PAYMENT ADJUSTMENT PROCEDURES

1. Payment Adjustment Procedures Associated with Government Correction of Performance Deficiencies. If the Government corrects performance deficiencies either with its own resources or with other commercial resources, payment adjustments may be made in the amount of the excess costs of such corrective actions.

The procedure for determining these excess costs entails the Contractor including the costs of the deficient work in his/her invoice as if it were acceptable; and then, upon receipt of the invoice the Government deducting the total costs of corrective actions from the invoice amount. The Contractor will be advised in advance by the Contracting Officer or COR of such deductions, but not of the corrective actions themselves.

Also, the amount of the related deductions as well as their method of computation will be furnished to the Contractor for his/her information.

2. Value Determination for Individual Item Cleaning Services. Since the bidding schedule contains pricing for cleaning services on a monthly, lump-sum basis, the individual costs for performing cleaning services for each type of facility, i.e., a rest room, is not readily available. Therefore, based upon:

a. the historical costing of unit-price type contracts for the same services, and,

b. the Contractor's response to questions 5 and 6 in the Appendix J Assessment of Work Understanding, and,

c. an analysis of the amount of effort required to properly clean each type of facility, The Government will establish relative weights representing the effort and total individual costs for each job.

These weights will be used to subdivide costs for each job.

3. Sample Weights. Sample weights are shown below. However, these sample weights are not binding and should not be taken as being in any way accurate. They are presented only to illustrate how the system will work. This list is does not represent all types of facilities to be serviced.

Facility Weight Facility Weight

Comfort Station 40 Picnic Shelter 20

Jug Filler Hydrant 1 Picnic Table 5

Grill 4 Exterior Trash Receptacle 4

Grill Service Table 1 Drinking Fountain 2 Playground Equipment 15 Playground (Surface) 10

4. Payment Adjustments Associated with Deficient Work Not Corrected by the Government. When performance deficiencies are not corrected by the Government, payment adjustments are to be made for each item of work determined to be unacceptable. Such adjustments will be made based on the applicable monthly price for the item multiplied by the quantities of deficiencies for that item. This payment adjustment procedure will be used only in relation to item cleaning services and not for litter-pickup service. The total monthly value of deficiencies determined by this method will be deducted from the Contractor's invoice amount in accordance with Paragraph 5.2.3.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT YOUR EVALUATION OF

THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional

Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner.

A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating.

Also, there should have been NO significant weaknesses identified.

(VG)

Very Good

Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory

Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.

There should have been NO significant weaknesses identified.

Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal

Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/ Owner.

Source Selection Information -- See FAR 2.101 and 3.104.

RATING DEFINITION NOTE

(U) Unsatisfactory

Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable

No information or did not apply to your contract

Rating will be neither positive nor negative.
