PERFORMANCE WORK

STATEMENT

FOR

SNOW REMOVAL AND SUMMER

GROUNDS MAINTENANCE AT

FOURTH CLIFF RECREATION AREA

PREPARED BY:

1. DESCRIPTION OF SERVICES:

1.1 Scope: The contractor shall provide all labor, tools, equipment, hoses, gauges, test equipment, hearing protection, eye protection including prescription safety glasses, materials, supplies and parts, transportation and other incidentals necessary to perform all operations in connection with winter snow removal and summer grounds maintenance at Fourth Cliff Rec-reation Area, a facility consisting of approximately 6.5 acres in Humarock, MA. The contrac-tor shall be responsible for insuring all services and parts provided under this contract are in accordance with the terms and conditions outlined herein and conform to the manufacturer’s equipment specifications and this Performance Work Statement (PWS). Contractor shall be licensed within the state of Massachusetts, as required, and shall perform work to comply with all applicable local, state, and federal codes, standards, and Manufacturer’s instructions.

Most stringent of nationally recognized or local codes will apply.

1.2. Scope - Winter: Contractor to provide snow/ ice removal and sand / salt application at the Fourth Cliff Recreational Area at Humarock, MA on the designated paved areas shown on the attachment #2. Performance is to be conducted in such a way that the facility is able to remain open and operational and that all personnel may traverse roads and sidewalks safely.

The Contractor will provide snow removal for every one to three inches of snow accumula-tion during the period outlined in section 1.4.9 below. In no case shall accumulation exceed three inches. At no time shall ice accumulate.

1.2.1. Provide supervision and quality inspection on site at all times during performance.

1.2.2. Contractor shall provide the supervisor’s phone numbers to call for assistance 24 hours a day. Numbers shall be provided to both Civil Engineering Contracting officer Representa-tive and the Fourth Cliff Site Manager.

1.2.3. Contractor shall verify all measurements (types and quantities of materials required and areas to be serviced).

1.2.4. Each plow event must cover the ENTIRE width of the pavement excluding individual housing units or trailer house driveways and must ensure community mailbox areas are entire-ly open and free for US Postal Service employees and residents. No snow will be stockpiled and banked so that it blocks existing roadways and/or building entrances.

1.2.5. Snow removal and/or ice alleviation services will begin when there is accumulation of one inch or greater of snow or ice has formed on any surface. Contractor is responsible for removing any sand accumulation.

1.2.6. Ice shall be treated to provide secure footing by snow removal operations with a sand/salt mixture. Sand shall be removed and disposed of as necessary to prevent accumula-tion.

1.2.7. Contractor to turn in a invoice of work performed which will be submitted to the Civil Engineering Government Representative after each snow event.

1.2.8. Contractor warrants that all work will be performed in accordance with the standards of care and diligence normally practiced by recognized firms in performing work of a similar nature. Contractor further represents and warrants that they have the knowledge, information, and skills to perform the work in compliance with all laws, rules, and regulations, including, but not limited to, those pertaining to health and safety, industrial hygiene, environmental conditions, or hazardous substances. Equipment shall be in appropriate safe working order and shall not leak excessive amounts of oils, fluids, or glycol. Contractor is responsible for environmental cleanup of all spills of fluid leaks caused by their equipment.

1.2.9 SUBMITTALS: All identified/required submittals will be submitted to the Contracting Office. Submittals will consist of:

1.Certificate of Insurance.

2. Site-specific Quality Control Plan.

3. Site-specific Safety Plan.

4. Subcontractor Points of Contact.

5. Plan with requested snow storage areas.

6. Landscape Maintenance Plan.

7. Seed Mix for approval.

1.3 SCOPE – Growing Season: Contractor to provide landscape services at the Forth Cliff Recreation Area at Humarock, MA. The area consists of improved grounds and tree-line areas as shown on the map in Attachment #1. The contractor shall submit a Landscape Maintenance Plan to ensure healthy, disease-free, well-manicured landscape. The plan shall be submitted within 30 days after the Contract award.

1.3.1. Seed Mix: The preferred seed mixture for the installation is 39.31% Perennial Rye Grass, 29.44% Crossbow Creeping Red Fescue, 28.45% VNS Kentucky Bluegrass, 0.37% Other matter, 2.42% inert matter, .01% weed seed.

