JUSTIFICATION FOR OTHER THAN FULL

AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

The 21st Space Wing, 21st Contracting Squadron, 21 CONS/LGCBA is the responsible activity for this Justification for Other Than Full and Open Competition in support of the National Security Space Institute’s requirements. The customer requests the purchase of the InfoWorkSpace License Renewal.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

The Government intends to solicit through other than full and open competition, Sole Source and award a contract for the InfoWorkspace License Renewal.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S

NEEDS

The NSSI requires InfoWorkSpace (IWS) for use in our Space Power Laboratory (SPL).

The Space Power Laboratory provides modeling and simulation with the basic Air & Space Operations Center (AOC) functionality, integrating 13 AOC operational applications and 4 simulations to create a fully-immersive space operations education facility. IWS is one of 13 AOC operational applications that are currently used in the Falconer Air-Space Operations Center (AOC). IWS is required to maintain currency with the current AOC baseline, as the only software that replicates the form, fit and function of the collaboration tools used in the Falconer AOC. IWS provides teams that are geographically dispersed with the ability to collaborate and share information in a real-time virtual environment. By providing organizations the tools to communicate through a variety of options, conferences, and shared applications this unique software solution will streamline day-to-day operations. IWS provides the capability for both voice and instant messaging (IM) chat rooms and person-to-person communication across a local-area network, bulletin boards for file sharing and multi-level security.

The total estimated cost for the operating licenses is $xxxxx. This item is being procured using 3400 funds.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

The authority for this Justification for Other Than Full and Open Competition is FAR 6.302-1(a)(2)(iii). Application for sole source procurements, Only one Responsible Source and no other Supplies or Services Will Satisfy Agency Requirement, contained in Citations 10 U.S.C. 2304(c)(1).

V. DEMONSTRATION THAT THE CONTRACTORS UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED

ABOVE (APPLICABILITY OF AUTHORITY)

As a training environment, the SPL does not have the flexibility to select many of the components of its software baseline. The SPL is required to host the operational software packages; of which IWS is one. Since IWS is COTS, and the Government does not have a bulk licensing agreement with Ezenia Inc., the licenses must be acquired separately.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED

FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

Per FAR 5.102(a)(6), a redacted copy of the Justification for Other Than Full and Open Competition will be posted with the solicitation.

Professional publications were scanned for comparable products to IWS including InfoWeek, Government Computer News, and ComputerWorld. No applications were found that met the requirements fulfilled by IWS in the Space Power Lab. These applications included:

BeeCall, FireTalk, HearMe, Internet Party Line, Pal Talk, Tribal Talk, and Visitalk.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

Prior to making award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3. The Government anticipates competition for this acquisition which will assist in the determination of the cost to be fair and reasonable.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS,

OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

Professional publications were scanned for comparable products to IWS including InfoWeek, Government Computer News, and ComputerWorld. No applications were found that met the requirements fulfilled by IWS in the Space Power Lab. These applications included:

BeeCall, FireTalk, HearMe, Internet Party Line, Pal Talk, Tribal Talk, and Visitalk.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION

The functions provided by IWS to the SPL are critical to the performance of the SPL’s mission of training the warfighter in AOC operations. If the J&A is not approved, and the license for IWS is not renewed, the SPL will lose the capability to support any training exercises.

Replacement of IWS with another program will require significant rework to the SPL to recover the lost functionality. The rework would encompass purchasing new servers ($~12,000), shutting down the Lab while the rework is performed, training SPL personnel on the new rework and rewriting 9 exercises (1,000 man-hours). Total cost could exceed $200,000 depending on how long the SPL is shut down, cost of new training and the cost to send 4 people TDY for that training, cost of servers, cost of 32 students to be TDY without the ability to get the training they need in the Lab, cost to rewrite 9 exercises (1,000 manhours worth of effort), etc.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

A sources sought notice was not required. The intended method of advertisement will be a sole source solicitation to Ezenia! Inc. via GSA.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING

SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

The SPL software configuration baseline was developed to mirror the space segment of the Falconer AOC software baseline which includes IWS as its collaboration toolset. The use was specified in the SOW to OPM-02-0800001. Since the license for IWS is an annual use license (vice in perpetuity), it must be procured annually. Since this is for maintenance of existing software, soliciting new software would be cost prohibitive.

XII. CONTRACTING OFFICER’S CERTIFICATION

The Contracting Officer’s signature on the Coordination and Approval Document evidences he has determined this document to be both accurate and complete to the best of his knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by her signature on the Coordination and Approval Document, the technical and/or requirements expert has certified all supporting data contained herein, which is her responsibility, is both accurate and complete.
