About this file

This document is a Justification and Approval for Acquisition under Simplified Acquisition Procedures for the Department of the Interior, Bureau of Land Management (BLM), West Desert District Office. The justification is to add Emergency Medical Services (EMS) to the existing contract for law enforcement services in the Little Sahara Recreation Area (LSRA) with Juab County Sheriff's Office under contract 140L5720C0001.

The BLM requires EMS services to assist with administration and regulation of the LSRA, which spans 60,000 acres. The Juab County Sheriff's Office is deemed uniquely qualified to provide these EMS services, as they already have the necessary staff, equipment, communication protocols, and jurisdictional authority in place. The estimated value of the EMS services for option year 4 is $20,000. The BLM conducted market research but determined that other EMS providers could not meet the requirements, such as integrating communications and dispatch with the county. The BLM plans to reevaluate competition for the EMS portion of the contract upon the conclusion of the current law enforcement services contract.

JUSTIFICATION AND APPROVAL

FOR ACQUISITION UNDER SIMPLIIFED ACQUISITION PROCEDURES

This document sets forth the justification and approval as required by 13.106-1(b)(1) &(2).

1. Contracting agency and activity.

The Department of the Interior, Bureau of Land Management (BLM), West Desert District Office, requests the Utah State Office, to contract on a sole source (including brand name) basis.

2. Nature and/or description of action being approved.

The proposed out of scope modification is to add Emergency Medical Services (EMS) to the contract for law enforcement services in the Little Sahara Recreation Area (LSRA) with Juab County Sheriff's Office under 140L5720C0001.

3. Description of supplies or services.

Obtain emergency medical services as needed to assist the Bureau of Land Management (BLM) in the administration and regulation of the use and occupancy of the public lands located at Little Sahara Recreation Area.

4. Estimated dollar value.

The estimated value of this action is $20,000 for option year (4).

5. Statutory authority.

_X_41 U.S.C. 1901 – Simplified acquisition procedures (use when the simplified procedures for purchases of property and services for amounts (1) not greater than the simplified acquisition threshold

____41 U.S.C 1903 – Special emergency procurement authority (applies when in support of a contingency operation as defined in section 101(a) of title 10 or to facilitate the defense against or recovery from nuclear, biological, chemical, or radiological attack against the United States).

Other statutes:

1) Federal Acquisition Regulation (FAR) 6.302-5. Authorized or required by statute.

a) Federal Land Policy and Management Act of 1976, Sec. 303(c),

6. Rationale supporting use of the authority stated in paragraph 5.

The Juab County Sheriff's Office is uniquely qualified to provide the services listed in the Statement of Work. JCSO possesses a staff of trained and qualified law enforcement officers who have a jurisdictional and operational authority to enforce state and county laws in the work area. Medical incidents that occur within the Little Sahara Recreation Area often require a Law Enforcement response. These incidents often involve a criminal element that needs to be investigated. JCSO EMS already has the necessary radios and required communication protocols in place to facilitate an interagency or Law Enforcement response. The State of Utah coordinates dispatch communication channels through the Utah Communication Authority which control and facilitate most of the states dispatching services. Juab County EMS and Law Enforcement dispatch services through Central Dispatch. Central can communicate with all the nearby federal and state agencies. This is necessary in case of a multi-agency or officer response. The BLM requires existing communication procedures to effectively work with local partners and agencies.

The JCSO possesses and can employ a communications command-and-control structure which can facilitate coordination with multi-agency law enforcement officers and EMS personnel. Juab County EMS personnel are able to utilize the same radio communications employed by the sheriff’s office to allow for a seamless inter-agency coordination that external EMS providers are not able to capitalize on. The ability to use and maintain the same consistent radio frequency infrastructure for communication allows for greater response times and coordination within the recreation area that spans 60,000 acres with terrain that cannot be traversed by “normal” modes of transportation. Juab County EMS employs vehicles designed to navigate the abnormal terrain encountered through Juab County and LSRA. Responses to medical incidents often require BLM assistance who can utilize specialized equipment to access remote areas. This request for assistance is done through local dispatching services that already have communications and protocols in place.

Other information.

No other facts are available to support this procurement as anything other than a sole source.

The efforts to identify additional sources including the market research conducted.

A notice of intent to was published on SAM.gov to notify the public of the government’s intent to execute the proposed out-of-scope modification to 140L5720C0001 for EMS services. The notice was posted for 15 days. The government received two (2) responses from Minuteman EMS and Red Line Emergency Services.

After a thorough review of the capabilities of both companies it was determined that neither company would be able to meet the requirements as outlined in the rationale. Neither company would be able to fully integrate communications with the County and the BLM. They would not have access to Central Dispatching services leading to communications issues along with prolonged response times due to those issues.

Future plans to permit competition.

At the conclusion of the current contract for law enforcement services with Juab County the decision to open up the EMS portion for competition will be reviewed again. Based on the information received from Minuteman EMS and Red Line Emergency Services future plans for competition will be considered depending on the availability of funding, contractor capabilities, and their ability to seamlessly integrate their communications with Juab County emergency services. Jurisdictional requirements and concerns will need to be evaluated throughout the consideration and evaluation process.