1.3.2. Improved Grounds: Improved grounds shall be indicated on the attached map. Proper mower height of cut, sharp blades, and low moisture content are the main requisites for a suc-cessful mowing operation. No more than one-third of the grass will be removed in any one mowing operation. Improved grounds shall maintain a grass height between 2” and 4”. Grass clippings shall be removed as resources permit. Vegetation shall be removed from all cracks and joints in pavements. Grass and weeds shall be trimmed around shrubs, trees, buildings, fences, poles, posts, fire hydrants, boulders, and other fixed objects. The trimmed height shall be the same as the grass height. Provide as part of the Landscape Maintenance Plan, an annual schedule to perform an effective fertilizer and lime application program for all improved grounds. The contractor shall apply fertilizer and other soil amendments to bring soil condi-tion to that suitable for the vegetation being treated. Eliminate pests as needed. Ensure fallen leaves are removed and composted.

1.3.3. Tree Line Cleanup: Tree cleanup areas are indicated on the Grounds Maintenance Plan. These areas will be kept free of trash.

1.3.4. Drainage Ditches: The Contractor shall maintain surface drainage ditches to be free of shrubs, trees, silt, and trash to prevent erosion and ensure continuous flow of water.

1.4. Issue to proceed: After contract award, the Contracting Officer Representative will give the Contractor permission to start work Notice to proceed [NTP]. Contractor may be required to attend a scheduled meeting.

1.5. Notification of commencement: Contractor shall notify Contracting Officer Representa-tive before commencement of work. Contractor will coordinate access to the site with the Site Customer Coordinator POC, Mr. Dale Minnis.

1.6. Mishap Reporting: In performing work under this contract on a Government installa-tion, the contractor shall report any accidents involving Air Force property/equipment dam-age, or contractor personnel injuries occurring on the job or an accident resulting in death, in-jury, occupational disease, or adverse environmental impact to the contracting officer within five days.

1.7. Quality Assurance: According to the contract’s inspection clause, the government will evaluate the contractor’s performance under this contract. The COR is a representative of the Contracting Officer (CO) and will participate in the administration of this contract. Any mat-ter concerning a change to the scope, prices, terms or conditions of this contract shall be re-ferred to the CO. All services to be performed by the contractor will be subject to review by the CO or COR. The contractor shall provide an answer to a submitted Corrective Action Re-port (CAR) and Customer Complaint Form from the COR within one (1) working day from receipt. The contractor shall provide written response addressing the root cause, corrective action and preventive actions (s).

1.8. Safety: Contractor is solely responsible for maintaining a work site and project execution in compliance with the Occupational and Safety and Health Administration (OSHA) Regula-tions (Public Law 91-586) and the resulting standards, OSHA Standard 29 CFR 1910, 1926, and the protection of their employees. The Contractor shall be responsible for the safe conduct of all craftsmen, laborers, and subcontractors. It is the Contractor’s sole responsibility to make certain that all safety requirements are met. Additionally, the Contractor is responsible for the safety and health of all Subcontractor employees. Department of Labor, OSHA inspectors are authorized right of entry to inspect any place of employment operated by an Air Force Contractor or Subcontractor. They are, for the most part, “NO NOTICE” inspections. NOTE:

Notify the Civil Engineering Government Representative if an OSHA inspector visits your site.

1.9. Hazardous Materials: The contractor will comply with the Hanscom AFB. Hazardous Materials Operation Plan provided. It is the responsibility of the Contractor to declare any hazardous material/substance, which the Contractor will use or store on site. A Hazardous Materials Report, available from the Civil Engineering Government Representative shall be submitted for each chemical used or stored, and a Hazardous Material Safety Data Sheet must accompany each Contractor Hazardous Material Report. This must be accomplished fifteen

(15) days prior to bringing the material on site to ensure the Contractor is granted approval and authorization for each hazardous material. Contractors are prohibited from using any Class 1 Ozone Depleting Substances. The Civil Engineering Government Representative should be notified if the need arises during the performance period to use or store any hazard-ous materials not yet declared.

1.10. Hazardous Waste: Any hazardous waste generated by the Contractor is the sole re-sponsibility of the Contractor for proper management and disposal. This material must be properly labeled, stored, transported, and disposed of in accordance with the latest Environ-mental Protection Agency and Department of Environmental Protection rules and regulations.

