Replace) Fence and retaining wall surrounding playground at Building 1994.

No Action Alternative: Allow fence and retaining wall to continue to fail. Close playground. This would not be sustainable and would not meet Child Development Center requirements to provide a safe and secure outdoor play area.

SECTION II PRELIMINARY ENVIRONMENTAL SURVEY

7. AIR INSTALLATION COMPATIBLE USE ZONE/LAND USE - This action does not affect airfield operations or airfield zones and therefore there would be no impacts to Air Installation Compatible Use Zone/Land Use.

8. AIR QUALITY- The proposed action will occur in an area that is in attainment for all criteria pollutants and no conformity determination under the Clean Air Act is required. Reference:

9. WATER RESOURCES- The proposed action does not include alterations to either potable drinking water systems, sanitary sewer systems, or storm water systems, therefore there would be no impact to water resources.

10. SAFETY AND OCCUPATIONAL HEALTH- The proposed action would not result in impacts to safety or occupation-health.

11. HAZARDOUS MATERIALS/WASTE- The disposal of any hazardous wastes or state regulated wastes generated during the requested work must be coordinated with the environmental office. No hazardous waste manifests can be signed by the contractor or any of their subcontractors. All hazardous waste manifests must be signed by a government representative of the environmental office.

Requirements for transporters of Hazardous Waste include (in accordance with 40 CFR 263):

• Hanscom AFB’s EPA Identification Number

• Compliance with the manifest system

• Appropriate response to hazardous waste discharges

• Compliance with all applicable DOT regulations (IAW 49 CFR Part 171-179)

• DOT Transportation number

• Some states may have additional requirements for transporters. It is the contractor’s responsibility to be familiar with the requirements of each State through which the waste is transported. Each contractor must also hold current State Hazardous Materials Transportation Permits.

Requirements for generating a Hazardous Waste Profile: All hazardous wastes generated at Hanscom Air Force Base must be accompanied with a Hazardous Waste Profile. The information necessary to complete the profile sheet will come from generator knowledge and from waste analysis. The laboratory

RCS 17-271-01, Page 3 of 13 conducting the analysis typically provides the sample analysis request form with a chain-of-custody. The laboratory portion of the form is then completed by laboratory personnel and includes the name of the person receiving the sample, laboratory sample number, date and time of sample receipt, sample allocation, and analysis to be performed.

Construction & Demolition (C&D) Debris: The amount of Construction & Demotion (C&D) Debris disposed/recycled in relation to the proposed work also must be provided to the Environmental Office. At a minimum, the quantity (CY or Tons) of C&D debris and the address of disposal site must be provided.

Reporting this information will help Hanscom demonstrate compliance with state and Air Force recycling goals.

12. BIOLOGICAL RESOURCES- This action will occur within a developed area of the base however the facility foot print lies within the 200-foot riverfront area. This is an area regulated under the Wetland Protection Act. Normally, such a project would require filing of a Request For Determination of Applicability with the Bedford, MA Conservation Commission. On November 15, 2017, the Hanscom Natural Resources Manager (Mr. Scott Sheehan) met with the Lincoln Conservation Agent (Mr. Tom Gumbart). The Town of Lincoln Conservation Department allowed this project to proceed without a formal filing, so long as the attached conditions (Exhibit 1) are followed. The USAF will ensure that these requirements are incorporated into any scope of work and that inspectors validate compliance on a weekly basis. By adhering to the guidelines in Exhibit 1, and federal, state, and Air Force regulations no impacts to wetland and river resources would be expected as a result of the Proposed Action.

Concerning threatened and endangered species’ requirements, they must be considered for any proposed actions. As of April 1, 2015, the Northern Long- Eared Bat (NLEB) was listed as threatened under the Endangered Species Act (ESA). Hanscom AFB is located within a county confirmed for white-nose syndrome (WNS) which is a preferred habitat of NLEB. The removal of any tree requires coordination with the Environmental Office and will likely be prohibited without a permit. Any proposed removal must be coordinated with the environmental office. The Proposed Action does not include any tree removal and therefore would not impact biological resources.

13. CULTURAL RESOURCES- Building 1994 was surveyed and evaluated for National Register eligibility in June 2003 by the Public Archeology Laboratory (PAL). This evaluation, sent to the Massachusetts Historical Commission (MHC), determined that Building 1994 is not eligible for listing on the National Register. This assessment is on file with the MHC and no further coordination is necessary.

