Acquisition Office: Department of the Air Force
30P th P Contracting Squadron (30 CONS)

DSN: 276-1733
Commercial: (805) 606-1733
Purchase Request: F4D3D34062AG01
UII. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
a. The proposed action is the continued operation of the SVPP Ambient Air Monitoring Station to monitor the air in and around the SVPP
Approval to issue a contract on a sole source basis to contractor is being requested for procurement and integration of the Ambient Air Monitoring
Station.
b. The current contract period of performance for the SVPP Ambient Air Monitoring
Station is ending 30 September 2014. The total value for the proposed contract action is The cost for the base year is and the cost for the following three option years is and respectively. The proposed contract will begin on 1 Oct 2014 with three one year option periods ending on 30 Sept 2018. This sole source acquisition is being acquired using FAR Subpart 13.5 Test Program for Certain Commercial Items.
UIII. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY NEEDS
The requirement to be performed is the operation of the SVPP Ambient Air Monitoring Station in accordance with Permit to Operate PT-70 13968 The Federal Environmental Protection Agency (EPA), California EPA, and SBCAPCD require the air to be monitored in order for Vandenberg AFB (VAFB) to operate the SVPP. Operation of the station
Other than Full and Open Competition Ambient Air Monitoring
Justification and Approval includes all required maintenance, testing, record keeping and reporting requirements at the station location as described in the requirements Statement of Work.
UIV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 U.S.C. Section 2304(c)(1), only one responsible source that will satisfy the needs of the agency and FAR 13.501 Special Documentation Requirements. The is the only source that can complete this requirement with the assurance that the Government will receive no Notice of Violation (NOV) for violations unpreventable by VAFB (ie. Equipment malfunction or breakdown).
UV. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY
CITED ABOVE (APPLICABILITY OF AUTHORITY)
This is a “sole source” request for the to secure and oversee the integration of the Ambient Monitoring System. Failure to utilize to fulfill this requirement will increase VAFB’s risk of being issued NOVs, which can cost the Air Force fines from $1,000 to $25,000 per day of violation and possibility criminal penalties from six months to one year in jail. The operating the Ambient Monitoring Station assumes liability for any data monitoring or reporting deficiencies that would normally result in NOVs to VAFB if we were operating the station. Only the , in operation of the monitoring station, can eliminate the risk of NOVs to VAFB through assuming the responsibility of station operation since this is
. No other agency or company can provide this reduction in risk.
UVI. DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
In accordance with FAR 13.501(a)(iii) notice of intent to issue a contract for the SVPP Ambient Monitoring Station will be published on the Federal Business Opportunities website within 14 days after contract award. Contract specialist contacted two companies found on GSA Advantage (RTP Environmental Associates and E2 Environmental, Inc.) that provide for Ambient Air Monitoring with offices in California. However, RTP Environmental only does air monitoring out of their Colorado office and does not perform air monitoring in California. E2 Environmental only does air monitoring as part of their own projects; they do not perform air monitoring as a single working activity, therefore their own company policies prevent them from performing air monitoring at Vandenberg AFB. Even if these two companies were willing to provide this requirement, they lack the ability that SBCAPCD has to insure that Vandenberg AFB would not receive future NOVs for equipment failure or environmental violation.

UVII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The “fair and reasonable” determination will be based on previous years this requirement has been found fair and reasonable and similar requirements from the two GSA vendors that were discussed earlier.
UVIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED
a. Market research was conducted for this requirement IAW FAR 10.001(a). A search on UNICOR.gov and AbilityOne.org for Ambient Air Monitoring found no results. GSA Advantage found two vendors as mentioned before under ambient air monitoring, however they cannot ensure VAFB of the requirement that no NOVs will be issued if there is a malfunction with the air monitoring equipment. Finally, a search was conducted for air monitoring within the DoD on FPDS.gov resulting in 240 contract actions located in ten different regions in the United States. Out of the ten regions, the DoD uses a sole source requirement for each of the air monitoring contract actions. Using the advanced search function in FPDS with NAICS 921190 Other General Government Support, was the only organization serving fourteen contract actions within Santa Barbara County.
b. Market research confirmed that no other sources exist, including the Air Force Center for Engineering and the Environment (AFCEE). Additionally, no other Government agencies (EPA, California Air Resources Board) are able to provide this requirement to VAFB.
UIX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
The subject requirement must be procured from because it eliminates the potential for NOV related to operation of the station and it reduces operational costs. The imposes extremely detailed monitoring, data capture and reporting requirements on the operation of the Ambient Monitoring Station. It is very costly for VAFB to meet the imposed operational requirements itself and there is a constant significant risk of being issued an NOV if requirements are not met due to station operational problems. The Air Force command structure takes NOVs very seriously because of the adverse publicity, the cost of fines which can range from $ to $ per day per violation and possibility of criminal penalties from six months to one year in jail. With the operating the Ambient Monitoring Station, the assumes liability for any data monitoring or reporting deficiencies that would normally result in NOVs to VAFB if we were operating the station. Only can eliminate the risk of NOVs to VAFB through assuming operation of the station. No other agency or company can provide this reduction in risk.

UX. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE
ACQUISITION
None
UXI. A STATEMENT OF THE ACTIONS IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO THE COMPETITION BEFORE
MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES
REQUIRED
The market will continue to be monitored for developments that could overcome barriers to competition. However, this is not likely to occur since this requirement exist due to county and enviornmental regulations within Santa Barbara, CA. Other Government agencies will routinely be reviewed to validate that the same processes are being met like VAFB’s.