1.11. Clean up: The Contractor shall be responsible for daily clean up of the work site, more often as necessary to maintain a clean and safe working environment. Before completion of work each day, the Contractor shall secure all supplies, materials, and equipment. Contractor shall also remove all scrap, debris, etc. and dispose off site, unless otherwise directed else-where in this work statement and leave the job site in a clean and safe manner.

1.12. Spills: Upon occurrence of any spills that could enter the storm system or cause any harmful environment effects, the contractor shall immediately call 911 to report the incident.

When possible, the contractor shall use a base telephone to receive help from Hanscom AFB

911. If using a cell phone, request Hanscom AFB 911. The contractor shall report all envi-ronmental violations to the COR. The contractor shall submit a typed or written report about the incident within four (4) clock hours. The contractor shall provide five (5) copies of the written report. The contractor shall provide one copy to the CO, two copies to the COR, a copy for Unit Environment Coordinator (UEC) and a copy for record. The format of the re-port shall be left up to the contractor, but the report shall contain the following information.

1.) Name and contact number of person reporting the spill 2.) Date and time of incident 3.) Location and source of spill 4.) Substance or pollutant spilled 5.) Amount spilled and the rate of discharge 6.) Any damages or injuries involved 7.) Extent of the area impacted 8.) Potential hazards 9.) Action taken 10.) Organizations contacted 11.) Remarks Section - that addresses the cause of the spill (e.g. human error, equipment) and whether 911 was called and which agencies responded.

1.13. Conduct at Work Site: There is no on-site storage area at 4th Cliff.

1.14. Contractor Personnel: The contractor shall designate in writing the name of the Con-tract Manager (CM) and any alternate(s) who shall act for the contractor when the manager is absent and their telephone numbers where they may be contacted any time to the CO and the COR within five (5) calendar days after contract award. The CM or alternate shall have full authority to act for the contractor on all matters relating to operation of this contract at Hans-com AFB. The CM or alternate shall be available to meet on the installation with government personnel designated by the CO to discuss problem areas.

1.14.1. Listing of Contractor Employees: The contractor shall provide a CM who can read, write, speak, and understand English fluently. The contractor shall provide an initial listing of contractor employees’ names and position titles to CO and COR prior to contract start date.

The contractor shall also provide an updated listing of personnel to the CO and COR within ten (10) work days when employees affecting the work of this contract have a status or posi-tion change.

1.15.The contractor shall not employ persons on this contract if such employee is identified to the contractor as a potential threat to the health, safety, security and general well being or op-erational mission of the installation and its population. The contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest, nor shall the contractor employ any person who is an em-ployee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval according to the DoD 5500.7-R Joint Ethics Regulations (JER). In ad-dition, the contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies contained in AFI 64-106, Air Force Industrial Labor Relations Activities. The contractor shall be prohibited from em-ploying off-duty COR’s who are surveilling any contracts/subcontracts awarded to the Con-tractor. All contract employees depending on particular condition, occasion or place, or job assignment shall require professional, suitable attire. All contractor employees shall conduct themselves in a professional, courteous manner. The selection, assignment, reassignment, transfer, supervision, management, and control of contractor employees in performance of this PWS shall be the responsibility and prerogative of the contractor; however, the contractor shall comply with the requirements set forth in this PWS and Hanscom AFB regulations con-cerning conduct of employees as referenced herein. The contractor shall employ and maintain a technically trained and experienced work force.

SECTION 2

Performance Assessment

The contractor shall be aware that in the absence of any contract requirement from the Service Summary does not detract from its enforceability nor limit the rights or remedies of the gov-ernment under any other provision of the contract. The contractor shall ensure the following service summary requirements are accomplished.+

GOVERNMENT-FURNISHED PROPERTY AND SERVICES

3.1. Government Furnished Property (GFP): Government Furnished Property is not ap-plicable to the in the performance of this contract.

3.3.4. Utilities: The government will furnish utility services. These utilities include natural gas, electricity, water and sewer for the sole purpose of accomplishing this contract. If the contractor requires additional utility services, it shall be the contractor’s responsibility to pro-vide. Contractor shall use due care and diligence in efforts to conserve utilities to reduce util-ity costs.

3.3.5. Refuse Collection: The government will provide refuse collection services limited to the extent provided in the Base Refuse Collection Contract for government provided facilities.

The government will only allow non-hazardous refuse to be emptied into the nearest author-ized refuse dumpster for trash collection. Do not use the government dumpsters for collection of construction debris.

3.3.6. Workspace: The government will provide adequate workspace around the equip-ment area.
