OHIO AIR NATIONAL GUARD
HEADQUARTERS 179
TH
AIRLIFT WING
MANSFIELD, OHIO
17 March 2015
Justification and Approval – Unusual and Compelling Urgency
1. This document constitutes justification and approval for only one responsible source for the acquisition described herein, under the authority of FAR 6.302-2. It is executed on behalf of the 179 th
MSG/MSC, Air Guard Contracting Office, Mansfield, Ohio 44903-
8049.
2. Nature and description of action being approved.
The 179 th
AW Civil Engineering has requested that critical maintenance and inspection services for oil/water separator (OWS) be obtained through a sole source contract. Not-to-exceed cost of services is $30,000.00.
3. Description of supplies or services required to meet the Agency’s needs.
Oil/water separator has malfunctioned/ceased to operate, as identified by 179AW Civil
Engineering personnel; cause of malfunction cannot be determined by base technical personnel.
4. Identification of statutory authority permitting only one responsible source.
a. FAR 6.302-2, Unusual and Compelling Urgency – delay in award of a contract would result in serious injury, financial or otherwise, to the
Government.
5. Demonstrate that the nature of the acquisition requires use of the authority cited.
Failure of oil/water separator to operate causes a real and significant danger to lands surrounding area; separator requires maintenance and inspection as soon as possible, to avoid jet fuel/oil tainted water to runoff into associated land. Ensuring the risk is mitigated and resolved in as timely a manner possible requires immediate action.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a CBD notice was or will be publicized as required by Subpart 5.2, and if not, which exception under 5.202 applies.
In accordance with FAR 5.202(a)(2), this requirement will not be publicized; however, justification for action will be posted to government point of entry in a timely manner.
Due to the nature of the requirement, multiple sources were not solicited.
7. Determination by the contracting officer that the anticipated cost to the government for the proposed acquisition will be fair and reasonable.
The cost to the Government will be determined fair and reasonable, based on the following:
a. FAR 13.106-3(a)(2)(vii) – contractor shall submit itemized invoice of materials and labor utilized to complete required work, which will be evaluated by subject matter experts (Base Civil Engineering and Environmental Office) to ensure final, definitized contract price is fair and reasonable (per undefinitized contract action procedures). Additionally, similar services (of non-urgent nature) have been provided previously and associated pricing from those actions shall be utilized for this determination, as well.
8. Description of market survey conducted and the results or a statement of the reasons that a market survey was not conducted.
Due to nature of requirement, a market survey will not be conducted; local company with known capabilities has been contacted and can meet our immediate service need.
9. Any other facts supporting the use of only one responsible source of supply.
None.
10. A listing of sources, if any, that expressed, in writing, on interest in the procurement.
None.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
None; nature of requirement deems competition not in the best interest of the
Government for circumstances such as this.
12. Technical requirements personnel certification.
I hereby certify that this justification and approval for other than full and open competition is made in good faith, that the supporting documentation and information is accurate and complete to the best of my knowledge, and that I would not be making this request if it were feasible to fully compete this requirement as the FAR and applicable supplements and regulations direct.
