This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation number F15PS00690 is issued as a request for quote (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005- 78.

II. This procurement is for multiple locations and multiple types of gravel. This solicitation will be awarded through one or more purchase orders. Potential offerors may provide quotes on one or more of the item lines identified in this solicitation notice. Offerors will be evaluated on the requirements of the solicitation for submission and the content of their submission.

III. This requirement is being procured in accordance with FAR Part 12, Acquisition of Commercial Items and an award will be made in accordance with FAR Part 13, Simplified Acquisition Procedures. This action is being solicited as a small business set-aside and only qualified offerors may submit a quote.

The NAICS Code associated with this requisition is 212321 with a small business size standard of 500 employees. Buyer intends to issue award using a fixed priced purchase order or delivery order. Bids from Sellers unable to accept purchase orders or delivery orders will not be considered for award.

IV. Offerors are cautioned that a warranted Contracting Officer is the only authorized Government Representative to make any contractual changes once an award is made. No oral statement of any person whomsoever shall, in any manner or degree modify or otherwise affect the terms of this Purchase Order. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment shall be made in the Purchase Order price to cover any increase in costs incurred as a result thereof.

V. Government Representative (GR): Authorized Government Point of Contact for this order is identified on the awarded purchase order at the time of award.

VI. Description:

(1.) Line Item 0010: Approximately 806 tons of SB2 Gravel for delivery and 2 inch tailgate spread at or near Bayou Pierre Unit of the Red River Refuge. Location at or near 150 Eagle Bend Point, Bossier City, LA 71112. From the blinking caution light at the intersection of LA 1 and LA 509 in Red River Parish, go south on LA 1 for 1.6 miles. Turn left (east) on Grand Bayou Loop/PR 401 and proceed 0.7 miles.

This work entails furnishing all necessary management, supervision, labor, materials, licenses, certifications, and equipment to supply for delivery, stockpile and/or tailgate spread with a minimum of 13 truckloads delivered per day. This will be under the direct supervision of FWS Personnel. The contractor shall ensure total for all amounts supplied does not exceed the amount noted in the contract line items.

(2.) Line Item 0020: Approximately 500 tons ABC Granite, gravel class “B” (football size) for delivery and stockpile at or near 38 Mattamuskeet Road, Swanquarther, NC 27885; Mattamuskeet National Wildlife Refuge.

This work entails furnishing all necessary management, supervision, labor, materials, licenses, certifications, and equipment to supply for delivery, stockpile and/or tailgate spread with a minimum of one (1) truckload delivered per day. This will be under the direct supervision of FWS Personnel. The contractor shall ensure total for all amounts supplied does not exceed the amount noted in the contract line items.

(3.) Line Item 0030: Approximately 635 tons of Class 7 SB-2 Base crushed limestone rock for delivery and 5” to 8” thick, tailgate spread. Two (2) Locations at Felsenthal National Wildlife Refuge. Location 1: Pine Island road (Federal Highway Route 011); Location 2: Shallow Lake Road (Federal Highway Route 012)

Location 1: Pine Island road (Federal Highway Route 011); Pine Island road (approximately 5.5 miles) is located approximately 7.2 miles west of Crossett, AR on Highway 82, and just east of Highway 82, Ouachita River Bridge in Ashley County.

Location 2: Shallow Lake Road (Federal Highway Route 012). Shallow Lake Road (approximately 3.66 miles) is located approximately 12 miles west of Crossett, AR on Highway 82, and approximately 6.2 miles west of Highway 82/ Ouachita River Bridge in Union County.

This work entails furnishing all necessary management, supervision, labor, materials, licenses, certifications, and equipment to supply for delivery, stockpile and/or tailgate spread with a minimum of 10 truckloads delivered per day. This will be under the direct supervision of FWS Personnel. The contractor shall ensure total for all amounts supplied does not exceed the amount noted in the contract line items.

(4.) Line Item 0040: Approximately 1400 tons of #610 Kentucky Gray limestone for delivery and 3” tailgate spread along Wildlife Drive for FWS Lacassine National Wildlife Refuge at/or near 209 Nature Road, Lake Arthur, LA 70549.

This work entails furnishing all necessary management, supervision, labor, materials, licenses, certifications, and equipment to supply for delivery, stockpile and/or tailgate spread with a minimum of 10 truckloads delivered per day. This will be under the direct supervision of FWS Personnel. The contractor shall ensure total for all amounts supplied does not exceed the amount noted in the contract line items.

(5.) Line Item 0050: Approximately 1100 tons of Limestone of #610 Kentucky Gray limestone for delivery and 3” tailgate spread along Pintail Drive for FWS Cameron Prairie Wildlife Refuge at/or near 1428 LA- 27, Bell City, LA 70630.

This work entails furnishing all necessary management, supervision, labor, materials, licenses, certifications, and equipment to supply for delivery, stockpile and/or tailgate spread with a minimum of 10 truckloads delivered per day. This will be under the direct supervision of FWS Personnel. The contractor shall ensure total for all amounts supplied does not exceed the amount noted in the contract line items.

VII. Delivery Requirements: Reference corresponding line item maps and/or specification material form that is associated with solicitation notice.

Coordinate with FWS personnel about delivery quantities and exact locations. The contractor will be expected to assign more than one truck at a time to deliver on the site. There may be county road weight limit restrictions coming into this site. It is the vendor’s responsibility to verify site conditions prior to submitting quote and prior to all deliveries.

