About this file
This is an EXPRESS NDAA Certification Form required by the Department of State for vendor compliance with Section 889 of the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year 2019. The form is a template and representation document designed to ensure contractors and vendors certify their compliance with federal telecommunications equipment and services restrictions.
The certification requires vendors to represent that they do not provide covered telecommunications equipment or services as substantial, essential, or critical components of any system in violation of Section 889(a)(1)(A); do not use covered telecommunications equipment or services within their enterprise as defined in Section 889(a)(1)(B); have conducted reasonable inquiry to identify any covered telecommunications equipment or services in their possession; and will report to the Government if they identify such equipment or services during contract performance. The form must be completed by a merchant's authorized representative, signed, and returned to the Contract Specialist. This representation applies to all procurement actions conducted by the Department of State and is mandatory for vendors bidding on federal contracts to demonstrate compliance with NDAA telecommunications restrictions.
