JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING ACTIVITY. Department of the Air Force, 87th Contracting Squadron, 2402 Vandenberg Ave, Joint Base McGuire-Dix Lakehurst, New Jersey 08641

2. NATURE AND/OR DESCRIPTION OF ACTION BEING PROCESSED. During operations last winter, an OSHKOSH flightline snowblower sucked in a manhole cover and was damaged. The proposed acquisition will result in a Firm Fixed Price (FFP) purchase of parts to repair the damaged flightline snowblower manufactured by OSHKOSH. This is a Sole Source requirement.

3. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED MEETING THE AGENCY’S NEEDS.

The Government has already purchased OSHKOSH flightline snowblowers; this additional purchase will be compatible in form, fit and function.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION.

The authority for this proposed acquisition is implemented by FAR 13.501(a)(2) and section 4202 of the Clinger-Cohen Act of 1996.

5. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE

OF THE ACQUISITION REQUIRES THE USE OF ONLY ONE RESPONSIBLE SOURCE AND NO

OTHER SUPPLIES OR SERVICES WILL SATISFY AGENCY REQUIREMENTS AUTHORITY. The purchase is necessary because these parts must be compatible with existing equipment that is already in use.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS DEEMED PRACTICAL. No other businesses where found that could manufacturer these parts. In the future, the market will continue to be checked to ensure that every effort will be made to try and open this sole source contract to as many vendors as possible.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO

THE GOVERNMENT WILL BE FAIR AND REASONABLE. As these snowblowers are widely in use at various airports (to include other military installations such as Dover AFB), there is sufficient commercial price/cost information available to assist in price analysis. Based on current rates, the price for these items is determined to be fair and reasonable.

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A

STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED. Searches were conducted on GSA advantage as well as CCR Small Dynamic Business database. Market research indicated there are no other companies that manufacture the equipment needed for this procurement. While there are other non-manufacturing distributers, OSHKOSH is the sole manufacturer of these parts and it sells directly to the Government. Delivery is estimated to be 150 days ARO.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION. There are no other known manufacturers for these parts.

10. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN

INTEREST IN THE ACQUISITION. No other manufacturers have expressed an interest in this procurement.
