SSJ No.: FY20-00274

SOLE SOURCE JUSTIFICATION FOR SIMPLIFIED ACQUISITIONS

(over $3,000 and up to $250,000)

Date: _7/15/2020______ PR Number: RUFO-20-00129

1. Nature and/or description of the item/service being procured and its intended use (including the anticipated cost):

The service required is the annual support and maintenance of the PistolStar Password Power Plug-In authentication security software licensed to the Department of Homeland Security (DHS), which includes the following support and maintenance services performed by the developer for a period of up to five years (one base year with four one-year option periods):

Technical and troubleshooting support for all end users; technical fixes of all software flaws; and the provision of all enhancements made by the developer to the software. All of DHS’s software licenses require annual support and maintenance. This support and maintenance will ensure that this software continues to operate seamlessly while maintaining its relevance to its purpose and therefore allow DHS to continue to ensure the software is operational and adequately interoperable.

The total anticipated cost of this requirement is $32,500.

2. Sole Source Justification Rationale (Check one and explain below):

__X___ Only one responsible source.

______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

Explanation:

Due to intellectual property rights statues, PistolStar Incorporated is the only firm capable of providing maintenance and support to its software as it currently owns the source code of the software.

The Government conducted market research for a business analysis regarding whether, over a five-year period, it would be more reasonable to maintain current software or buy new software with maintenance. The market research determined that no other commercial product has been developed to meet DHS security requirement for password protection and security; therefore, PistolStar Inc. is the sole vendor offering a product that meets DHS’s requirements.

3. Market Survey. Explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

PistolStar Password Power Notes ID Plug-In Support/Maintenance - (RUFO-20-00129)

In accordance with statues covering intellectual property rights, the Pistol Star’s software source code is the property of the developer, and therefore PistolStar is the only developer that can provide annual maintenance and support to its commercial products. Also PistolStar does not have authorized resellers and sells its product directly to customers; therefore, the product is not available to be competed among authorized resellers.

4. If this is a determination for sole source, the contracting officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist, or other (explain).

b. The anticipated price will be determined fair and reasonable using standard price analysis techniques described in FAR Part 13.

5. A statement of actions to be taken by the requesting activity to preclude the necessity for future sole source acquisitions of the same supply/service.

a. Future efforts will be made to seek products currently under development that may be compatible with the current ePMO system. As future products are identified compatible by Government market research, a cost comparison analysis will be made to determine the reasonability of buying a new license with long term support and maintenance vice buying long-term, follow-on support and maintenance from the current developer.
