Justification and Approval for Only One Responsible Source and No Other Supplies or Services
Will Satisfy Agency Requirements
1. This document constitutes justification and approval for only one responsible source for the acquisition described herein, under the authority of FAR 6.302-1. It is executed on behalf of the 179 th
MSG/MSC, Air Guard Contracting Office, Mansfield, Ohio 44903-8049.
2. Nature and description of action being approved.
The 200 th
Red Horse Squadron – Environmental Office has requested Parachute Training Simulator
(PARASIM) equipment, software upgrade and maintenance by means of a sole source purchase order.
3. Description of supplies or services required to meet the Agency’s needs.
The products and services to be obtained (total estimated cost: $16,500) are required for the following reasons:
a. The Environmental report referenced in statement of work is required; last report generated was five years ago (currently overdue; unable to be funded until recently).
4. Identification of statutory authority permitting only one responsible source.
a. FAR 6.302-1, One responsible source and no other supplies or services will satisfy agency requirements.
5. Demonstrate that the nature of the acquisition requires use of the authority cited.
The Radar system data is collected by DeTect's proprietary software. The company collecting and analyzing the data would need to be familiar with the use of this software and have knowledge to perform QA/QC tasks, query development, data analysis, and interpretation of the results. In this situation DeTect is the only company authorized to perform this work.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a CBD notice was or will be publicized as required by Subpart 5.2, and if not, which exception under 5.202 applies.
In accordance with FAR 5.101(a)(2)(ii) – oral solicitation, this requirement will not be posted.
7. Determination by the contracting officer that the anticipated cost to the government for the proposed acquisition will be fair and reasonable.
The cost to the Government is determined fair and reasonable, based on the following:
a. FAR 13.106-3(a)(2)(ii) – previous contracts for similar requirements
b. FAR 13.106-3(a)(2)(vii) – other reasonable basis (previous quotes received for same requirement)
8. Description of market survey conducted and the results or a statement of the reasons that a market survey was not conducted.
Market research was conducted; GSA company that is authorized to provide De Tect’s equipment (e.g.
Merlin Radar) were not authorized to provide the associated services related to the function of the radar
(proprietary to De Tect).
9. Any other facts supporting the use of only one responsible source of supply.
Company was contacted by this office to confirm the sole source/proprietary assertion of requesting activity, which they did confirm.
10. A listing of sources, if any, that expressed, in writing, on interest in the procurement.
None.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
None at this time. This requirement is supported by the software and associated equipment provided De
Tect. Should this software and equipment need replaced in the future, and this office is involved in the process, obtaining the requirement from a source that does not restrict future service needs to be performed only by themselves (proprietary) will be pursued.
12. Technical requirements personnel certification.
I hereby certify that this justification and approval for other than full and open competition is made in good faith, that the supporting documentation and information is accurate and complete to the best of my knowledge, and that I would not be making this request if it were feasible to fully compete this requirement as the FAR and applicable supplements and regulations direct.
