Grant Cooperative Agreement (PHEP) guidelines state that CDC Laboratory Response Network -Chemical (LRN-C) members must purchase instruments the meet the exact specifications for performing LRN-C chemical terrorism methods. The preowned and refurbished Agilent Mass Selective Detector (MSD) will be connected to an existing Agilent Gas Chromatography (GC) Mass Spectrometer analyzer. The MSDs work in conjunction with the GC-MS analyzer to produce results.

In accordance with 60A-1.045 Florida Administrative Code, the Department of Health, BPHL requests authorization to purchase, as a single source, a refurbished Mass Selective Detector (MSD) 5977B Mass SD model from Agilent Technologies, Inc.

Justification for single source acquisition (what is necessary and unique about the product, services or source; steps taken to confirm unavailability of competition, as appropriate):

• The refurbished Agilent MSD is compatible with the existing GC analyzer. The compatibility of these instruments is required to ensure the functionality and accuracy of results.

• Agilent Technologies, inc. is the only vendor that can provide the MSD that works in conjunction and is compatible with the existing, attached Agilent equipment.

• The Agilent system and software are propriety. They are not available for modification or redistribution.

Prospective vendors are requested to provide information regarding their ability to supply the commodities or contractual services described. If it is determined in writing by the agency, after reviewing any information received from prospective vendors, that the commodities or contractual services are available only from a single source, the agency shall provide notice of its intended decision to enter a single-source purchase contract in the manner specified in Rule 60A-1.045, Florida Administrative Code, and section 120.57(3), F.S.