An archaeological survey of Hanscom AFB was completed in 1992, however, the Proposed Action’s area of potential effect is limited to work in previously disturbed areas. The Proposed Action would not affect significant historic or archaeological assets. The proposed action would not impact cultural resources.

14. GEOLOGY AND SOILS- The Proposed Action would not affect geology and soils because the action is on previously disturbed land.

15. SOCIOECONOMIC- The proposed action would not result in significant positive or negative a socioeconomic impact.

16. OTHER- All provisions of the Hanscom AFB Contractor Environmental Guide shall be followed to ensure compliance. A copy may be obtained from the Contracting Officer and/or Environmental Office.

HANSCOM AFB PROJECT –

BLDG 1994 REPAIR (REPLACE) FENCE AND RETAINING WALL

NOVEMBER 15, 2017

1. It is to be noted that Hanscom AFB has requested approval to proceed with project without filing a Notice of Intent or Request for Determination. These guidelines are to be enacted to demonstrate Hanscom AFB’s commitment to compliance with the Wetlands Protection Act MGL Chapter 131, Section 40, the Wetlands Regulations 310 CMR 10.00. These guidelines have not been considered by the Lincoln Conservation Commission and does not have the effect of law, rather represents a commitment to implementing prudent measures to protect wetlands and surface waters. It is the opinion of the parties that the project will have no effect on hydrologic conditions of the site and only temporary impacts foreseeable. Therefore Hanscom AFB agrees to adhere to these conditions. In the event that Hanscom AFB fails to meet these conditions, this Administrative Order shall become null and void and Hanscom AFB shall immediately cease work and file a Notice of Intent with the Town of Lincoln.

2. With respect to these provisions, Hanscom AFB Natural Resources Manager is designated as Agent with powers to act in administering and enforcing these requirements.

3. All work shall be performed in accordance with this Exhibit and approved site plan(s) which shall be submitted to Agent (identified below) no later than 7 calendar days prior to construction. Site plan shall include provisions for a contiguous sediment barrier consisting of at least two rows of hay bales, stake as necessary, with one foot separation between the rows, and a silt fence between the construction area and the riverfront. The site plan shall restrict all activity to no further than 8 feet to the east of the existing structure(s). Beyond this area is a no touch zone, which includes traversing of personnel and equipment. Attached maps show areas that are restricted as a no-touch zone.

4. No alteration of wetland resource areas or associated buffer zones shall occur on property without prior approval from the Lincoln Conservation Commission (aka. Commission) through the filing of a Notice of Intent and a public hearing.

5. The Agent, and his/her officers or employees shall have the right to enter and inspect the property at any time for compliance with the conditions of this Exhibit, the Wetlands Protection Act MGL Chapter 131, Section 40, the Wetlands Regulations 310 CMR 10.00, and shall have the right to require any data or documentation that it deems necessary for that evaluation.

6. It is the responsibility of the Hanscom AFB Contractor to procure all other applicable federal, state and local permits and approvals associated with this project.

7. All work shall be performed so as to ensure that there will be no sedimentation into wetlands, rivers, and surface waters during construction or after completion of the project.

8. If there are conflicting conditions within this Exhibit, the stricter condition(s) shall rule.

9. The Agent shall have the discretion to direct modifications the erosion/siltation control methods and boundary during construction if necessary.

10. The Agent reserves the right to impose additional conditions on portions of this project or this site to mitigate any actual or potential impacts resulting from the work herein permitted.

11. The work shall conform to the plans reviewed by the Agent and the following conditions:

PRIOR TO CONSTRUCTION

12. Prior to the commencement of any activity on this site other than activities listed above, there must be a Pre-Construction Meeting on site between the project supervisor, the contractor responsible for the work, and the Agent to ensure that the requirements of this Exhibit are understood. Please contact the Agent at (781) 225-6144 at least forty-eight (48) hours prior to construction to arrange for the Pre-Construction Meeting.

13. Prior to the pre-construction meeting and commencement of any other activity on this site, sedimentation and erosion control barriers shall be installed as shown on the plan(s) submitted to the Agent for review as described above. The Agent shall inspect and approve such installation at the pre-construction meeting.

