*RFO Provision 52.212-2 Evaluation-Commercial Products and Commercial Services

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(a) The Government will award a contract resulting from this RFQ to the responsible vendor whose quote conforming to the RFQ will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

(1) Total Evaluated Price:

Price analysis will be performed to determine the reasonableness of the Offer's price quote. Reasonableness will be based on the total evaluated price. The total evaluated price will be calculated as the sum of the Estimated Total Price for all the Contract Line Item Numbers (CLINs).

The proposed prices will be evaluated for reasonableness. Analysis of the cost/price quote will be performed using one or more of the techniques defined in RFO 12.203 in order to determine price reasonableness. Reasonableness must represent a price to the Government a prudent person would pay in the conduct of competitive business.

Normally, price reasonableness is established through adequate price competition but may also be determined through cost and price analysis techniques.

(2) Technical Acceptability:

The technical offers will be evaluated IAW Statement of Need.

The government’s technical evaluation team will evaluate the technical portion on a pass/fail basis, assigning ratings of Acceptable or Unacceptable IAW the table below.

Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Offer meets the requirements of the solicitation.

Unacceptable Offer does not meet the requirements of the solicitation.

Evaluation steps: Price and Technical Acceptability: Step 1: Evaluate all quotations for responsiveness. Step 2: Rank all responsive quotations based upon vendor’s Total Evaluated Price (TEP). Step 3: Make a Best-Value decision based on performance evaluation and a determination that the price is fair and reasonable.

(b) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

Discussions: The government intends to award a purchase order without discussions with respective vendors/quoters. The government however, reserves the right to conduct discussions if deemed in its best interest.

Include descriptive literature such as illustrations and drawings.

Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Revolutionary Far Overhaul (RFO) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the RFO and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.
