Section B: Description of the Supplies/Services Required

96 CEG has a requirement for web based design review management. The National Institute of Building Sciences (NIBS) DRChecks application provides the capability to securely identify and resolve design issues through real time internet-enabled collaboration, communication and access.

Section C: Justification for Soliciting from a Single Source or Brand Name

96 CEG is required to create a design and complete a design review for every construction project it attempts.

DRChecks provides a single and secure record of every document, inquiry, comment, and resolution through authorized project partners. This enables faster review and approval, and reduced design review costs. This application will allow 96 CEG the capabilities to design, save, share, comment, change, and resolve items as necessary on construction design requirements. DRChecks is the universal application created by the government and for use by the government. Access to the DRChecks application is not only being used by the US Air Force it is widely used among the government construction agencies and mission partners such as; USACE, NAVFAC, NASA, GSA, and the VA. This application is also the universal service used by government contractors who focus on construction requirements. DRChecks provides continuity among design review personnel providing rapid access to reviews and designs from any location with Internet access.

FAR 13.106-1(b)(1)(i) states that a contracting officer "may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source is reasonably available." Market research indicates NIBS is the only supplier offering this unique type of secure engineering and project coordinating web-based service and user support system.

96 CEG mission partners the US Army Core of Engineers (USACE) has directed the use of DRChecks through Army Engineering Regulation: AER: 415-1-111. DRChecks is essential for 96 CEG/USACE coordination/collaboration on current/future projects. Furthermore, DRChecks is operating with a Department of Defense (DOD) authority to process and store information categorized as sensitive but unclassified (SBU) or for official use only (FOUO). It is operated as a Government-accredited Internet-connected enclave. As such, the security within the web-applications as well as the operational controls/procedures meet Federal guidelines based upon NIST SP 800-53 control criteria, FIPS-199 Data Classifications, and in accordance with the provisions of the FISMA Act of 2002. National Institute of Building Sciences currently has a 3 year DOD ATO.

Section D: Efforts to Obtain Competition

Market research identified NIBS as the only supplier offering this unique type of secure engineering and project coordinating web-based service and user support system with the appropriate security approvals/authorizations.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

The Government will continue to evaluate other products to identify alternate solutions and/or sources capable of providing the requested items to meet agency needs.

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