Commencement date 48 hours upon request from GR. Request may be made through email or phone.

Once delivery begins, the Contractor shall deliver at rate of not less than 10 truckloads per day consecutively with no gaps in days of non-delivery without prior approval from FWS GR. Delivery will be conducted during regular working hours, excluding federal holidays. Hours are the designated business hours for that particular National Wildlife Refuge Location; Monday through Friday. There is maybe no restroom at the delivery site. If a restroom is needed at the delivery site, it will be provided by the contractor. Deliveries may be stopped at the discretion of the GR if rain causes the material being delivered to become saturated or causes poor road/ground conditions at the delivery site.

The delivery may accompany a spot dump with amount piled and thickness to be determined by the GR at the designated location. Identified delivery location will be at designated through GR. All deliveries will occur within an active jobsite or staging area that will accommodate highway compliant vehicles, required delivery trucks, etc. Drivers shall furnish mine number stamped certified scale tickets to FWS/government personnel upon delivery of each load to the delivery site.

Required commencement date for delivery is on or about two business days after award. Expected completion date will be no later than 60 days of award issuance.

For inquires on delivery site details, exact locations and specifications, please reference attached “Roadway/Gravel Surface Material” sheet and map.

NOTE: It is the Contractor’s responsibility to visit the site prior to bidding and know existing delivery and dumping conditions.

VIII. Local conditions (bridge restrictions, weather conditions, water levels, road flooding, etc.) that may affect delivery: weather conditions, road flooding and water levels. Contractor shall coordinate deliveries (including hours of delivery) with GR 48 hours in advance.

IX. System for Award Management (SAM) Registration - A prospective awardee shall be registered in the SAM database prior to award. Information on registration may be obtained via the Internet at:

https://www.sam.gov/portal/public/SAM/#1 or by calling 866-606-8220. Failure to maintain a current/active account so will render your offer non-responsive.

X. RFQ Due Date: Telephone quotes will NOT be accepted. All quotes must be received at this office no later than 06/25/2015, 10:00 AM Local Eastern Time. ONLY EMAILED QUOTES WILL BE ACCEPTED. Email to constance_fields@fws.gov. Attention to: Constance Fields. Please reference/subject: solicitation number. Quotes should be attached document that is either Microsoft Word 97 compatible or PDF. The anticipated award date is on or about 07/01/2015. Please do not request award status prior to this date.

XI. All questions regarding this solicitation must be emailed to constance_fields@fws.gov. No phone questions will be answered. All questions must be submitted no later than 06/17/2015 by 10:00 AM local eastern standard time.

XIV. SUBMISSION REQUIREMENTS. All interested Contractors MUST provide a quote with the follows:

NOTE: Any quotes not received by the due date and time specified in this combined synopsis/solicitation will be rejected. Additionally, any INCOMPLETE quotes that do not contain the required information as stated in this solicitation may also be rejected.

Price(s) should be for FOB Destination.

(4) A list of three (3) most recent and relevant past performance references for a similar type purchase including name/point of contact, address, phone number, and email address; description of worked performed, value of the contract, and contract number. If you do not have 3 relevant past performance, you must provide a statement on how your company capability and why you are the best fit to meet this requirement.

(5) Statement confirming registration in SAM (www.sam.gov). Statement confirming to the Representation and Certification completion within SAM. Provide account expiration date, cage code, DUNs number, and taxpayer ID number;

(6) Statement confirming that you will accept electronic payment through IPP. (www.ipp.gov)

(7) For Contractors wishing to bid on this post that is outside of 150 mile radius of corresponding line item address must provide SUBCONTRACTOR/ LOCAL VENDOR’S COMPANY NAME, VENDOR REPRESENTATIVE NAME, ADDRESS, EMAIL ADDRESS, AND PHONE NUMBER. In addition, provide statement from local vendor confirming the ability to provide and deliver requested material on prime contractor behalf.

(a) In addition; provide the name, email address, and phone number of the prime contractor’s Field/Contract Representative that can address and resolve contract related matters and has the ability to be available and at the delivery/jobsite within a 1 hour notice upon request.

NOTE: The final quoted price(s), both total and individual, MUST include all applicable fees, gratuities, commissions, service charges, hauling fees, etc. The awarded price must remain valid through life (performance of period) of the purchase order. THE FEDERAL GOVERNMENT IS TAX EXEMPT.

XII. Provisions and Clauses:

FAR 52.252-1 Solicitation Provisions Incorporated by Reference. (FEB 1998) This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. DIAR 1452.201-70 Authorities and delegations. (SEP 2011) The terms and conditions to this cause are determined by the contracting officer to be necessary for this acquisition and consistent with customary practices.

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the Contractor’s generated invoice is to be submitted as an attachment to the IPP invoice.

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

FAR 52.212-1 Instructions to Offerors - Commercial Items. (APR 2014) The terms and conditions for this provision applies to this acquisition with addendums found within the solicitation guidelines.

FAR 52.212-2 Evaluation - Commercial Items. (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government through price and other factors considered. The following factors shall be used to evaluate offers:

(i) Price

(ii) Compliance with the requirements of this solicitation notice

(iii) Past performance (see FAR 15.304);

(iv) Must be small business participation;

Technical and past performance, when combined, are equally as important to price. [Contracting Officer state, in accordance with FAR 15.304, the relative importance of all other evaluation factors, when combined, when compared to price.]

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