14. No clearing of vegetation, including trees, or disturbance of soil shall occur prior to the pre-construction meeting. If any disturbance of shrubs and herbaceous plants is necessary in order to place erosion control measures, Agent shall be contacted and shall have the authority to make decision with respect to any such removal.

15. There shall be at least twenty (20) hay bales and wooden stakes stored under cover on the site to be used for emergency erosion control purposes.

16. All nearby drainage structures and inlets shall be protected by silt fence, haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system.

EROSION CONTROL

17. Appropriate erosion control devices shall be in place prior to the beginning of any phase of construction, and shall be maintained during construction in any wetland resource area, reiverfornt zone, and/or buffer zones. The erosion control measures shown on approved plan(s) and provisions in the Exhibit will be the minimum standards for this project; the Agent may require additional measures.

18. All debris, fill and excavated material shall be stockpiled a location far enough away from the wetland resource areas to prevent sediment from entering wetland resource areas.

19. Erosion and sedimentation control devices shall be inspected weekly and within 24 hours after each storm event and repaired or replaced as necessary. Any accumulated silt adjacent to the barriers shall be removed. Written weekly inspection documents shall be submitted to the Agent by 1500 hours (3:00PM local time) each Friday.

20. The area of construction shall remain in a stable condition at the close of each construction day.

21. Any de-watering of trenches or other excavation required during construction shall be conducted so as to prevent siltation of wetland resource areas. All discharge from de-watering activities shall be filtered through hay bale sediment traps, silt filter bags or other means approved by Agent.

22. Within thirty (30) days of completion of construction on any given portion of the project, all disturbed areas in the completed portion of the site shall be permanently stabilized with rapidly growing vegetative cover, using sufficient top soil to assure long-term stabilization of disturbed areas.

23. If soils are to be disturbed for longer that two (2) months, a temporary cover of rye or other grass should be established to prevent erosion and sedimentation. If the season is not appropriate for plant growth, exposed surface shall be stabilized by other appropriate erosion control measures, firmly anchored, to prevent soils from being washed by rain or flooding.

DURING CONSTRUCTION

24. A copy of this Exhibit and the plan(s) approved shall be available on site at all times when work is in progress.

25. No alteration or activity shall occur beyond the limit of work as defined by the siltation barriers shown on the approved plan(s). Agent shall have authority to stop work at any time to enforce the provisions of this Exhibit and require actions be taken to preserve wetland resources.

26. All waste products, grubbed stumps, slash; construction materials, etc. shall be deposited at least 100 feet from wetland resource areas.

27. Cement trucks or other vehicles or equipment shall not be washed out in any wetland resource or buffer zone area, nor into any drainage system. Any deposit of cement or concrete products into a buffer zone or wetland resource area shall be immediately removed.

28. All exposed sub-soils shall be covered by a minimum of three (3) inches of quality screened loam topsoil prior to seeding and final stabilization.

29. All nearby drainage structure inlets shall be protected by silt fence, haybale barriers and/or silt bags to filter silt from stormwater before it enters the drainage system. These shall be inspected at least once per week and within 24 hours after every rainfall, and maintained and replaced as necessary (reference paragraph 19).

30. There shall be no pumping of water from wetland resource areas.

31. All equipment shall be inspected regularly for leaks. Any leaking hydraulic lines, cylinders or any other components shall be fixed immediately.

32. During construction, all drainage structures shall be inspected regularly and cleaned as necessary.

33. The Contractor is hereby notified that failure to comply with all requirements herein may result in the issuance of enforcement actions including, but not limited to, civil administrative penalties under M.G.L Chapter 21A, section 16.

AFTER CONSTRUCTION

34. Upon completion of construction and final soil stabilization, the applicant shall submit an "As-Built" plan showing post-construction conditions within all areas under the jurisdiction of the Massachusetts Wetlands Protection Act to the Agent.

35. Erosion control devices shall remain in place and properly functioning until all exposed soils have been stabilized with final vegetative cover and the Agent has authorized their removal.

36. Revegetation shall be monitored for two years and shall achieve a 70% or greater ground cover within two years. Failure to meet this standard will result in additional time being added to the two-year warranty period for restoration.
