JUSTIFICATION
INTRODUCTION. Fair opportunity exception justification in accordance with FAR 16.505(b)(2)(ii)(B), as prescribed DFARS 216.505-70 implementing the minimum requirements of DFARS PGI 216.505-70.
I. IDENTIFICATION OF THE AGENCY, CONTRACTING ACTIVITY AND JUSTIFICATION. [16.505(b)(2)(ii)(B)(1)]
| A. Agency: Department of the Air Force | |
| B. Contracting Activity: 21st Contracting Squadron, Peterson AFB, Colorado | |
| C. Justification Type: Justification for an Exception to Fair Opportunity | |
| D. | Authority: Refer to Item IV below |
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED. [16.505(b)(2)(ii)(B)(2)]
A. This action will be awarded as a modification to an existing order pursuant contract FAR clause 52.217-8 “Option to Extend Services” for a 6 month task order extension period. The period of performance for the extension period will be 6 August 2014 to 5 February 2015.
| B. FA2517-12-D-9000-0015, A&AS support for TA2S Enterprise Architecture. |
| C. Firm Fixed Price |
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS, ESTIMATED VALUE. [16.505(b)(2)(ii)(B)(3)]
A. Description: Option to extend performance of the services described in the Task Order identified in item II B. above in accordance with the basic contract terms and conditions.
B. Value: $99,999.96 (labor). The value of this action was calculated using the rates established upon order award as described in the “Option to Extend Services” clause of the contract.
IV. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY [16.505(b)(2)(ii)(B)(4)]
A. Authority: FAR 16.505(b)(2)(i)(C). The order must be issued on a sole-source basis in the interest of efficiency as a logical follow-on extension of services modification to an order already issued under the contract as prescribed in the “Option to Extend Services” clause of the order. This modification action satisfies ongoing mission needs currently performed under task order FA2517-12-D-9000-0015 that are required to be continued due to anticipated government changes in timelines for the TA2S Enterprise Architecture. The relationship between the initial order and the extension effort is for the exact scope of the original order and is therefore considered logical. This modification action satisfies ongoing mission needs currently performed under task order FA2517-12-D-9000-0015 that are scheduled to be converted from contractor to civilian billets at the conclusion of the period of performance initially established for this task order. Due to possible delays in the hiring process, an extension of services is necessary to ensure task order support does not end until all positions have been filled.
B. Augmenting current support as an extension to task order FA2517-12-D-9000-0015 is clearly in the interest of efficiency to the Government. The current contractor has supported this requirement without any performance issues, it is expected that they will continue to do so until all positions have converted to civilian billets. The effort required for a new solicitation and the government oversight that would be required to bring on a new contractor would be not efficient given the short duration of the extension period and the potential for any or all of the positions to convert to civilian billets at any time during performance. Further, a re-compete would be wasted effort as it can reasonably be assumed that none of the TA2S contractors would bid on this requirement knowing that it has already been selected for conversion.
V. ORDERING ACTIVITY CONTRACTING OFFICER’S DETERMINATION STATEMENT THAT THE ORDER/MODIFICATION FAIR AND REASONABLE. [16.505(b)(2)(ii)(B)(5)]
The anticipated cost is considered fair and reasonable as the pricing parameters for this modification were established upon order award and are as described in the “Option to Extend Services” clause of the basic contract.
VI. OTHER FACTS. [16.505(b)(2)(ii)(B)(6)]
None.
VII. STATEMENT OF ACTIONS THE AGENCY WILL TAKE TO REMOVE OR OVERCOME BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR SUPPLIES OR SERVICES IS MADE. [16.505(b)(2)(ii)(B)(7)]
Not applicable. Action executed in accordance with the terms, conditions and provisions of the contract as described above. In addition, at this time funds are not available for a new task order with a longer period of performance. If funding becomes available in the future to support an additional task order the requirement will be awarded using competitive procedures on the TA2S contract.
VII. CONTRACTING OFFICER’S CERTIFICATION THAT THE JUSTIFICATION IS ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING OFFICER’S KNOWLEDGE AND BELIEF. [16.505(b)(2)(ii)(B)(8)]
I, the Contracting Officer by affixing my signature below, hereby certify that this justification for an extension of services (6 August 2014 to 5 February 2015) for task order FA2517-12-D-9001-0015 is accurate and complete to the best of my knowledge and belief.
SHERI L. BURKS
CONTRACTING OFFICER
IX. EVIDENCE THAT SUPPORTING DATA THAT IS THE RESPONSIBILILTY OF TECHNICAL OR REQUIREMENTS PERSONNEL (e.g., verifying the Government's minimum needs or requirements or other rationale for limited sources) WHICH FORM A BASIS OF THIS JUSTIFICATION HAVE BEEN CERTIFIED AS COMPLETE AND ACCURATE. [16.505(b)(2)(ii)(B)(9)] Not applicable. Action executed is totally within the purview of the Contracting Officer’s authority and in accordance with the terms, conditions and provisions of the contract as described above
